I started following you and I stubbed my little toe on a doorjam. Coincidence? Maybe. Maybe not. I like to think it's all interconnected in the very fabric of time and space; a mere ripple or wrinkle on an infinite timeline that one could only witness if you were to peer through the eyepiece of the world's most powerful telescope, magnified enough so that you can see 13.5 billion light years into the past, because light only allows for us to see the present and the past, but never the future. Am I slightly happier in life? I don't know...Maybe a little. But I'm also a little buzzed right now, so it's kinda hard to distinguish between the two.

As I understand it, he lives in Alabama. Alabama is an at will state. So the way he was terminated with the " it is just not working out" and not stating an official reason, he is not able to sue his previous employer. Wrongful termination lawsuits get laughed out of court in Alabama. He should be able to collect his unemployment ($350 per week for 6 months depending on employment status) because they did not site a cause for the termination. Gamestop it technically at fault for getting him fired. However, it is impossible to prove in court. The previous employer would have to admit that they fired him for that (not likely cause they would be sued over it if they admitted to it) and you would need proof that it was Gamestops intention to get him fired. However some good things can come from this. The PR nightmare may cause Gamestop to disavow the actions of the manager and the district manager and fire them to avoid anymore bad press. They will never admit fault, but they will cut people loose to avoid the fight. It is a stretch but he could sue under 1st amendment. Where his freedom of speech was challenged and as a result gamestops reprisal was getting him fired at is current job. I hope everything goes well for Camelot331, and I am sorry that things like this can still happen in the world.

I think the legality of this is different state by state. I know in my state the previous jobs you use as a reference on a job application aren't even allowed to say anything bad about you if a prospective employer call them.
@mitrovarr
@mitrovarr 5 жыл бұрын
This is true nearly everywhere, I think. It's why businesses are loathe to say anything other than "I would/would not hire this person again". Anything more negative could entail liability.
@ProfessorRoy82
@ProfessorRoy82 5 жыл бұрын
That's true. California is specific about references. Legally, a past employer can only state last job title, last salary, time of employment. Even if you were a factually a horrible employee, like a thief, the employer is not legally allowed to say negative information about you since it can open a can of worms about who can say what and is it true or an opinion? The hard part is proving the past employer said bad things about you. An employer can just say you were not selected at this time. I would imagine a past employer in California cannot say negative things to a new employer about an employee after they have been hired at a new company. I understand its state to state on exact rules and words.

I mean, he might not be able to sue GameStop, but he might have a case against his most recent employer for wrongful termination. Depends on his state's at-will employment laws and the company's policies-- a lot of places require some formal reprimand system prior to termination. They're probably banking on him not wanting to take on the expense of a lawyer, even if it was totally illegal.

I know he stated his company worked closely with Wal-Mart as a third party in-store vendor, and one of his last videos before being fired was talking about Wal-Mart. I think the GameStop videos did make his former employer nervous, but talking about their current company they contract with was enough for them to sever ties. I think GameStop needs to learn that there's a reason people are speaking out. Working for Toys R Us in my opinion was a cakewalk compared to dealing with GameStop. GameStop is so tone deaf they think they aren't doing anything wrong. They lie, will rip hours from people who do their job properly to give them to people who suck up to their managers instead, and overall have no care or empathy for the associates they screw over on a daily basis. As a former employee I don't buy from them and probably won't again until the going out of business sale takes place. Even then it'll just be to bulk up my collection cheaply.

Lawsuits are expensive and time consuming with no guarantee of a win. The current goal is to hit 81k subscribers as fast as possible and humiliate GameStop TV since Cody could have been doing what he's doing RIGHT now but for GameStop. Besides that GameStop is ready for a lawsuit- that's how THEY do things. A several million dollar one time payout isn't going to fix anything and I would advise Cody against accepting any kind of deal with them.It may sound stupid that's not going to fix anything and the money would be tainted. There are far more interesting things happening in the Knights of Camelot discord and reaching a settlement with GameStop really isn't on the menu. GameStop picked a fight and I don't want to let them off that easy. No hush money, no NDA, no deals. He's taken everything they have thrown at him so far and it's only made him stronger, he's the captain now.

You're right about the lawsuit thing. All the lawyer wannabes in CAMELOT331's comments who said he should sue don't know what they're talking about. Firstly, no one knows for sure what happened. Discovery would have to get going with depos and what not, and then you'd have a clearer picture, but most likely he doesn't have a case. Obviously it's worked out well for him anyways and it's been a horrible PR move for both GameStop and the company he got let go from.

If his accusations are true, which I believe them to be, than Gamestop is intentionally lying to their investors and the public. The IRS, the FBI and SEC could get involved. People could go to jail and Gamestop is probably not strong enough to survive any legal penalties. This could kill them.

I think the last thing a sinking ship needs to do is fire shots at former crew memebers 😂. Glad to see the KZbin community is in his corner because regardless of legality They has no right to interfere in his current job like they did.

