My husband is a Commercial producer, and frequently does his own shoots. And if there is ANY safety issue, he does a meeting with anyone and everyone present during the shoot. And that’s just for a short spot.

That's why I found the broad statement that, "there are no safety meetings these days," odd. I've _never_ worked on a show that didn't have safety meetings for a number of dangerous things (including guns, fire, explosions etc). That's partly why this was so egregious, because most of Hollywood takes safety meetings very seriously.

My hubs is a professional stagehand with IATSE. He had a MASSIVE rage fit when this broke in the news. Having had worked in all manner of productions from working pyro for concerts, commercials and full length films, he is exact words were: "Who the hell brought live rounds onto a hot set??? Where are the safety logs??" This whole saga is such a tragic shit show. I totally feel for Halyna's family. The unmitigated nightmare they have to live through right now makes my heart shatter into a thousand pieces. I can't even begin to imagine.

@@butterflymoon6368 it just sounds like their husband was rightfully upset about a tragedy that could have been prevented. It obviously seems to have affected him more because he is in that line of work. I don’t mean to speak for OP, but he doesn’t sound scary at all. He sounds angry and upset about a life being taken because safety was not a priority for the people in charge, and those emotions are completely justifiable in this situation.

I know this is legal analysis, but I cried the whole time. My heart is broken for Haylna's husband and son. I lost my best friend of 25 years shortly after her 40th birthday leaving behind a wonderful husband and 2 beautiful children so I have witnessed the devastating sorrow of a family missing a wife and mother.

It was obvious that Baldwin and the other production crew did not take the time to have safety meetings--it would cost them MONEY. Some of the crew pleaded for action and then left when they realized the safety measures weren't being taken and claimed it was a chaotic and unsafe set. Baldwin is unbelievable! He said he had the remaining crew sign a statement denying the unsafe conditions. SURE THEY ARE GOING TO SIGN IT!!! They were covering their own asses and possible lawsuits and knew that if they didn't sign-- that Baldwin could blackball them and they would never get work again. How idiotic!! Baldwin was negligent as an actor and producer and REMAINS one of the most pompous and egotistical actors who exists. I hope the family gets compensated OUT OF HIS FAT POCKETS--even though there is no price you can place on a life. This is so sad.

Didn't Baldwin say it took him 45 min to an hour to understand that a live bullet had been fired at Halyna and Joel? Did he really not understand what "I've been hit" and "ow" referred to???

Brandon Lee was killed by a gun and it had nothing to do with a live round. In his case the gun did NOT have live ammo- it malfunctioned and he was close enough where whatever spat out if the barrel- was deadly. So Baldwin likely thought it was some malfunction and not a bullet.

I worked as a paralegal in occupational safety regulatory compliance for 13 years. I learned that catastrophic accidents don't happen without a series of preventable failures. I've never heard of a fatality that was the result of a freak accident no one could have predicted. It's been very sad and rage-inducing to learn how this seems to have played out on the Rust set. It's not surprising at all that it points to multiple factors or that a big one was management's failure to take safety precautions. It's management's job to facilitate reporting of incidents and concerns, not to stifle them. This is basic OSHA 101 level responsibility. If management isn't told about safety incidents it's because they've created an atmosphere of "don't ask, don't tell," just like this lawsuit alleges. Baldwin claiming no knowledge doesn't exonerate him, it makes it all look worse.

You are exactly right. As an engineer who has done site visits to heavy industrial and manufacturing sites, I have gone through many safety trainings and daily safety meetings. Accidents are almost always preceded by several “near misses”. So sad someone lost their life in an incident that was totally preventable.

