Examples of Torts - Law of Torts

To better understand the concept of torts, let us look at some examples of torts.
Due to some negligence - like playing with the music system and not paying attention to the road - a driver hits a pedestrian - it is a tort against the pedestrian - who can seek compensation for the injuries caused.
If a person commits defamation - which can be written defamation - libel - or spoken defamation - slander - against another person, it is a tort.
If a person enters into another person’s property without permission - it is trespass, which is a tort.
If a person commits assault or battery - both of them are torts - and the victim can sue for damages.
Now, you will remember that different categories of assault are covered under the Bharatiya Nyaya Sanhita as crimes.
So, this is a good example of a wrongful action that is both a civil wrong and a criminal wrong.
So, the person who commits the assault can be punished under the criminal laws; and the victim can also sue for damages under tort law.