Game stop is a dying breed there repuatation/business model is greatly behind with the times. I get that you have to meet those sales numbers but not though deceet, no matter what a company sells. That is how you lose big money and important trust that is shattered.

This is not new, nor is it exclusive to GameStop. What you post/put out on the internet stays on the internet forever and can and will come back to you and bite you in the ass. This happens 100's of times per day. Facebook/KZbin/Instagram/Twitter. I am so glad that this medium wasn't around when I was in my 20's. It sucks for him but at least he is gaining subs/popularity on KZbin where he can at least reap some financial rewards. Not so much for the drunken photos of some girl on FB that gets fired from her job.

4:17 it's a gray area. Company aren't generally suppose to silence employee criticism and social media policies are questionable due the National Labor Relations Act. So somethings they are legal. 5:29 He could argue hostile work place or some states have additional worker protections to prevent this exact thing from happening. Old employer shit talk about you to new employer. Which may limit reference calls to 1) how long the employee worked there and 2) if you'd hire them again. 6:10 You're real name is Beef Wellington! Proof me wrong!

Gamestop violated his First Amendment Rights to freedom of speech. He had already left the company before making his remarks. Gamestop purposely directly targeted him for harassment and stalking. Which led to a wrongful termination. He has a hell of a legal case and could make bank.

I mentioned this on Cody's videos already, but this is the Barbra Streisand Effect in full force. The more they try to silence people, the more attention they're going to bring to the situation. Now, I need to go listen to that Duck Sauce song again. Oooooh oooh oooh Barbra Streisand. Ooooh Oooh oooh Barbra Streisand.

As Cody Benson I feel really bad for Cody Dennison's situation. GS is the absolute worst. We have similar tenure and I feel every bit of what he has talked about. I will stand with him as long as I can. I have a new employer, but Cody is a good guy. He is honest. He is a southern gentleman.

So, you guys are mad at Gamestop, but not mad at the company that actually made the decision to take what GameStop said to heart and actually terminate the relationship with Camelot? 🤔 Sounds kind of silly. Remember, freedom of speech does not also mean freedom of consequences. Both GameStop AND Camelot could've let go of what was all those years ago, so you can't get mad when you reopen old wounds and then someone comes along and squeezes a lemon over top of it.

This doesnt speak well for game stop or Cams recent employer. If I had an employee under me and their previous employer called me and started talking shit, I'd tell them to kick fucking rocks. As long as hes performing well, I dont give a fuck about his past or what he does on his own time. Its complete chicken shit from both the gamestop and the other employers point of view. Its completly fucking bullshit

@FANTAVISION Be careful...I don't use my real name on Twitter or KZbin and I talked a lot of shit about the company I currently work for on Twitter. Someone inside the company took the time to find my KZbin channel that was linked to my Twitter account, watched my videos and found my name in the credits at the end of one of my videos. Of course they had to cross reference several names in the credits with potential employees (They narrowed the district down to Oklahoma). They eventually found me and I got a phone call one day while I was at work from our regional HR guy. Naturally I tried to deny any involvement with the Twitter and KZbin accounts, but he wasn't buying any of it. In fact, he just completely ignored all my attempts of denial and continued to ask me questions specifically pertaining to things I posted on Twitter. So, companies have ways to find you, and they will spend the resources to do so because they do not like it when an employee drags their employer through the mud. Pretty much every company, retail and else-wise, has some sort of policy in the employee handbook that states, in general terms, employees are not allowed to say anything disparaging against the company on social media. So...Just a heads up...Be careful, be kind and please rewind.

Hate to say it but he is a public figure with a huge reach that can cause substantial damage to an already dying company. If anything GameStop could probably sue him for defamation, slander, or corporate Sabotage for leaking trade secrets. I’m not saying they were in the right at all but KZbinrs need to realize that they are not private citizens after achieving certain milestones, they can do significant damage through their subscribers without any proof or fact checking. In my opinion they are both in the wrong. He second employer probably felt the exact same way and let him go before they upset him and he hurt their company with his loyal base.

So I will throw this out there. If his old employer used his HR records to run his SSI/Background check again to get ahold of who his new employer was then that would be grounds for a suit. Proving that's what happened is a different story alltogether.

The biggest problem with GS is that its a company ran by non-gamers. GS needs to be a store for gamers RAN BY gamers. And that's really the problem with corporate America as a whole.

I think that was crappy to have happen. If G.S. at the corporate level thought something was wrong and their legal people advised them to do something, that would be different if done through the legal system. But this just sounds like some idiot maybe trying to save his ass so thought he would try and mess of this guys life, not thinking how it could all blow up in his face.

I don't usually comment, but just WHY does the fact that gamestop would come after somebody talking about how bad they are on the internet baffle you so much? Yeah, he might be being honest, but that still doesn't change the fact that a corporation like gamestop would not want this information put out, and would henceforth take action in order to attempt to suppress that negative press.
