Just another crime for Redd White's list: Battery, when Phoenix goes to his office to try and get information out of him, he hits Phoenix as a way of showing him that he can't do anything to him due to the fact that he has a lot of judicial figures under his control.

Not only that, but his blackmailing of Grossberg too. I know he said he wouldn't count stuff that happens before the game, but the blackmailing of Grossberg is actually ongoing into the case (Grossberg doesn't defend Maya because of Redd White's blackmail) and also important to the story of the case, so I think it deserves to be included.

In fairness, prosecutors have very, very broad discretion when it comes to filing perjury charges, and rarely if ever do so--particularly in cases where someone lied on the stand while the defendant, since being convicted pretty much implies that any account you gave denying culpability was inherently a lie.

I mean we could extrapolate that spiritual (or demonic) possession would exculpate someone of a crime according to CA Penal Code §.26 as seen at 30:50, due to them not being conscious thereof, thus falling under the fourth listed class of persons non-liable to be punished for a crime. Honestly, that part could be used for a lot of other characters in fiction. Sephiroth could fall under that if you believe in the fanon idea of him being mind controlled and being used as a puppet by JENOVA ever since the Nibelheim Incident.

I think it has to do with Jake being recorded in the locker room tampering with evidence while Angel wasn’t caught. Jake was also an active police officer (granted he was a security guard in the evidence room but still a cop) when tampering with evidence Angel was retired from active duty. Angel merely misled the court with her testimony but it was mostly to gain attention and credibility as a witness. At least thats the way I see it. Also let’s not forget that he attack Officer Meekins and managed to cut him so possibly attempted murder?

I think the only thing you can charge Angel with is perjury. As she provided the evidence she collected to the police, it was filed and properly (within established procedure in the game world), even tampering with a crime scene would be shaky.

One thing worth noting: Real World California does not use the death penalty, as you stated. But Dahlia Hawthorne, Terry Fawles, Simon Blackquill, and Joe Darke are all explicitly stated to have been given the death penalty for their crimes (or alleged crimes). So Japanifornia uses it.

Frank Sawhit does come back in a later game, but he is still serving his sentence, as that case takes place in prison. Granted, it seems implied that he might get out at some point, but maybe he's hoping to get parole.

Yeah, I believe the implication is that Frank's participation in the vocational program is specifically with the goal of getting parole sooner (although they never say the word "parole"). Also, he gets his sentence extended by " a few years", so he presumably doesn't have a life sentence. Or at least, his opportunity for parole has been delayed.

One thing to consider about Von Karma's stun gun charge is that Maya is 16, and therefore the assault and battery charge is assault and battery of a minor depending on how California law defines a minor in these cases, which would probably mean a longer sentence.

29:13 iirc in the game it's stated that May told the bellboy ahead of time to bring coffee at 9 so he would be a witness to her being in the suite and not Fey and Co., which combined with the calm, matter of fact way White speak to Mia implies, to me at least, that they had planned to kill Mia. Edit: also the fact that they knew Mia was going to be in the office at the time because they listened to her call with Maya. If White's intent was just to steal the papers then all he had to do was wait a bit longer.

The first can be explained as being establishing an alibi for the break-in, so doesn't rise to establishing intent to commit murder I think, but the latter point could indeed be more damning. I do still think reasonable doubt remains. For instance, maybe they heard the phone call, knew they had to get the papers quickly because Mia was going to give them to Maya, and 9PM was the first opportunity they had to get it, and they were hoping to be out before Mia returned.

Prij, i do have one point to bring up--a *lot* of the lesser criminals in this would probably be given concurrent sentences instead of consecutive, simply on the grounds that their crimes were minor enough as to not require separate prison time. For example, it'd be hard to argue that Lana Skye poses enough of a direct threat to the public as to require keeping her in prison as long as possible, so I suspect that her sentences would be set concurrent to one another. Additionally, I suspect that a good defense attorney would be able to make a solid argument that Lana's actions to cover up Bruce Goodman's murder were under duress, on the grounds that she knew exactly what Damon Gant was willing to do to prevent the truth of SL-9 from coming out--i.e., she knew that he killed Goodman to keep him silent, and had a reasonable expectation that he would have been willing to kill her if she refused to help cover up that murder. Guaranteed defense? No, but a good chance of it working. On another note, shouldn't Cody Hackins be facing some time for his regular B&E of the Global Studios lot? Or at least a slap on the wrist as a youthful offender...

prij did clarify that the sentences aren't absolute, he's probably giving sentences purely based on what the laws are telling him. if the prosecutor was very good, they'd probably get heavier sentences as well

Your ace attorney with an actual lawyer series was one of the things that inspired me to finally pursue my interest in law, and I've started studying to get a paralegal certificate! Trying to figure out what fictional characters could be charged with legally has been something I've done to help practice making use of my knowledge, so this video has been a wonderful full circle for me. Would love to see more of these in the future! :D

Even though Prij doesnt agree, it could come out during April's trial that Redd White did in fact blackmail her into helping, like he does with everyone Prij only didnt agree cause PW doesnt seem to say otherwise, so in my opinion, April was absolutely acting under duress, and thats going to reduce her sentence(s). Plus, i have a feeling that getting Redd White convicted is so important (as he's a powerful figure) that the prosecution would probably offer April a reduced sentence or drop a few of her charges in exchange for testifying against him later. As the secretary of Bluecorp, getting her to flip would massively screw Redd White over in his trial.