Alec didn't need a safety meeting, so, why are so many people focused on such irrelevance? Alec is a 40 year veteran of film. He may well have had a hand in crafting the guidelines. He also knows the rules of gun handling. I don't attend regular gun safety meetings in an effort to help me remember or follow gun rules. Alec knew that taking his gun from an A. D. wasn't in line with guidelines. He did it anyway. Alec knew that the person handing him the gun was supposed to demonstrate the gun was safe. He decided it was unimportant. Then, he proceeds to deliberately break two gun rules: 1) he takes someone's word for the safety of the gun. 2) he then decides not to check his gun (this requires 2-4 seconds). Then he proceeds to break the remainder of gun rules: 1) aims the gun at a person (18" from Halyna's lower chest) 2) places finger on trigger then pulls the hammer back 3) lastly, he does the unthinkable: he squeezes the trigger. He coincidentally did this series of inconceivable actions on the same day that no armourer was present and the monitor was missing which put Halyna right in front of him. Lastly, what's the personality profile of this guy? Would any other movie star point then fire an unchecked gun at someone? Tom Cruise? Cage, Clooney, Pitt, Damon, ... anybody? How about Tom Hanks? It's something to consider that only one famous actor fits the profile of someone who could shoot someone "accidentally" on s film set. I'd bet everything I have that Clint Eastwood has never pointed then fired an unchecked gun at someone over his 60 plus year career.

He cannot check the gun. That goes against the rules of filming with a firearm. If he checks the gun, then the armorer has to take it again and recheck it to make sure he put it back together correctly. The rules for filming with a firearm are slightly different from any other firearm operation. If an actor is told the gun is cold (by the armorer), then they are not supposed to have to worry about rules like "always treat it like it's loaded" or "don't ever point it at a person"...because sometimes the scene requires them to point it at someone, or at the camera. Alex Baldwin is responsible. But mainly because he was a producer, and didn't ensure his film set was following industry standards.

44:10 the "Awesome Sounds good" to me looks and sounds like a response to "and wrap should be like 30-45 i think". it looks like the person responding was asking if they meant accidental discharge of firearms and then responding to the wrap time not that they think the accidental discharges were awesome or good.

The demonstration that a weapon is clear and safe is standard in any environment involving firearms regardless of whether you’re on a film set or not. In the military we always demonstrate that the magazine is removed, the chamber is empty, and the safety is on before issuing a weapon to someone. This applies even when removing the weapon from the armory first thing in the morning even though it was cleared before being placed in there. The fact that they skipped this basic step is beyond negligent.

Reminds me of OSHA; their rules are written in blood. These industry standards are written in blood. I'd be surprised if this case doesn't lead to further change in the industry to prevent further tragedy.

Those rules already exist. Doesn’t help if they don’t follow them I haven’t worked in the industry in 20 years and can tell you 3 people in lots of trouble, ad , armorer and production manager. Based off the way it used to be done, because these 3 regardless of union or non union, know exactly how to handle scenes with firearms.

Here's my current theory: the reason the prop company owner was talking trash about Gutierrez was that he, his gf, and sister were planning to set up the armorer so she'd be fired. Then the particular demon who looks after muddles took the wheel.

Safety first. That's what we teach the preschoolers at age 3 and age 4. Even my four year old demands I wear my seat before the car starts moving. Follow the effing rules, follow simple Safety protocols . Where was the plexiglass? Why point at her & clearly at others too, without it? Even George Clooney spoke out about the ridiculous idea of not checking a gun or having the hired armorer do so before actor handles firearm. It would've taken how many minutes to take out, look at the bullets and shake each one?

I completely understand feeling weird about placing a dollar amount on the loss of a person. When I was in grad school studying Operations Research, one of the things I found difficult was optimizing construction operations where one of the factors is the expected number of deaths on the construction site (this is why I moved into software development).

It seems like it would feel dehumanizing (to a person who passed) to have to decide how much their life is worth, even though it’s not intended to be dehumanizing. I feel sorry for those who have to go through that process, and I especially feel sorry for Halyna and her loved ones.

Yes we had to study the projected cost of a human life when I was in school for engineering, to determine if it was more cost-effective than issuing a recall. I no longer work as an engineer.

