So I THINK she's taking the position that she can't say he IS if the California courts have already ruled otherwise. What process is there to determine if a 30 year old can appear on the state ballot for US President? None. This is a matter for the Secretary of State to enforce the US Constitution's applicable provision. For her to fail to do so here is an abdication of her responsibility to enforce the US Constitution and is a violation of her oath to do exactly that. For her to claim there no process for her to remove him is a lame excuse that is contrary to law. She needs to be sued promptly and forced to do her job.

The argument that there needs to be a national discussion on whether or not a State can make a decision to exclude a person from candidacy for being an insurrectionist is ridiculous for it's a state decision squarely within a states' purview. To demand that the Supreme Court overrule a States' right opens the door to such actions in other matters subject to the political whims of the Court. The law is clear, and each state has the right to decide how to implement the law.

Unfortunately those who are not looking to the federal level constitution seem to overlook that even democracy has a guideline in that federal level constitution. It's supposed to be the highest law that everything else is supposed to be based off of. State laws can fine tune or add to but are not supposed to go against. If 14-3 says he doesn't qualify, he doesn't qualify and should be removed from the balot on that principle. They don't have to go through a full blown trial to recognize that. They just have to go over evidence and see what's there to decide. Judges do have that right and ability.
