why Malthus is still considered as founding member of classical economics as we know he refuted the main idea on which classical school lays it's foundation (I,e says law) .

Thanks for the academic engagement. The classifications cannot be rigid. Classical system is a name that was given later (perhaps by Marx) to the work of Adam Smith and his followers. The essence of the classical system was in the complete faith in the market forces. In this matter Malthus belonged to classical school regardless of his views on Say’s law and his arguments with Ricardo.
