I’ve been a permanent resident since 2001 got it through my dad he is a citizen since 1995 or 1999. Don’t remember. I’m 42 yrs old and my card was expired when I left Texas I sent the I90 got he extension for 12 months and waiting for my green card to come in , my question is can I travel! My card is 10 yrs expired and the extension talks about 12 months of expiration date so what I understand I can’t come in back to Texas….???????? I don’t know………trusting God everything works out!

Permanent Residency means, permanent residency. If your visa is valid, you must be let in regardless of how long you have been out or in. Some stuff in the US makes no sense! Really convoluted immigration rules indeed!

Hi, thank you for this information, but I wonder if he is from Germany (VWP Country) why didn't he get an ESTA visa to enter the US without risking the confiscation of his GC by CBP?

ESTA visas are used for non-immigrants who do not hold green cards. Our client already had his green card, so what he could apply for is the SB-1 visa. However, the consulate might cancel his green card right away because he’s been outside of the U.S. for many years. Many of our clients who hold green cards have the same concerns, so that is why they don’t apply for the SB-1 visa to reenter. Great question and thank you for asking!

I am a US citizen, my wife has a green card we are both over 70 years old. Why the US immigration does not have a policy for seniors green cardholders to remain over 12 months outside the US..we have done everything that a normal citizen does,--still, pay taxes, drawing Social security..and other things that prove even we are out we still return to the US,, of course, we are retired.-. we like to travel all over the world and remain over one or two years in other countries, I think they should amend these rules for Seniors over 70 years of age.. what shall I do to request this change of polices

hi i am 2 year conditional greencard. i was travel outside usa with my daughters. Who is derivative dependent to me we dont intention to abandoned my greencard its because. 2020 lockdown in my country has travel restrictions. And unfortunately. My husband's hospitalized here in .my country. my greencard Expired last 2021 nwo im still in phillippines. we dont fly back Because financial problem also my husband. Going back to texas soon does he can apply this I-751 to me so i could. There was a case of a woman similar to yours, she was from Hong Kong or something like that. She was able to argue in court that because her parents took her away as a child the decision wasn't hers and she wanted to return upon turning 18 years old and becoming an adult. Ultimately, she was successful in court and went on to live in the US 🇺🇸. Remember, once you are an LPR or green card holder you are one for life, the only way you loose that is through voluntary surrender or a judge rules against you. Technically, you could try to reenter the US. If you do this you may get the card confiscated and a cout date in federal immigration court.