I’m kinda surprised that being an accessory to a crime that didn’t happen is a defense, while you can be charged for actually murdering someone if you attempt murder without actually succeeding.

I've seen content like this before, but this is by far the best that I've ever seen. The level of depth and editing that went into it is incredible. One of the only minor complaints I can make is that there are arguably some crimes that were missed. It's understandable since they are pretty minor or argueable for the most part, but I still want to name some I thought of here: Larry never paid Phoenix for defending him. Redd White stealing the papers from The Thinker could be considered stealing evidence in the same sense of Von Karma stealing DL-6 files. Phoenix Wright definitely broke some laws during investigation (such as trespassing and stealing evidence without a warrant) and some of the people with Phoenix could be a principal to these crimes. Even though we can't accurately judge Redd White's history of blackmail, we can see some of it through his extortion of Grossberg and how he used Grossberg selling out Misty Fey to get his painting and prevent him from defending Maya. Also, Grossberg selling out Misty could be a crime to itself. Redd White also clearly commited assault and battery when he punched phoenix. Cody Hackins snuck into Global Studios, a privately owned movie studio, on multiple occasions. I'd say Sal Manella was sexually harassing Maya Fey (a minor). Dee Vasquez was definitely using the Mafia to threaten Phoenix's and Maya's lives and it can even be argued to be first degree attempted murder as they might have died if Gumshoe didn't intervene. Lotta Heart was clearly breaking a law when she camped next to a no camping sign. Yanni Yogi fled from the courtroom witgout express permission. Don't know if this is illegal, but it could be. Gumshoe's pay being cut by prosecutors. Prosecutors like Edgeworth and Von Karma aren't allowed to do that. Also, based on Gumshoe's $5 annual bonus and how he describes his living situation, Gumshoe is probably underpaid. Again, this isn't much of a complaint as this video is overall phenomenal and very well made, but I just felt it was worth saying. However, if you want to, you could add an addendum to the start or end of the next video in this series clarifying these things to be more thorough. Also, second comment, but there was actually a case in Virginia where a patrol officer was arrested for impersonating a detective, and was charged with 'impersonating an officer.' He apparently did this to intimidate people into giving him access to personal files. I'm unsure on the differences between Virginia and California law in this regard, but it feels like it'd mean Jake Marshall's case would count as impersonating an officer, too.

It's a shame Sal could only at most get 6 months in jail, but other than that, this essay is awesome! It was really interesting learning all these legal terms and technicalities. Prij and everyone did a great job, and I'd love to see these for the other games.

There's some room to cut down on repeating info previously established, but I'm so glad you covered the less open and shut crimes and just how up in the air it is on whether they'd be found guilty. I don't usually leave comments on KZbin videos, but I just HAVE to for this one, I NEED the KZbin algorithm to promote this. I can hardly imagine the hours put into this, and I can feel the dedication put into this video! I'm excited to see what you'd have to say about some of the other criminals in the series, especially one memorable dead red head. This video also was a great reminder to get back into your series as well, as I found it earlier this year and was enjoying it. I've still got a long way to go (I'm on case 2-3, tragic bc it's big top, ik), but I love going through it! To be fair, Frank Sahwit is in prison when he comes back in a later game. That case takes place in the prison he's being held in. So he is still presumably serving life in prison.

This was awesome. I would love to see this continue! For a note about Perjury, it is actually addressed, but not in the trilogy, that I remember. The Great Ace Attorney 1 has perjury as a major plot point for the final case. So it does exist in some capacity in the AA universe, but probably Japanifornia has more lenient laws about it than England

Fantastic video! I'm a bit of a law nerd - in the specific sense of I find reading legalese and hearing law be talked about fun, but would never go to law school - so this whole video was a delight. I'd actually be really interested to see if you would convict any of the 'heroes' of anything. We already know (and disregard for the sake of stylistic/gameplay absurdity) that Phoenix absolutely tampers with crime scenes and Franziska and Godot would be held in contempt of court for assaulting the defense, but what would you make of, say, Edgeworth's crimes? It seems that he very knowingly used false evidence to convict innocents to life imprisonment (or possibly death). The possible faking of his death (I have my reasons to believe that it was a genuine-and-failed su1cide attempt). Then there's also Phoenix's crimes (concealing + falsifying evidence) in Apollo Justice. There are likely others I'm not thinking of right now, but you get the gist.