The simplest way to conduct an investigation. First establish what should have been done. Second establish what was done. Third compare and contrast the two, and the guilty parties can be seen through the gaps.

"...there are no safety meetings these days..." I'd be interested to know if that was actually a statement from the client or an assumption from the attorney. I've worked on multiple sets as an extra, and every single show I've worked on had safety meetings when a gun was involved (real or fake) as well as other potentially dangerous things on set. Multiple other commentors, who have worked in Hollywood, have said this as well. Based on first hand reports, there were obviously none on this show, but it's by no means applicable to the entirety of Hollywood.

I think Alec being a hothead, has an intimidating presence to him. I think the assistant who handed him the gun was intimidated of Baldwin and did what Alec asked him to do. Others probably did the same where Alec was concerned and broke protocol for this reason.

It was a producer-director who handed Alec the gun, not the weapon tech. That is not protocol on a movie set. There were so many glaring errors on the set. Sadly, it ended in tragedy.

The response is to both statments, so "Accidental discharges on the firearms" is for message 1 and "Awesome. Sounds good" is about the second message regarding wrap.

Right?! I've never been on a set where there weren't safety meetings. Most other productions (especially large ones) _always_ have safety meetings for any potentially dangerous scenes.

Haha I worked on Real World Chicago for the General Contractor. Small world. Very small interior build-out for what we were used to and yes, weekly safety meetings at a minimum. Our bigger projects included an on-site safety manager. Maybe that’s what these movies need to oversee these kinds of messes and ensure they don’t ever occur again.

@@MollyZelko2.0 100% agree. Maybe it's something that's a problem with indie films/smaller productions? I've never worked on a small indie film, so I wouldn't know, but that's the only thing I can think of being that case. There have been countless other actors and crew confirming (in interviews and the comments section of previous videos) that safety meetings are prevalent.

Especially with how much he was making a big deal about it being "his movie," before this, then trying desperately to distance himself afterwards with, "no, no, I'm just a producer, I didn't have any say, yadda yadda." Funny how you want the credit when everything's going great, but the minute you have to take responsibility for shit hitting the fan, you suddenly weren't running things anymore. 🤨

Emily re: the I don’t know why it is so hard to read and pronounce the names. It is because they are written in all caps and in bold. You don’t have the shapes of the word that help you to see not only the letters. It means you have to look at each individual letter and calculate how it relates to the letter prior and option for how it interacts with letters afterwards. With lowercase and capitalization you can see the shape of natural groups of letters, and read them much easier. Standard dyslexia issue.

I put it down to the fact that she's from the USA. Ya'll really (on average) are atrocious with any name that is slightly foreign. I really enjoy your content, but I am getting distracted by how the audio spikes right after the swooping. Right after it becomes really loud until kind of flows black into normal, it has not been like this before, maybe you have already addressed it, is there any chance it can not spike? since it hurts my ears when I wear headphones

That was ridiculous!! And not how it works at ALL! He should have checked that gun WITH the armorer, and announced to everyone that it has been DOUBLE checked and safe, and if anyone else wants to check it, they are welcome to do so. You don’t just go off of what ONE dude says 😂 that’s precisely how people get killed.

5:57 any revolver can be fired without pulling the trigger. That's the entire point of the hammer (which should lock when pulled back all the way) because the hammer is what actually causes the gun to fire. If you pull it back partially and it doesn't lock, the hammer is going to hit the primer causing the weapon to discharge. It's not complicated and honestly doesn't need "investigation to determine if it's possible." 🙄 I mean, I get it, for solid investigative purposes; they want to have all the proof to have a solid case, but that specific statement is silly. The original gun isn't even needed to determine this either. It applies to pretty much every revolver. The trigger is just there to cause the hammer to snap back.

That not true. Many people have demonstrated this with revolvers very similar to the one in this case. Releasing the hammer is NOT enough to fire a round without the trigger being pulled, but it is VERY easy to pull the trigger a tiny bit without realizing it if your finger is on it, which is likely what happened here.

