Counter argument to mothers lawyers closing statement: The mother is supposedly too poor for a phone, has no transportation, has trouble reading and fully comprehending written instructions. To the point that she wasn't communicating with services despite offers to find transportation and help. The testimony has shown that the children have medical needs, one such child has appointments for "every therapy under the sun" due to his disabilities. How can you expect her to keep up with the children's needs, therapies, medical appointments, etc with no phone, no transportation, a heavy intellectual disability, and severe poverty? It's unfair to the children and unfair to the mother. The judge made the right choice.

One of our five adopted children was born to an intellectually disabled mother and abusive father who were homeless, living in their car when she prematurely gave birth to a #2, 13oz baby. He had a blood infection. They visited once during his hospitalization and then signed papers for relinquishment. That was 43 years ago. He is a wonderful son; kind, helpful and a blessing to our family and his many friends. He has a developmental disability, autism, but we are very thankful that he survived his difficult beginning and came to us at age 2 1/2 years. I am grateful that his parents were able to make the unselfish decision to give him life and a chance for stability.

I think it’s really nice that there is potential adoptive homes already for all 4 kids ❤ hopefully they all have permanency and are doing well now.

Agreed 👍. It seems like she isn't able to make good choices, even for herself and her own well-being. Even in regards to the men she ends up with.

Yes. With an IQ of 64 (also referred to as being 61) Samantha is operating at an age of 9-12 years. To have expectations that she could care for children, much less multiple children, and to run a household, would be way beyond her abilities. She is very vulnerable and would probably be best off if she was under the care of an adult (family?) to help her accomplish the established goals. Her caseworker has really dedicated herself to helping this family.

Does Texas have adult protective services? Mom likely doesn’t know any better or what a normal home is. She was raised in the filthy home and has an intellectual challenge. The children can’t be left in with mom, in that home. This whole case makes me sad. I hope the children can learn that home CAN be a safe place.

This is exactly what I wish all of these cases were like. I feel confident that cps did, in fact, do everything possible to get this family reunified. This is what cps is supposed to be. This caseworker seems to be a really good one.

The majority of things they mentioned could have been helped if they spent more time providing resources to her instead of standing back to watch her fail so they had ammunition. With their logic no one with a low iq should have children.

​@stunzeed3066 so they offered transportation but she refused. They had meetings they she didn't attend. She refused to speak to any of them when they called. She didn't do her services. She is worse off now than she was before. They helped her a much as she let them. This kids are who you should be focused on not how much of a victim she is to herself. You can only do so much for someone. If they don't accept the help they're nothing no one can do. Did you even watch the other videos? That smart would be no.

It seemed the department had tried to accommodate the mother. There are plenty of people with low IQ who are loving parents. Very sad all around.

The mother’s lawyer is ridiculous! Her excuse is that mother moved out and so could no longer drive her to her meetings, etc - then she immediately says that Samantha has plenty of friends and family to help her raise her children. Also, “no evidence?” Stomped on the infant’s head? Holes in the floor? Urine odor? Poor hygiene of the children even with grandmother was living there? How in the world would she be able to meet Bradley’s needs? Unbelievable

I understand that the lawyers of the parents have a job to do. But I always want to ask these lawyers who fight so hard for such negligent parents, “would you let this person babysit your child(ren)?”

I'm a foster parent and I totally understand having a kiddo being affected by visits. My kiddo's teacher even notices when my kiddo has visits the day before. It takes about 36 hours for my kiddo to rebound after a visit with her mom. It kills me everytime I have to let her go.

It's actually pretty normal for children to act out after visiting the other parent, even if cps isn't involved. My kids have an adjustment period after visiting their father every other weekend. It's just their normal adjustment.

Fellow foster parent. My kiddos are the dame way. The night before a visit wr have lots of big meltdowns, and big behaviors for 2 days.

well..um..you kinda sign up for this when you go through the process of being a foster? The point of being a foster is a temporary fix for kids with serious problems with parents, and to eventually unify them......its kinda like sending your kids to grandma's house for a day or two, and getting them back as complete brats...im confused why you or anyone would complain about this

No, foster parents are not a "temporary fix". No it's not like grandma's... useless grandma severely abused them and then continues to every time your kids see her.

