Mine is in 2021 as well, is it really 50 years? Also the am22tech calculator not working, any other website for the calculation?

Ideally it depends on your country of birth. For countries like India and china the wait time is significant as the current backlog is huge. For India right now the wait time is insane as more number of people file for GC vs the total available GC every year and that is only increasing every year. If the am22tech is not working try searching for other calculators on google. Please note none of these calculators will give you exact date or accurate prediction as there are multiple factors to it.

EB2 ka abi ke timeline ke hisab se 12-15 mahine lagre hai due to backlog but kuch months mai yea improve homa chaiye as USCIS is trying to improve the process. Ideal scenario mai minimum 9 months lagta hi hai. Hope this helps!

Thank you so much, Saurabh for making this video. This is very clear and insightful. I have 3 questions if you can answer those please: 1. I have heard that we have to renew visas every 1 year but you mentioned it is 3 years, so a little confusion there. 2. Once the PERM is filed when it is safe to change the employer who filed our PERM? 3. Is it true that we cannot get a promotion or salary hike till our i140 is approved?

Thanks for your comment. Below are my responses. Please note this is just based on my experience and no way a legal or immigration advice. 1. So ideally once your i140 is approved your employer can file for extension of your H1B. Lets say if you are working for a client and that project is only for 1year or x months/year then in that case there is a probability that it will be only extended until the project date. But usually every extension is given for 3 years if all paperwork is in good shape. 2. Once the PERM is filed its not advisable to change employer as its only filed and not approved. So if you leave the company then the employer can stop the process and you have to restart it again. Now another point is, once you get your i140 approved then also it’s recommended that you stick with the same company for 6 months as during the initial 6 months the employer can still withdraw your application if you leave the company. 3. You can get promotion or hike but if you got promoted into a different job function then entire process has to be redone. Lets say right now you are working as an application developer and in 4-5 months you became Sr application developer then a slight amendment has to be filed assuming your job duties has not changed more than 50%. Flip scenario is if you are a Sr application developer and now became a Software development manager then the process has to be restarted. But always consult with your lawyer as every scenario is unique and different. Hope this helps!

Is the processing time is less if we have L1 visa and we are starting processing for green card

Yes if you have a L1A its ideally done very fast, way faster than H1B. Usually L1A visa qualifies for Eb1 category for which processing is immediate. Check the visa bulletin online to see what is the current processing time but last month it was current for all nationals in Eb1 category. Hope this helps!

Current processing time is variable anyway from 10-18 months. One of my colleague PD is current (in EB2) and his GC is still under processing from the past 8+ months so can’t really predict the exact processing time.

@@nagendrababu8869 thanks for the question. So for Eb2 category you need to have an US advanced degree or equivalent foreign degree so it could be either a Masters/PhD and if not advanced degree then even a bachelors degree work but then you need to have to show some exceptional skill in your area of work like some advanced certification, some great recommendation letter, etc. I would say the immigration lawyer can help you creat the case better. If you are getting a chance to get your green card filed in EB3 then go ahead with it. Main point is to get your filing done soon so that you get a priority date. Once your i140 is approved you can stay in US until the time you get your GC. Just that you have to maintain employment and then before every H1B expiry your employer has to keep on refilling for H1B extension until your get your green card. Hope this helps.

I don't think it takes that much time. For Indians, you will get in less than 15 years max. I confirmed it with the attorney. May I know on what basis you are saying that it will take more than 50 years?

India EB2/3's current PD is 2012, which may give the impression that there is a 10-year delay. But it would only be accurate if the number of cases and the number of available visas were equal. Only ~5k GCs (including families) are available for Indians under EB2/3 in the absence of significant spillover or legal changes. While the annual number of applications is 5-10 times larger. The pandemic-related consulate closures over the past two years have caused dates to advance swiftly from 2009 to 2014 before going backward. Prior to that, the transition from 2009 to 2010 took 6/7 years. Therefore, if the dates advance by one year every five years, it might easily take 50 years for someone whose PD is 2022. I may have missed few numbers here and there but mostly this is the situation here and why it will take a lot of time. Hope this helps!

@@Ankit-hs9nb I am not sure on why all attorneys are not saying this. Maybe you can share few data, current state and then ask them. I had a discussion with mine and shared all the data points to which they agreed. Now unless there is a significant law change (read removing the per country cap rule) the overall processing time will remain same. Hell, it will even increase for newer folks as more and more people will be applying every year.

@@Ankit-hs9nb Every now and then someone introduces a bill to change it but it never goes past from being just a bill. Read about the ‘eagle act’ to learn more about the latest bill on the per country cap removal.