@@olhydra Do you not understand how a revolver works? What I said is true. That is literally how a revolver works and what happens when the trigger is pulled. If you pull the hammer back far enough without locking it in place, it has the same amount of force as if you had pulled the trigger. The hammer is what fires the round because it's what hits the primer on the bullet. There's a risk of it firing (depending on the bullet and the amount of tension on the hammer) even if you don't pull the hammer back that far. This is the whole reason why people carefully reset the trigger - even with hand guns.

@@Amarianee Sorry but the people here who don't understand how a revolver works are you and the district attorney. First off ther are a series of notchs that the hammer engages with as it is pulled back. If released prematurely each notch will catch the hammer preventing it from falling any farther. On top of that as the hammer is being drawn back the cylinder is revolving into firing position (thus the term Revolver) if the hammer is released prior to being pulled the whole way back the cylinder won't be properly indexed and a primer won't be in position under the hammer. Ther are several videos on KZbin explaining this, there are also several contradicting it. However in those that contradict the process there are glaring errors. In one you can clearly see that the trigger is being held back with a rubber band in several others they are using a modern reproduction firearm which features a transfer bar safety system. A gun using this system is capable of allowing the hammer to drop from a half cock position but the gun can't be discharged not only because the cylinder isn't properly indexed but because the transfer bar won't engage unless the trigger is pulled.

oh, yes - setting up this young woman and having near misses and other mishaps, would have put everyone on edge - Alec should never have pointed a gun in anyone's direction and pranksters messing with everyone, should be jailed when their 'pranks' end up causing harm/death - end of that person's story.

If Baldwin were just an actor in the film instead of also being a producer, would he still be included in the lawsuits? (I.e. would he incur any charges/civil suits as an actor only)

@@angelipie2592 If he were only an actor, ensuring the safety of the set as a whole (which is what this suit is ultimately about) would not fall under his direct duties. If a chemical plant explodes because one employee opens the wrong set of valves, it's the chemical plant that gets sued, not the employee (even if the employee survived). When someone is an employee, some of their actions/inactions while on the site can be attributed to the company. The key is whether the behavior is reflective of company practices or deviant of those practices. (Quick note: wrongful death suits are typically divided into percentages of fault between different accused parties.) Put simply, if Baldwin were only an actor, his personal actions would be a much smaller percentage in this wrongful death suit than in the current situation. So while he would be included, he wouldn't be as big of a piece.

He'd likely still be able to be charged for unintentional murder aka man manslaughter. The other people in charge of checking the weapons would probably be charged (and might be being) with 2nd degree because it's flat out negligence that was 100% avoidable had they not neglected their duties. That being said, it could be manslaughter for everyone involved. Just depends on what the prosecutor or the suing party's lawyer (depends on civil vs criminal case) chooses to do.

This is what happens when You let a stupid city slicker play with a real gun for the first time. As a kid I was taught @ 13 years old (in the country) NEVER to point a gun (loaded or unloaded) at a human being unless it was life or death. I think Baldwin should go to prison. Ignorance is no excuse.

Been re-watching these videos and I think in her lawsuit Hannah does mention shaking each bullet as she loaded the gun at the start of the day. She doesn't say she checked every round in the box, though.

I think recklessness started when they decided to not use a dummy revolver and when live ammunition made its way onto set. We can talk about improper firearm handling all we want, but if those two things hadn't happened, no one would've been able to get shot.

Forensics actually recreates all of that simply by knowing where the shooter was standing and the victim too (taking into account the angle of the wounds). Having additional info on top of that helps. So they know exactly what happened and they also know he DID pull the trigger.

Sloppy business handling! I’ve been a District Manager for 40 years and supervise 12 stores. OSHA is a guideline that protects employees from accidents! It’s a requirement for all business and is broad enough to encompass any business. Standards must be followed and monthly meetings to ensure protocol is monitored. In 40 years I never had an account. So we know there were other safety violations and negligent discharges on set. Do you think it’s possible that those guns were also tampered with along with the one that Alec had? Speculation of course and I could be totally wrong but it would be interesting to know first if the one Alec had was tampered with and then see if the other guns on set had been tampered with as well which could be more evidence of sabotage.

