@@ak48 This case relies completely on circumstantial evidence as there is no eye witness in this case. When the prosecution relies entirely on circumstantial evidence, securing a conviction becomes challenging, as each circumstance should point to the guilt of the accused. According to the prosecution, the crime occurred on 30.6.2021. Initially, everyone, including the parents, believed it was accidental hanging inside a closed room. The locked doors led the police to treat it as an accidental death until the postmortem revealed that the victim had been sexually assaulted. With no eyewitnesses, there was no accused initially. It was when the police noticed that the accused claimed not to have seen the victim on 30.6.2021. However, other witnesses contradicted this, stating that the accused had seen the victim. According to the accused's interview given after acquittal, he claimed to have forgotten that he had seen the child on that day. The accused was arrested on 5.07.2021. Many actions done by the police before the arrest of the accused were carried out in a shabby manner. Especially the scene mahazar of the room where the victim child had died. It showed that the windows were locked. It was only when the accused confessed that the police understood the significance of that window. If the window is closed, there is no way for the accused to leave the room after the crime because it was locked from the inside. There are many problems in the investigation; scientific evidence was inconclusive. There was no presence of male spermatozoa on the anal or vaginal swab of the victim or the dress or underwear worn by the victim. The only place spermatozoa were found was the bedsheet, but it was of low quality for DNA profiling according to Forensic report filed by FSL. Pubic hair was found on the same sheet, but DNA profiling couldn't be done due to the low quantity. It was similar, but no DNA evidence was present. Additionally, a fiber similar to the dress worn by the accused was found in the victim's hand, but it was just similar, not identical. Hence, scientific evidence was also lacking. There are many problems in the investigation, especially in collecting scientific evidence. I won't be able to point out every issue in the comment section. In my personal opinion, even if I was the judge, I can't convict the accused in this case. There is no circumstance that I can point to and say the crime was committed by the accused based on the evidence presented by the prosecution. The case is structurally weak, and anything built on it will fall apart. I don't think the police had malicious intentions for saving the accused. Their delay in understanding the circumstances of death made a huge role in this result. They couldn't find the accused in short span of the incident is also one factor and them being poor in collecting scientific evidence is the reason to some extent why this happened .When I read the judgment, I feel they might have even tried to plant evidence to ensure conviction. The pubic hair and semen found in the bedsheet are not reliable because it was unsealed and unpacked with the police until 7.7.21. Remember, the accused was in police custody from 4.7.21 to 5.7.21, then the arrest was recorded. So they had tried but couldn't do much. They might have thought Anal and Vaginal Swabs would show the presence of the accused's spermatozoa, but they didn't. Since the accused was taken into custody only on 4.7.21, there is no point in trying to find the victim's DNA on the accused. Regarding the accused I might have a personal opinion on the accused after seeing the interview but I am not an expert in body language to give my opinion on it in public. It's not right.
