Explained: Articles 35 A & 370

On August 31st 2018 , the SC deferred the hearing of petitions challenging the constitutional validity of Article 35A of the Constitution of India. Article 35A empowers the Legislature of the J&K state to define ‘Permanent Residents’ of the state and confer special privileges on them even in violation of the Fundamental Rights under Part III of Indian Constitution. I sincerely thank the faculty for staging a vivid picture on judicial/geopolitical approach to the scrapping of those articles. No doubt, these articles were framed from time to time commensurate to the prevailed situations and to the perspective of that time. In my view, in the rapidly changing world in all spheres, the integrity and sovereign of a country should be placed at top without any compromise or whatsoever. Immigrants from Pakistan came to India during partition. So it is our duty to give the full rights as of Indian citizens.. but it wasn't the case in immigrants of Bangladesh. Most of them are aimed at changing the demography of the border districts all along the border of Bangladesh.

I have one question Maharaja was going to loose his kingdom to Pakistan and would do anything to save it . Then how while signing the instrument of accession he was able to negotiate ? He was not in dominating position.

okay you have valid points...but forget about all presidential orders for a minute...that means delhi agreement...in your words back clock...can we challenge a single presidential order in supreme court to be unconstitutional...we dont want to raise challenge on the procedure of presidential order in case of j&k...just a single order... Agreed that both the great leaders of that time Mr. Nehru and Mr. Shekh Abdullah felt this all measures to connect j&k with india...but today the situation has been changed...and if we want to challenge a single presidential order, not entire process of 1954...then???

Sir, you have missed a point regarding violation of women rights argument. Men, who are citizens of kashmir, if they marry women who are outsiders their children will automatically get the citizenship of kashmir but vice versa is not possible i.e., Women, who are citizens of kashmir if they marry outsiders their children don't get any citizenship. Is this not a violation of women rights ? Article 35 A should be there but certain amendments have to be made to article 35A itself.

Hello Sir, Iam student of NIT Srinagar as, I am witnessing the worst situations in the valley from past 4 years . As you said that we cant remove the article 35A &370, If it is scraped the situation again goes back like 1954 right? If the situation goes like 1954 then, that is Beneficable to these Kashmiris, then why the people of Kashmir will Do Strikes & Bandhs to support this Articles, and why will the situation become worst if they are really benficable? I think this is one side of the coin? Can you explain on other side?

Well it's not so simple. But this can be one of the explanations. It's the stakeholders (recognised political parties, people of J&K and the opposition at the centre) who oppose the scrapping of these 2 articles. The insurgents or whatever we wanna call them directly demand for full autonomy or independence. This way they are not the legal stakeholders anyways. So their views don't at all matter. This simply implies that all the people among the legal stakeholders who are opposing the scrapping have faith in the Indian constitution and whole integrated nation-state of India.

then the main provisions of GOI like finance commision,UPSC,election commision etc would not have any impact on J&K. that would lead to chaos and improper management

Actually the protests are mostly from the separatists and they feel that if article 35A is repealed india will try to snacth all the autonomy from them and make it just like any other state of india and all the special provisions of women losing citizenship, state govt services reserved for locals will also get repealed, and whole demography of kashmir will be changed which dominated by kashmiri muslims and as well as there are some kind of funding from the other side of the border to keep things warm to drag attention of the united nations that india violating human rights in kashmir and i strongly believe india should snacth pok from pakistan just like russia did in crimea, amend and ratify article 35A such that we can generate more govt jobs, msme sectors get cash boost and trainings are provided, schools and colleges are improved in kashmir so that youth don't get distracted towards extremists and eventually they will all comply by the laws of land live a life in a civilised manner cause all of these are hurting their tourism badly. My strong believe is Food is above religion and religion wont feed a person but a well fed person preaches and follows religion
