You are probably correct; in public speaking competitions, including debating or mooting, participants are at a disadvantage if their language proficiency is not as high as that of other participants. Naturally, it is more difficult, although not impossible, for non-native speakers to achieve the same level of proficiency as the top native speakers of any language, however, many non native speakers can reach a sufficient level of proficiency to defeat native speakers by virtue of other merits.
