Wow! I wish to know you as this kind of professional before I have given up my Green Card. I was outside of the USA for about 7 years. I got one attorney from the USA for the Returning Resident Visa application. She said that the case will be more likely unsuccessful... From your video I understood that we basically didn't prepare it - just a few documents, not real petition with the evidence. Thank you for the video, because now, since 2013, this is the first time when I feel validated in the right way, because if we put more effort then, I can see now that result would be different. I am now uplifted by you and do appreciate it.

We’re really sorry to hear about your experience, but we’re glad the video brought some clarity. It’s tough knowing things could have gone differently with more preparation, but we hope this insight brings you some peace. If you ever need advice or just want to chat, we’re here for you. Take care!

Hi, I am a US Citizen, my wife was granted an IR1 Lawful Permanent Residency (LPR) and a Social Security number on 5/19/1997, and lived in the USA with me until 3/17/1999 and she had not returned to the USA since that date. Her Resident Alien Card expiry date is 06/10/2007. My QUESTION is; if her LPR status is still active or not, and if I should file Form I-90 or Form I-130 all over again. Thanks
@TsangAssociatesPLC4 ай бұрын
Hello! For your situation, since your wife has been outside the US for an extended period, her LPR status may be considered as abandoned. However, I recommend scheduling a consultation to discuss the specific details of your case and explore the best course of action. You can reach out to us at media@tsangslaw.com for a detailed discussion.

Been abroad for 3 years with my US citizen spouse and kids for his job. I only want to visit family for 3 weeks, not ready to come back. Is applying for CB1 necessary in my case, as I am not returning? (My green card is still valid and I would need a visa if I did not have it to enter US).

Hi, I am aware permanent residents have little trouble when they travel abroad for less than six months in one calendar year ... but, if for instance, a green card holder travels from Feb 1, 2022- Mar 31, 2022 and additionally from Dec 1, 2022 - Jan 31, 2023 .... Would this be considered a three month absence for 2022?? and a separate one month absence for 2023??? or, are the two trips tied together as a four month absence?? I appreciate any info. Thanks.

It would be very, very difficult to prove you didn't abandon your green card. Our firm typically doesn't take on cases where the green card holder has been abroad for over ten years because after that there's a high chance of denial.
