It's also stupid af to compare 2020 to the Gore versus Bush debacle in 2000. Ted Cruz equated the two situations, but it was actually close in 2000 due to Florida not being certain who won, so close it came down to a 5-4 scotus ruling which was resulted in much post-election controversy. In 2020, it was not close, Biden won by quite a bit. It was only controversial because Maga Trump cultists are sore losers.

In general, baselessly undermining faith in government institutions including the electoral process is indeed a poison. Maybe it _could_ be criminalized although it would have to be narrowly defined as to avoid impinging upon free speech. Republican ideals are now so completely at odds with majority public opinion that they are giving up on democracy. Same reason they're achieving nothing in Congress (least productive session since the Great Depression). They want people to lose all faith in government and its institutions and conclude that everything is rigged, so that out of frustration they will become open to the idea of an authoritarian takeover. It's an evil strategy but unfortunately it is effective.