My god this is on a different level. Instead of dealing with the inevitable fallout and removal of child after child, baby after baby, why doesn't this department of family 'services' force her to get an IUD or other semi-permanent birth control. This is ridiculous. This individual has at least 5-6 children and can't keep any of them alive. It's such a shame, it really is. So many decent people in the world who are barren and this lady is a certified breeder.

Also, just wanted to add: this woman has the mental age of a third grader. I question her ability to even consent to sex and I want to know what men have been having sex with her because I'm concerned they are exploiting a vulnerable person.

I also get that all the tools she really has are a few objections so she can appear like she’s doing something, and then try to lob a couple or hail Mary’s. But to say they haven’t shown “any endangerments in the case….” ummm, was she sleeping through this?? 😅 Roaches in the home, holes in the floors, broken glass on the grass, head lice infestation: etc etc.Those are all endangerments‼️🤦🏼‍♂️🤷‍♂️ Great video as always.

I understand as a family attorney, you have a duty and obligation to your client. In this case, how can you fight for your client knowing that children’s health, safety, and well-being would be negatively impacted if they were to remain with their mother? Makes me wonder if Attorney Ward would allow the mother to care for her own children. Would she trust her? Sounds like at least one has significant disabilities and medical needs that she can’t even begin to address within her own means. These children would suffer long term if the mother has any type of custody or parental time. So sad. Nothing but neglect.

Depending on the state you can qualify for a free phone with talk, text, data, and it’s a smart phone for free. Her children are in state care if she wanted to call the caseworker she would and could find someone with a phone to do that.

The Mothers attorney argued she had a good support system, so where was that support system when the children were living in squalor and infested with head lice? This is just sad. I wish the children the best, and pray they find forever homes.

I’m a foster parent. I’m all for reunification but through out this journey. I have realized that we in a “victim poor parent” mentality. Now I refused to be an enabler of this mentality.

Mom was failed as a child. She was raised in a filthy unsafe neglectful home and was not taught better. Generational neglect. Removing the children sounds like the only way to break the cycle. I’m sad. Mom should be helped to file SSDI. She does have steady, but very limited employment. The children need to be given a chance to grow up in safe home.

My sons wife had a younger sister we would invite on vacations, I would have to de lice her, buy her clothes and underwear, her mom did not send her to school regularly so yeah lice may just be one of the neglectful things parents do try having treating this were you can actually see them crawling!!!why was he arrested when he had marks and she had none. Plus fights follow her!

Too bad they cannot order a forced sterilization. This person should not have brought five children into this world (these four plus one involved in another CPS case), as she can't even take care of herself. So very tragic. It's amazing to me, that one has to obtain a license to drive, hunt, fish, or perform a multitude of activities which require only a moderate degree of responsibility, however, anyone who is capable is allowed to become a parent. I find this to be a very interesting moral dilemma and unfortunately, precious children are the ones to suffer the most.

Wow, the lawyer! Couldn’t believe what she said to the GAL. Was it the GAL? Basically, asking if she knew how to do her job! Noticed quite a few rolling their eyes at her objections and “facts.” Wonder if she’s going to continue on in this manner in the future.

@@okiemom More than one child has died due to extreme lice it’s insane what it does to your body but I think the most recent was a 9 year old little girl who died in 2022 her mother & grandmother were both charged & a 12 yr old Kaitlyn Yozviak also died from extreme lice both her parents were also charged I believe. Edit: I only remember bc I’ll never forget the first time I heard it I couldn’t believe lice could actually kill you.

This is so sad. The mother is not able to take care of these children. The children seem like the are being taken care of. The mother should think about her kids and let them be adopted. The children will have a better chance in life.

Let me get this straight. The mother can't avail herself of all the resources and classes she has been required to do to get her children back, BUT she'll be able to take care of her children. There may be family that COULD help, but they haven't been. The mother actually contributed to the problem with dogs that were not house trained. I would ask the mom's lawyer one question: would you allow this woman to take care of your child in her home for 1 hour? I'm betting the answer would be no. But yet you want her to take care of 5 children when she can't take care of herself.

Well, this case is rather heartbreaking.. it appears the children being elsewhere is honestly the best place for them and their wellbeing...as sad as that is... Also, Moms attorney is ridiculous with her hyped up over dramatic objections and RBF.

