As a licensed dealer you should know better then to allow this to get this far. You should not have sold the car until it passed inspection. You should have payed for the inspection even if 90 days had passed. You should have never went to court over this and you should've made it right with your customer even if she was squeezing you for a few hundred bucks. As a dealer myself the number one rule is to always stay out of the courts and avoid attorney's fees. YOU are to blame for poor business choices.

I got sued 2 years ago and spent 26k to defend my dealership. All of that is to settle for $1500. Here, in CA, attorneys illegally find people using our corrupt DMV and auctions and then offer them money if they say they bought an unsafe car. Everyone I know dealt with this law firm. I am honestly surprised they still do this to this day.

I feel your pain. I’m a used car dealer of 27 years and a being sued by a guy who bought a nearly perfect Mercedes S550 in August of 2021. First time he sued me in May of 2022 it was dismissed. Now he’s suing again. My attorney told me just fix the car, but the cause of the complaint was a faulty remote start installed by a friend of the customer. Remote start caused failure of the electronic ignition switch. Now I just sent out the switch along with the key and PCM to a rebuilder so we can get the car started. I am in liberal Massachusetts so my attorney says I may lose in court even though I’ve done nothing wrong. Already up to $8000 in attorney’s fees and a couple of grand to fix the switch. I closed my store in October and I’ve been stressed about this since March of 2022. Good luck with your case. It sucks because the consumer always has the advantage over the big, bad used car dealer! Also, I met German when he came to my shop in Fitchburg a couple of years ago. Great guy.

The car passed the safety inspection. It was the emissions portions that she had to return for. She crashed the car 3 months later, and is attempting to claim the crash was because he never gave her an emissions sticker. Of course she did get it inspected elsewhere and using it as the excuse to scam and get one over on the court system.

A car dealership should know already that the license plate will attach to a vehicle identification number She may have had an accident that was never recorded You could have made her an offer to buy the car back at fair market value. You still need your profit whatever you’ve sold the car for. And then resell the vehicle again somewhere else. Just thinking out loud. Avoid the hassle, and never hire an attorney for something this frivolous.

When I went to look at my truck from a dealer we set the alarm off before he got there as my brother opened the rear driver side door. Found out it wasn't locking with the power locks, So the guy pulls in as the alarm is going off. I told him I been pricing these trucks and saw some that were 3k cheaper but were not local. We go to look at it open the hood and the oil dipstick was missing. He told me if I wanted it for 15k I could have it for 15k. I told him as long as the test drive goes well and he buys a new dipstick and it checks out ok I would buy it. He bought the dipstick on the test drive and the oil was fine and it drove well and seemed like a good truck. Haven't had an issue with it.