They are taught to never aim a gun at someone, treat it as if it is loaded, and he was supposed to inspect it himself as well per the rules when it was put in his hand. Also, if they were just running angles, it should have never been loaded with anything at that moment anyway.

Have you heard the DAs office is saying they tested the same scenario and agree with Alec baldwins statement that the gun fired without him pulling the trigger? If that’s the case I don’t think he will be found guilty of anything

@@susanw9111 If Alec had attended the gun training session the armorer hosted, he'd have known that - for this gun - pulling back the hammer is the same as pulling the trigger. His irresponsible, reckless decisions and behavior killed another human being.

The Armorer I feel did not have the experience or the temperment of being able to back up the laws and safety rules. The fact that the Armorer did not shake each individual bullet. They also have reports of the workers who walked out said that the guns were used for target practice which means that live rounds were on the set. I think the Armorer is sueing to gaslight. They did have 2 safety meetings but that is not enough. I don't know if Baldwin yelled and cowed some of the crew. But when he is the producer he is liable as well as the other producers. But the laws should be tightened like the crew wearing safety vests and or equipment. This tragedy could have been avoided. A young woman has died because of their neglectful actions and cutting costs.

She was given unrelated duties and inadequate resources to do the job responsibly. Her authority as armor was no reseted. It is sad that she didn’ have the foresight to quit before this happened. She stayed because she was trying to build experience. Now Baldwin and others want her to be the scapegoat.

I really like how this is written. That list of what they say the Producers and Rust Production Companies had a duty to do is completely overwhelming, as it is meant to be. As just a regular human being reading it, it's so uncomfortable. I'm thinking: Wow, we've not seen evidence they did ANY of that, and plenty supporting the allegations that they did not! Of course, that's the whole point - I'm supposed to think the Producers are liable for everything, and that there is no possible thing they could say that would convince me otherwise. I don't even know how anybody could possibly argue against this though - the facts are so damning. Like, just give up. Give up and surrendeer.

Funny, the expert I saw going through that type of gun did so clearly I could see myself doing it by mistake. You didnt have to pull the trigger, just let go when cocked and it would go off.Having said that he knows and should have known better, pointed the gun at the ground whilst making adjustments. The whole safety and office politics is a joke.

@@raw6460 Yup. All pulling the trigger back does is release the hammer, which is what initiates the firing. That's precisely why you're not supposed to play with guns (along with other obvious reasons as well), because if that hammer is cocked and released it can still go off .

Personally I feel like Hannah shouldn't be at fault because 1. She did not bring the live rounds on set, 2. She was rushed and who was to ever expect there would've ever been live rounds on set, and 3. It's Alec 's fault for shooting it, and whoever brought those bullets on set is at fault to. Idk why this Case is taking so long lol

I understand where you’re coming from and she’s cute and Alec is a jerk and he shot her and it’s easy to want to make him responsible and not her and I’m w you 100%…then I take my feelings out of the equation and decide as the armorer she has a responsibility and failed at her job many times but to what degree is she at fault? That’s a tough question I’m not prepared to answer and perhaps so many more ppl hold more liability than she does hers won’t even matter if that makes sense.

It isn’t necessary for her to know about live rounds because you MUST always assume there are, and THIS scenario is why!! This is why the gun is Always checked and rechecked before handing it over, then the next person ALSO checks it! Her ENTIRE job as armorer was to make sure the set was safe no matter WHAT. She wasn’t willing to do that tho. Imagine a police officer who picked and chose their battles and who they would go after based on how they felt uncomfortable. This ain’t hard- if your job is to keep people alive and safe- you must be willing to adhere to that at any cost. Sheish, gen Z’s are so entitled.