My sister is an advocate in the autism field, and the preference actually is to say a person "has autism" versus "is autistic." It's subtle, but the difference is in identifying what someone has versus saying that this is who they are. I had never thought about it before, but it made sense when explained to me. *EDIT* After seeing all these responses, its clear that opinions differ. It illustrates that even when you're trying to be thoughtful in your word usage, you will manage to offend someone. Perhaps the lesson is to give everyone a little grace.

Just a caution that this is _not_ universal. I find it patronizing, personally (and think it makes autism sound like a disease to be plagued with instead of a different sort of brain to have).

Those individuals with autism who are super articulate prefer being outright called autistic or neurodivergent. It was humbling for academics. The bottom line is to only call people what they want to be called. That will change over time. If you're not sure, ask. If you need to label someone, ask why. I deeply believe that the LGBTQ+ community has challenged us in a good way to examine English. Other languages are much more accommodating of male, female, neutral, and undecided...without social judgment. They are often as equally accommodating about what we label as disabilities. The only reason to cast labels is to acquire services that are backed by civic dollars. I was trained as a behaviorist of the gifted and talented, autistic, and behavior and emotionally disordered. They are all the same. Everyone just needs structure, order, and kindness. And the belief that they are chosen, wanted, and cherished. Love to you and your sister.

Many many many autistics adults feel very strongly against “person first” language and believe it is harmful. I realize that not every neurodivergent person will agree but just to caution against advocating from a neurotypical voice without listening carefully first and taking your cues from people who are actually autistic.

That's the preferred for professionals, but it's not the preferred for actual autistics. Trust me. The vast majority are very tired of neurotypical people trying to soften or subtle down words for their comfort. We're autistic.

I kinda want to believe that the mothers attorney said what she did at the end because she knows those kiddos cannot be with their mother. She said things that were obliviously wrong and proven in the trial…. My heart thinks she meant to do that 🤷🏼‍♀️. She can’t be THAT dumb. As a human with a conscience I couldn’t take this case on with the aim of winning, totally unfair to the children.

I realize that people go thru issues and problems….but what I don’t understand is why these people have no problem laying down and having kids but I don’t see why she can’t see what she does affects her children….and I get with the IQ situation it’s difficult. And any guy who takes advantage…if that’s what happened…..of these girls. I’m so sick and tired of children being caught in adult situations that they have no control over. Do what you want but do not bring kids into your chaotic lifestyle.

I understand that there is the idea that mom is the best version. But here it's clear mom is not. There is a couple that is ready to do the work of raising these kids, give them a safe home, love them. These months and years parents like her get to be better are lost time for the kids. So much harm by not feeling safe, wanted and loved. It's sad.

I wished my county DSS was like these people 😢 they’ve put me and my husband through hell and haven’t offered to help us at all we have done it all on our own we want our children have fought hard did everything to keep them but they keep putting us through the ringer. But yet here this woman is literally giving her kids up like it’s nothing while I grieve for mine and do everything requested 😢😢

It’s still a terrible system. I know, I’ve been there myself and it did not go like any of these cases at all. Unfortunately with every system there’s problems. You need to contact people above your caseworker and let your lawyer know that they aren’t helping.

I’ve been there. Advice you are free to take or leave…Keep your side of the street clean. Be of few words and lots of action. Be honest with yourself. Don’t take anything personal, this is their job. Be kind to the cps workers, honey gets you further than vinegar. Drop pride and ego. You and your children are at the mercy of the cps workers, and courts. Be as polite and kind as possible. Always tell the truth.

Yes they do when the parents have engaged and completed the service plans. I have seen those hearings and everyone is always so happy because that is their primary goal.

It looked to me like she was one of the caregivers for the kids. I think between this case with these kids and the other case with the baby, there are three different placements. Mom wasn't at this hearing.

