Navigating in a car is no different than navigating in your life. It's not just you in your life. You'll encounter other people that you have to be prepared for. Other things. And if you ever lose control of your car, ever lose control of yourself, ever lose control of your life or anything in it which has the direct consequence of something being lost... Either it's a shame, or you should be ashamed, and the only difference is if you stopped and/or removed yourself from the situation when you could have or should have, at least long enough to get help in getting and keeping control of what you need to to prevent losses. The crime of road rage isn't what your rage did. It's what not doing anything about your anger issues before then did.

Unfortunately, when you plead guilty, you normally waive the right to appeal. He could have withdrawn his guilty plea when the court decided not to follow the plea agreement, but a jury trial is always a crapshoot.

I love Judge Simpson but I don`t agree with this ruling. One thing juries are always told is not to let emotions factor in a decision. I think Judge Simpson did let his emotions factor in this decision. The girls were driving recklessly when they hit the defendants car and when they left the defendant. There is no evidence the defendant actually caused the crash. I agree this is very sad and if they were my daughter's I would probably feel they were wronged too, but that is why Judges and juries should only make decisions on facts.

He, the victim, pursued them as often happens with a hit and run, usually to get their license plate and insurance info. The girls fled, and still drunk and high, crashed a second time and died. The prosecution, realizing that they couldn't hold him responsible for that other accident, decided that they would charge him for leaving the scene of the accident in which he was the victim of a hit and run (which often doesn't happen, because why would the victim stay once the perps have fled??). Well, the judge did his own investigation into the crash that this man isn't on trial for, which is misconduct to even consider evidence not submitted into the case (which couldn't be admitted because this case isn't about that crash). Well judge Simpson decided to refuse sentencing guidelines and sentence him to the maximum possible in order to punish him for the accident that he isn't responsible for and isn't on trial for! Can you imagine being sentenxed to 90 days in jail, 2 years probation, 100 hours of community service, $1,550 in fines, and have to undergo random drug testing and a driving safety course, on the charge that you were a victim of hit and run and left the scene of an accident where the drunk and high perpetrators had already illegally fled? Because that is what happened in this case.

Those girls essentially killed themselves by fleeing at a high rate of speed away from the scene of the accident before he even started following them. They did exchange information and he waved them off then they accelerated and sped away. It was their own reckless driving that caused their death and their family couldn't accept this and pleaded with the judge to fix it the only way they could which was by giving this guy jail time. I was disappointed to see him in a case, within the past few days, where he was making fun of a litigant and laughing with his staff about that person. It happens sometimes before or after he hears a case, which is troubling enough, but this was in the middle of the proceedings as that person was walking to the stand! I love Judge Simpson but he allowed himself to become impartial due to the mother's statements and their understandable grief. As the defense attorney who had to amend the original agreement with the DA to include jail time, I would've been very tempted to allow Judge Simpson to continue his hearing and then hand down his modified sentence knowing it would most probably overturn at the appellate level. But the client might've spent more than 45 days during that process. It's sad two young women died but it all started and ended by their own actions.

The defendant pursued those girls, ostensibly to get their license plate number. The girls were driving recklessly and rolled their truck over at the railroad tracks. (There were also allegations that the “victims” may have been under the influence when the accident occurred.) The defendant pleaded guilty to not stopping at the _first_ accident. The plea agreement did not contemplate jail time, and no one would reasonably expect jail time for leaving the scene of a minor fender-bender that you didn’t cause. The girls’ mothers, who are unable to accept that their daughters caused their own deaths, were unhappy about the plea agreement, because they believe that the defendant caused the second accident by needlessly chasing the girls. They begged the court to launch an independent investigation into the circumstances surrounding the second accident, which the court did. The judge concluded that the defendant had lied about how far away he was from the second accident (which the defendant was not charged with) and therefore chose not to follow the plea agreement. He was prepared to sentence the defendant to significant jail time. The defendant’s attorney objected to the judge’s independent investigation into facts that were irrelevant to the offense that the defendant actually pleaded guilty to, and he threatened to withdraw his client’s guilty plea. The judge delayed the sentencing to give the defendant time to decide whether to withdraw his guilty plea. At this hearing, the judge still decided not to follow the plea agreement, although I get the impression that he did not order as much jail time as he would have ordered at the previous hearing. I had a guy cause $7,000 worth of damage to my car during a hit and run on a car repair lot. Luckily he was caught on camera and I went to the police station daily until an officer went to his house to cite him. His insurance company reimbursed mine but he was never prosecuted even though he committed a prosecutable infraction.

I like Judge Simpson but he is wrong on this one. He allowed emotion to cloud his judgement. The simple fact he calls the girls victims shows he isn't being neutral here. He kept saying it was the best he could do and that the girls need to be remembered. They were not victims as he isn't being charged for their deaths. He pled guilty to fleeing the scene of a minor traffic accident. 45 days in jail for that is completely out of line and I think Judge Simpson knows it. You are unaware of the facts of the case. The victims hit the defendant. They stopped, exchanged information, and defendant waved them along to go. They left. The defendant called the police and said he was chasing them to get their information, which he already had, then slammed into them, as they did to him. Two girls were killed and one survived. Defendant is very lucky that the police and prosecutor dropped the ball on this one, as his original sentence of wreckless was 15+ years.

I'm not being a smart alec, but maybe you did miss something. Judge Simpson used a satellite map which he displayed in court which was not a part of the trial but was used for sentencing. The judge suspected the defendant's story did not add up and the judge was basing the sentencing on that.
