Well this hadith refers to people who fight you. Allah says in Al baqara verse 193 "Fight them until there is no Fitnah. But if they stop so should you unless it is for the sake of killing a wrongdoer." So if you compare this hadith to the Quran the hadith does not go against it, but this verse is about people who are at war with you. Not just any random group of people.

Thats why its best not to learn deen by yourself or unqualified people ...i passed through this and i know wat i am saying...i used to listened to hadith from fazail amal book in a deobandi mosque and sometime i get confused to wat the hadith really meant and i tried to interpret it but still confused....this throws me into a spiritual crisis...because i the one narating the book is a normal muslim and not a qualify scholars in order for me to ask him wat the hadith really meant

The Role of the Messengers: In order to understand this hadith it is important to realize few points about the Qur'an. It also highlights that the hadith is more in need of the Qur'an then the other way round. It is a historical and academic fact that most of the hadith were severed from its context because of individual reporting. It is thus important that we first ponder on the Book of Allah and then interpret hadith in the light of the Qur'an. The real insightful understanding about all such issues has been given by the scholars of the Farahi school, in particular Javed Ahmad Ghamidi (Pakistan). The real breakthrough in this regard has been the understanding of the divine practice (sunnatallah) of God through his messengers (rasools). By analyzing the narrative of the Qur'an we come to realize that all the messengers of God come to establish the judgement of God on the earth for their nation. This is the real difference between a nabi and a rasool. The da'wah of the rasool culminates to a shahadah (witness). Apart from doing propagation and preaching, every messenger (Nuh, Saalih, Lut, Musa, Ibraheem, Isa, Muhammad etc.) has an extra duty to be a shaheed (witness) for his nation and also for the subsequent generations. The way these Rasools (Messengers) become shuhada-alan-nas (witness over mankind) is by establishing God's judgment (in various degrees) on this very world. This acts as a reminder for the later generation that there is a greater day coming, the Day of Judgment, as they have witnessed it taking place in history in a worldly format. This judgment of Allah manifests in various forms throughout history. For the people of Nuh, Saalih, Lot it took place through natural forces like floods, earthquakes etc. Whenever the Messenger is able to get substantial followers then it takes place through their military power, like the case of our messenger (alaihissalatu wassalam) and also bani-israel under Moses when they were sent to Palestine. The whole of surah Tawbah needs to be seen in this light. All the jihad and qital waged by the prophet had two dimensions: firstly it was a means to eradicate oppression and persecution and secondly to establish a miniature Day of Judgment on this very earth by establishing God's judgment. The believers are given victory and authority over the land and the rejectors are given punishments according to their crimes: death penalty for the mushriks of Arabia and jizya for the people of the book. No doubt the latter dimension can only be specific to the age of the messenger, the former is the universal shariah applicable for Muslims for all time and place. The hadith 'whoever changes his religion kill him' has to be understood in this context. It is not an independent directive of shariah. As is often the case with hadith, the background and context is not always apparent as the narrators sometime omit them. The hadith is talking about death punishment of the people of Arabia (the nation of the Prophet) at that time; whoever goes back to jahiliyyah after accepting Islam he must face God’s judgment as the truth has been conclusively communicated to the nation of the messenger. The hadith "I have been commanded to fight the people (the people of Arabia at the time of the Prophet) until they testify 'la ilaha illallah.' "also needs to be understood in this context. It is a divine law regarding the rasools. The incident of banu-quraidha, the war of 'ridda' waged by Abu Bakr during his caliphate and the execution of certain disbelievers outside of the battlefield also make sense once we see them in this light. The ulama have wrongly tried to derive rulings of shariah from all of these incidents and narrations, whereas they are specific for the age of the messenger and his people. These conclusions are based on a critical analysis and appreciation of the language and coherence of the Qur'anic discourse, without any need to read 'liberalism' between its lines. An extensive amount of work has been done on Qur'anic hermeunitics by the scholars of the Farahi school in this regard. Please refer to the following, 1. This hadith was probably told during the sura tauba 9 after the elapse of 4 months. Those will not leave could have come under this as it was conditional for those who would not move away to accept Islam if they want to continue to live in vicinity of Kaaba. Even Abu bakr though to fight those who conditionally accepted Islam after the declaration of sura Tauba to pray and give zakat but after the passing away of Prophet SAWS they stopped giving zakat or changed. Am talking about the below verse where is conditional acceptance of Islam only in this case of declaration or demarcation of Ihram area where non Muslims are not allowed 9:5 ".............. But IF they should repent, establish prayer, and give zakah, let them [go] on their way. Indeed, Allah is Forgiving and Merciful" Allah knows the best

I can relate to the natural desire to protect yourself against people trying to kill you. But how do you justify the great Muslim expansion of its empire? Would Sheikh Hamza accept that it wasn't a justifiable expansion of the faith and it was just another example of power games in the history of the world? Specific to the hadith, we're told nas (forgive if spelling is wrong) has three meanings. But even if a small group is meant in the context of the hadith, why does the fight continue until the other side declare that Allah is their god? Isn't that compulsion to convert?

Firstly, before WW1 all countries are all empires, which means you have to expand and if you don't you will get expanded upon by other empires (if the country didn't make any agreements between empires). When an Islamic empire expands, they have certain rulings to non muslims, 1. They can convert to Islam, or 2. You can stay with your own religion and pay the dhimmi which is a tax obligated to men of non-muslims (excluding children, woman, and elders). In the context of the empire world, expansion is necessary to keep the empire stable and have enough power to not collapse.

Your reply says more about the politics of empire than the morality involved. Muhammad is known to have taught that war is to be avoided by all means possible and entered into only as a last means to save lives. This is totally at odds with empire. Empire is brought about by going on the offensive. As for conversion or paying tax, that notion is entirely at odds with 'there is no compulsion in religion'.

There were reasons why the Muslims attacked the Persian empire. 1) There was a huge civil war and different people were fighting for power in Persia. 2) Many Persians close to Arabia were dissatisfied with their Persian rulers and politics and they were impressed by the benevolence of the Muslims. 3) The Persian empire was declining and some important Persian generals went and joined the Muslims. 4) Small Arab tribes had joined forces with Persians. These tribes and the civil war in Persia, and the fact that too many Muslims were accepting Islam resulted in the Persian king Yazdigard threatening the Muslims. That’s when the Muslims attacked. For the Roman empire some of the reasons were thethe same as the Persian especially the 4th reason. But the main reason was that Muslim missionaries were sent to different rulers during the Prophet (PBUH)’s time, and they took letters with them. Zaid bin Haritha was killed by the Romans and this was considered an act of war in that time so it created a rivalry between Muslims and the Byzantines. In the battle of Mutah, the Muslims made a successful retreat and they later took their revenge by defeating the empire.

Allah made people into nations and tribes. With that come along the differences. It makes no sense for Him to have said there is no compulsion in religion and at the same time ordered Muslims to go to war with everyone until Islam prevails. This is an incorrect interpretatation. All verses must be harmonized fully with other verses in order to understand its meanings. Shaykh Hamza is correct in pointing out the requirement and criterias needed in order to do an exegesis of the Quran.

It is not for a laymen to decide and interpret the sharia that allows for Jihad and for prisoners of War. The quran is clear to those who wish to understand the Quran, the way it is to be understood.