Probably. I get them and they're sooo frustrating. If I'm lucky and I notice it immediately I can medicate and it's much faster. My service dog alerts to them so I haven't had one last all day very often since training that alert lol

1:05:22 I agree. Autism is not a dirty word, but I tend not to say “s/he’s autistic” either. I feel like it’s so limiting. Like, we don’t say “he’s cancer” or “he’s brain tumor.” I try to define my kids and others by who they are, not what they have, if that makes sense. So, he’s got autism or he’s on the spectrum just sounds more accurate to me. But, that’s just me and how I feel things work best at least for one of my children. Bc he’s kind and thoughtful and sensitive and silly and funny and helpful. He also has some special needs which do identify some of who he is, but they don’t define him. ♥️

When the vast majority of autistic people prefer it, it's time for neurotypical people to accept that it's our comfort, not anyone else's that should matter. Rejection of person first language is very prevalent. I don't have a disease, I don't carry it around with me, I don't have it, it's part of who I am. I'm autistic.

" The correct phrase"is what a person prefers. Many self advocates prefer identity-first language. Always best to ask and not presume person first language is preferred. It's looked at as making people's identity like something is wrong with them by many people. Not just people who are autistic either. "Many people in the autism community also prefer identity-first language. They view autism as a central and important part of their identity and take pride in it. Some autistic people feel that identity-first language better reflects and respects neurodiversity. Some are firmly against person-first language(link is external). Others in the autism community, however, prefer person-first language-including many parents of children with autism. My son says both. "I have autism" and I'm autistic depending on the situation. He likes me to say he's autistic. Many friends identify as ND or neurodiverse. ( Usually we use first names or nick names 😉. )

so let me get this straight.......mom works (not a bum), makes around 300 a week, but thats not poverty level? when living expenses are easily triple that in any given family........um....okay...so she cant see her kids for 4 months...not because of possible abuse, neglect, dirty house...ya know, actual good reason to prevent visits with a parent.....but because she had head lice?....head lice= missing days with your child???????? OMG these cases are gonna give me a ulcer.....i cannot believe the CPS system is doing this to people.....i so pity all you young parents out there in danger of coming across these power-bully a-holes that can take your kids for what> head lice? not having a cell phone? having a low paying job and near poverty? (btw..i just went through head lice last year, it is is REALLY hard to get rid of, we almost went seek out professional hair stylists to help)

@@sydneysovern wtf you going on about now? who stomped on whos head?...and as i said it took over a year to get rid of headlice, just a simple shampoo?? lol...i spent 150 bucks at the pharmacy for a special shampoo that didnt work....the only thing that worked was doing everyones head that was infected at the SAME time...using those special combs, doing it again days later, and spraying and cleaning everything (and cutting the hair of the boys in the family affected)...it was a real B@tch!!.....who stomped on whos head...i hadnt heard anyhthing about stomping lol

Well if you had such a problem with head lice, then you should understand the problem here. Were you not paying attention? The house is dirty and dangerous and smells like pee and his dog feces everywhere. The mom has an IQ of 64 and cannot take care of yourself little on these kids. Thank God for CPS to step in and take care of them.

I don't see how they can say there were appropriate ADA accommodations here. It makes me wonder if they've ever worked with someone low IQ before, or if this is just what they get away with. An accommodation for low IQ isn't going to be: take more classes on more basic subjects; it would be: take _these_ classes from this provider who is familiar with teaching people with low IQ. Everyone else seems to be excited, but I'm heartbroken. The case worker said Mom made efforts around the house. She's clearly not checked out. But it sounds like the department put a huge roadblock in front of everything that might've been beneficial to her by asking _her_ to go do new and novel tasks, or to initiate them. Self-starting, especially in areas of unfamiliarity, is a _classically_ difficult thing for someone low IQ to do. It would be good for her to have a State ID, but it's not reasonable to just tell her to go get one. She needs guidance. I think it's sad that these kids -- especially these girls -- are going to grow up without a mother (or even mother figure) in their home. That's _really_ tough as girls get older.

I can see your heart is in the right place but there’s a point where a disability makes someone incapable of something. Samantha’s disability precludes her from caring for children. If the adult responsible for children cannot mentally process, even through no fault of their own, how to access services offered for your and your children’s benefit, how to properly feed children, realize the dangers that were present in the home at the time of removal, or leave rampant lice untreated, then the children need to be taken. Yes, perhaps being told to do something would be the best for Samantha but if she has to be told to do something that helps her and her children, then the inverse is likely true, that she can be told to do things that are not good for her and her children. I believe that is what is happening with the childrens’ fathers’, who may be telling her not to provide their information. Samantha should have a guardian herself, to assist her with benefits she’s eligible for and, hopefully, to help her understand, and perhaps find birth control, that she does not need any more children.