Very knowingly? Rise from the Ashes establishes that despite the rumors surrounding the demon prosecutor, Edgeworth wasn't aware of the forged evidence he used. That in the one proven case where he used false evidence, the fault was with Damon Gant and Lana Skye. Its typically not illegal to fake your own death. The illegal part comes from acts taking advantage of your false death like defrauding life insurance. What it means to conceal evidence sounds like a headache thanks to California laws being very different from generalized Japanese laws. And falsifying evidence would fall under the general umbrella of tampering with evidence. So it likely wouldn't be treated any different than Phoenix messing with crime scenes. At least in California.

I think it's implied that Edgeworth did not know that any of the evidence was faked-he may have willfully ignored signs/chosen not to probe deeper, but he's genuinely shocked to find out that he presented false evidence in 1-5. He was probably knowingly stretching/playing dirty, but from what we know of his character, I don't believe he'd purposely do anything that would constitute actual falsification. At least the way I interpret it, he's truly convinced, for the first part of his career, that everyone on the stand is/*must* be guilty, and his duty is to make sure that truth comes to light-but he actually believes that it _is_ the truth, due to his, erm. personal neuroses. He does have a (very strong) personal code, it's just been warped by von Karma and the weight of his own guilt, which he projects onto every defendant placed in front of him. I think the retroactive realization that he's been complicit in convicting innocents through negligence is a big part of what influences his...further decisions that may or may not warrant criminal charges.

I mean as far as we know in "faking his own death" Edgeworth just left an ambiguously worded note & then left the country. None of which is illegal. Actually I believe he was working abroad? Like tracking down DeKiller & stuff. So he definitely wasn't declared legally dead or anything.

Jokes aside, someone should probably get rid of that fence given that's indirectly responsible for 2 deaths. Even if people weren't acting or quarrelling by it, it's still feasible that someone could trip walking in or out of the trailer and end up skewed on the fence. That things is a major safety hazard.

This video taught me so much! At first I was worried all the readings from the penal code would be boring - but you explain things so well after the initial quote. To the point, I was understanding the direct reading a lot more as the video went on as i learned from previous explanations. Today I learned about assault vs battery and how battery charges in this system include assault by default! I learned about kinds of manslaughter, larceny, burglary/robbery and extortion charges. That is all to say - PLEASE MAKE MORE!!!

This was So Good and so fascinating. I loved how you broke things down and made them somewhat easier to undertake (laws are written like riddles for real) but also getting a semi realistic perspective on the crimes. AA is NOT meant to be a reflection on real life in a one to one scale, but seeing the possible aftermath of the crimes was very cool. Also I have been flipping myself over trying to figure out how long Lana was in prison because they NEVER MENTION HER AGAIN so I assumed it was like ten years or something since Ema comes back around that time as an adult. But gosh I would looooove to see a crime breakdown of justice for all (my beloved) because BABY that’s a whole assassins in there. Plus. Good lord. Turnabout big top. Major props to Prij for giving us this gift and all the save data fam for helping out and editing and brining this absolute gift to us

I'm kinda surprised he didn't talk about the stuff Phoenix does. There's a few examples but the biggest one is Phoenix finding, and taking the wiretap. As Phoenix Trespasses into her hotel room while she was showering. Then practically steals the wiretap from one of the drawers.

I'm no expert in law. But I think Phoenix is considered a civilian while he goes into April May's room. As he has no warrant and was not let in by the occupant and hotel rooms are considered private property. Which, would lead to at least get Phoenix a tresspassing charge. I don't think it would change May's verdict or punishment. But it would spell fines for Phoenix at best. Or at worse get himself disbarred from practicing law. Edit: If I'm wrong and Prij, sees this. He'll probably correct me

I'd love to hear what Prij thinks of Mr. Spoiler's 10-year sentence at the end of Ghost Trick. I guess that game takes place in a fictional country so it's harder to know which laws to use but it's been a subject of debate in the fandom (whether it's too short or too long a sentence) for the 8 years I've been in it.

Spoilers: If i remember right, his crimes would be: -Escaping police custody (unclear whether he was properly detained, as they were just taking his statement.) -Stealing a firearm -Taking a hostage (though we never actually see him point the gun at the hostage, only at the officer chasing him) Yeah those sound heavy, but Cabanela and Jowd admit themselves that their actions may have caused Duress. Such as firing a warning shot and making him think his life will be ruined. Also at the end he ended up saving his hostage from death, which even resulted in serious injuries, which a good lawyer could use to lighten the sentence. But i don't know
