Glad my diving in the Red Sea was between 2000 and 2007, 2 liveaboards and 1 hotel based. 69 dives in all. Moved to Thailand where I have done 2 liveaboards + 2 in the Philippines, another 68 dives. The dive boats are no more modern, but they don't bump into things or catch fire.

VALERIE apparantly flying now St.Vincent flag instead of BVI. Thank you for your always very factual reports.
@jamescronin7742Ай бұрын
The issue with dive boats in the red sea is that there has in effect been a ban on building new boats (or atleast laying down a new keel, so you can't build a longer boat even if you reuse the an old keel. Therefore many operators have added an additional deck on the top in order to be able to get more room on board the day trip boats, and hence allow their passenger count on their licence to be increased. This allows more passengers per boat and higher income. The downside of course is that it raises the center of gravity and also reduces the angle of vanishing stability and hence the number of capsizes once they get beam onto the wind or turn sharply with lots of people on the top decks accross the wind. The reason for the fires is probably multifactorial, but clearly the engines are under the dive deck which is the main way on and off the boat with wooden decks with numerous cylinders of compressed gas and or oxygen/nitrox/teimix sitting around.
@festerofest4374Ай бұрын
Why would there be a ban of new keel/boat construction?
@TerryKeeverАй бұрын
A couple of these have been reported as being built in the last few years
@jamescronin7742Ай бұрын
@@festerofest4374 I'm assuming it limits the amount of boats, as at one point there were so many day trip boats being built / operated you couldn't move around some of the more popular reefs. Its also easier to afford to build a small boat if you are starting out in this buisness with little cash I suspect.

When I was the Marina Manager of a prominent marina in Sydney, Australia I had a boat arrested, by the sheriff for non-payment of marina fees. Incorrect. in the UK arrests may be made anywhere, but they may be made ONLY if there are reasonable grounds for suspicion that the arrested person has committed an offence. In cases where it is not possible to make an arrest, police may ask someone to attend a police station for questioning, but the person may legally refuse that request.

It's also critical in these shenanigans to recognise that legal identity falls generically into two forms of competence, physical and virtual entity. Others exist, "me and my mates" for example, but are not legal beyond conspiracy. Virtual entities (mostly companies, charities and recognised associations) are generally registered so the tax man can track them, but the use of tax havens is likely to be considered nefarious under the Proceeds of Crime Act, which does not recognise the need for proof absolute. In this instance, the authorities are likely considering A to be akin to Sesame Street.

On detailed vs arrested: MY uneducated **guess** is that "arrested" has legal responsibilities for the arresting party to ensure the yacht retains its value during the arrest, whilst detained may involve no responsibilities and the owner still liable to pay all maintenance and docking fees.
@JelMainАй бұрын
In general law, arrest freezes a situation which may degenerate. It simply means "stop". Human rights apply, including the right to enjoy one's property, but may be limited if th situation - in this case a war - persists. A notable precedent was Gerard Bull's Iraqi Supergun, where components presented as petrochemical pressure vessels were nothing of the sort - rather close to home as my father wrote the ISO Standard for Pressure Vessels! Arrest will necessarily progress either into release or remand/seizure, but whereas the former has time limits rooted in habeas corpus, the latter does not, and Courts may be reticent to intervene, considering wars resolve themselves.

I feel really sorry for those crews whose livelihoods are being affected by the machinations of the ethically ambivalent people that employ them. By good fortune I have not been in that position, however maybe we need to remind ourselves that it is our professional qualifications and experience that enables such individuals and just maybe when we’re told to “rename” the vessel that we cherish, we have the courage to say, “no”, reminding ourselves that all that’s needed for evil to triumph is for good men and women, to say nothing.

I am a lawyer (although not a maritime one). My understanding is an order for the arrest of a vessel is a civil order and may be made by the court on the application of enforcement authorities eg, the national crime agency or by a person who has a civil judgement enforceable against the vessel or its owners or anyone who has a legal or beneficial interest in the vessel. A detained vessel is one that can not leave port on the orders of the port authorities.

Crew of Meridian A should be arrested on spot since they participated in a fraud trying to avoid EU sanctions. Crews on superyachts owned or controlled by Russians should reconsider their positions. Their actions are often illegal and there should be no mercy for said people. I think the same analogy would apply if you were detained vs arrested as a person on land. When you are detained you are essentially being temporarily seized so they can investigate to determine if you have broken a law and during that detainment you are not free to leave. You can only be detained for a reasonable amount of time before they either have to charge you or let you go. An arrest means they have probable cause you have committed a crime and therefore can seize you and your property and hold you until you appear before the courts. Now in maritime law I don't know how long they can legally "detain" a vessel without probable cause but I bet it isn't 3 years. If you ask me this vessel has been arrested and a court has determined it is not free to leave the port or go anywhere because there are charges that still need to be answered to. Just my thoughts as I'm not a lawyer.

If the border guards "suspect" that a product has not had the appropriate "transfer" fees paid, they just confiscate it. Even if you have the paperwork on you, they will "detain" the product until they can check it out. If you are on a trip, and on a schedule, you have to abandon the product to them, and go on your way. When you come back, they have "mysteriously" lost the product. On the number of "ran aground": Dive boats have a purpose: get to a specific dive spot so passengers don't have to swim far as they sink to reach the desired underwater feature (coral reef, wreck, or play with the cute cuddly reef sharks). For a wreck, the dive boat wants to be at a particular end of the wreck and the dive master will tell divers where the boat is in relation to wreck so you have orientation once underwater, and know to ascend from the right end of the wreck back to dive boat. A proper GPS can be used, even if you have a very basic bridge compared to the rich people row boats with the fancy gold plated gadget-laden Furomo bridge. This also assumes some experience to position the boat where it needs to be at the dive site (not drop anchor on the wreck for instance). IIf you don't have the fancy bidge with all the gadgets, one would assume the captain would plot a route to destintion to avoid shallow areas and program it into the basic GPS they have. If they just program the destination and drive straight line to it, they are begging for trouble. Coral reefs are often on walls that separate a very shallow sand bar from deep ocean. It doesn't take much to run aground if too close to that wall. I'd write off the "ran aground" incidents as novice navigation skills, unless I get more info on why they did (huge storm pushed them from safe location to shallow waters for instance).
