My story about this game is that I saw screenshots of Gollum himself going around a couple weeks ago and, as I didn't know this game was out quite yet, thought they were meme pictures from some PS3/360 LOTR game. When I later saw this game and recognized that Gollum screenshot from it, I was legitimately shocked in a way I not often am. LOTR: The Third Age is such a guilty pleasure for me. You can break the game so easily with Evil Mode, and Idrial's version of Final Fantasy's Reraise recovered the target's HP and MP, including her own. Plus it has that great glitch when played on 360 where the subtle "something's here!" glow just FLOODS the screen.

Probably because it's a different "they" who made this game than the Warner Bros. associated games he voiced Gollum for. While it is possible they avoided using the same voice actor for rights reasons, or he avoided this game to maintain his relationship for future Warner Bros. projects, it's most likely simply that the German developer was not recording the voice work in the Los Angeles area where Mr. O'Brien is based.