Their mother did not participate and anything. These children WILL have a mother, maybe not the biological mother, but a mother that can properly care for them the way they deserve. Mom just keeps having babies.

The workers all seemed to report positive behaviors from Mom: real effort toward cleaning up/renovating, consistent employment, her reaction to her daughter's lashing out at the start of visits, and her parenting during visits. She also has extensive family support. (Ironically, I thought her parenting intuition regarding the daughter's behavior -- to try to transfer the physical aggression into silly dancing or something like that -- was actually better than the guardian who brought her -- who is unintentionally reinforcing that this sort of outburst results in extensive, soothing, 1-on-1 focus from a caretaker.) My issues are at a couple of intersections, and the first is what the standard for removing a child and terminating rights is. I'm actually confused to hear them referring to "best interest of the child," because (as SCOTUS has recognized) that's a custodial standard between two fit parents, not a child protection standard (and would be unconstitutional as a child protection standard). I'm not sure how it's still alive in Texas statues (if it is). So we don't look at what would be most ideal, or even better, for children, because there is _always_ a better situation, and we don't terminate such a fundamental right on the basis that someone else could do it better. We also now have extensive, longitudinal research on how _extremely_ rare it is for a child to have better outcomes after being removed from their home than if they had remained there (research looked at outcomes among similarly situated children, even those being neglected/abused). The other major issue for me is that we don't sterilize women for being too unintelligent to be mothers anymore. And because we do not do that, it is cruel to then terminate their rights to those children because their IQ is too low to mother. Human history has had a lot of unintelligent mothers, and they are capable of parenting with family/community support. Especially considering how, when directed to do specific things she knew how to do (like improving/cleaning the home), she made great endeavors toward those things, I have no doubt that she could learn parenting skills from _appropriate_ classes designed for people with intellectual disabilities. The State has a lot of tricks in its bag: Mom could've been given specialized support services for a long period. Or they could've set her up with a third-party charity that does these services (instead of just referring her to one). Or set up a family plan with these family members who are temporarily caring for the children to support Mom in raising the children. I just think that DFPS/CPS workers (and the judges they go in front of) _very quickly_ become hammers in search of nails, and forget what their remit _really_ is, and it's not actually to secure what they believe is the best outcome for children. It's to ensure that children are not in environments that are an immediate or ongoing serious threat to their physical safety. (Because, in reality, living in poverty with disconnected parents results in better outcomes significantly more often than being removed to middle-class caretakers/parents who are attuned to the child's needs, as strange as that may sound.)

I'm a strong advocate of children's rights including being with their biological parents but that's only one right there are many more. Children have no voice someone needs to advocate on their behalf.

CHILDREN have legal rights and parents have the legal responsibility to protect those rights and it doesn’t matter what the reason for not being able to do that, if they are incapable, it is not up to anyone but themselves to prove their competence. Who cares if this mother has a diminished IQ? Accommodations are absolutely inappropriate in a situation like this. Accommodations for school? Great. Accommodations for employment? Great. Accommodations for anything is perfectly reasonable, BUT NOT WHERE THE SAFETY OF CHILDREN IS CONCERNED! Why do monsters like you believe that the adults’ rights are more important than the children’s rights? This is why there are so many devastating social problems today. Children are NEVER prioritized. They aren’t listened to. And they are never even given a chance because people like you ignore the children and scream that developmentally impaired mothers who have proven that they can’t take care of themselves, should have custody because otherwise, god forbid, ITS DISCRIMINATION! And, making sure we’re not discriminating is WAYYYYYYY more important than making sure kids don’t die. Ughhhhhhh! You making this monster out to be the victim here is disgusting. She victimized her OWN children!! The only relevant consideration is whether she can provide the care these children are legally required to receive. And SHE CANT! Get over it 😡

That’s not why the case started! There was testimony that it started when one of the kids told someone the mother had harmed one of his/ her siblings. We didn’t get to hear about what was found in the investigation because none of the investigators were there to testify.
