I actually liked the way all the attorneys acted in the first hearing, both attorneys zealously advocating for their client, and the prosecutor zealously advocating on behalf of the state, but at the end, all of them wished each other well. Great example of advesarial back and forth professionally, but never taking it personal.

He exacerbated after he was shot. That’s a fight or flight thing. Obviously we weren’t there so I have to defer to the court. On a personal note I have seen a situation where a cop has it out for someone and consistently shows up with no cause. This person was no Angel to be sure. DUI and fighting. But it’s the real country part of the south so that’s most people. Luckily when he was being driven by someone with no record and the cop noticed him he detained the driver and when he asked the cop “what is this about” he charged the driver with resisting arrest. They tore his car apart and said “just because we don’t SEE anything doesn’t mean you’re innocent”. And said that he “could’ve been up to anything. When all that came to light the officer was punished, and he and the driver were awarded compensation. Not saying that’s happening here, again I have no idea. Just a little food for thought.

That first case was wild. The supervisor at the PD better check themselves, they just made representations to the court of illegal police activity with zero evidence to back it up. They have a duty of candor with the court and she was well over the line. The other PD was sticking to the facts that he could say to the court without stepping over that line. It's statements like that which can come back and haunt you. The PD also knows the legal standard for deadly weapon, it's something they have to know. A vehicle is a deadly weapon because it can cause death OR great bodily harm. The fact that the officer was not seriously injured is beside the point. If you shoot at someone you don't get to claim that it wasn't a deadly assault because you weren't a good shot.

Put it’s the one everyone plays. Look at the people claiming he’s guilty because he’s black. While it’s true the race card shouldn’t be used frivolously let’s also not pretend racism doesn’t exist in the US where people are obsessed with race. I’ve been told “you wouldn’t be criticizing them if they were black” or when a white person commits a crime “if he was black they’d have gotten off”. And I used to never abide that until I saw it more often by people who also say they don’t allow it! Until it’s useful. But like I said racism isn’t a valid excuse a good portion of the time. @boomer150
@boomer150 9 күн бұрын
Well it started with him not getting out of the car, according to Pennsylvania v Mimms, if an officer orders you out of your car, you have to comply. And failure to do so is a crime in all 50 states. So in not complying, he broke the law. Then when the officers used their vehicles to pin his car to prevent him from driving away, he did the forward, reverse, back and forth trick to shimmy his car out of the pin. Then when he was free, he gunned it, fleeing and impacting an officer in his escape, it was during this fleeing that he was shot. So he brought all this on himself. If he had just complied, he wouldn't of been injured at all. And if there was nothing on him or in the car, the case would of been dropped and he could of then sued the officer for harassment. But he just wanted to run away. And under no circumstances can you run from police. No matter how scared you are of jail.

BUT ..... if what you're saying is he didn't try and hit the cop until the cops shot him, then the whole thing should be thrown out. Because I already feel like the charges were trumped up to begin with. Blocking the sidewalk? Really? That's when you're really really reaching, as a police officer! I mean trying to find any little reason to pull somebody over! So I wonder if there is something to all this harassment that the suspect is talking about. Because it does happen and police officers do harass people. By the way I back the blue 100% but I don't back the black. The black being evil, or racist or just plain harassing a citizen.

Young black man shot by police is a pretty charged topic. Prime for extremely emotional reactions. Having not seen the camera footage I can't say with any degree of certainty. However the narrative the prosecutor is promoting, the shoot sounds controversial but not criminal. If the defendant was refusing orders to get out of his car, as ruled by Pennsylvania v Mimms. The person in the car has absolutely no right to flee, under any circumstances. And him in is attempts to flee, putting the surrounding officers in danger. Cops can panic just like anyone else. The moment you flee from police, you surrender any innocence you had. Because only the guilty run from law enforcement. If this man truly had nothing illegal in that car, he should of cooperated and fought the traffic stop in court. And if he had done that, he wouldn't of been shot and in fact nothing would of happened. But in his perceived sense of victimhood, of "officer harassment" that I would bet only exists inside his own head. He felt justified in fleeing. This in effect put others in danger. So his own paranoia makes him a danger to others. I would never, not even with guns pointed at me, run from police. Not ever.

Okay, why did we switch from the one case abruptly to the other? Didn't seem like either one had anything to do with the other?

It's funny how people in the comments are so typical. The body cam could show the unarmed man really was the victim and ya'll would STILL find a reason.

And re: the one case with the FL football player... I listened and observed both sides carefully. And at this point... I believe the defense!

There are no "unarmed" drivers when they are in control of a multi-ton bludgeon. The car is the deadly weapon the officer is defending themselves against. If you think the cops are harassing you, go out of your way to not violate any traffic laws or other things that might give them an excuse to pull you over, or to initiate contact and search you or your car or whatever. From the description, it sounds like he was parked in a driveway partially in the street or otherwise blocking the sidewalk. Yeah, that's an offense the cops can write a ticket for. If you don't think that's appropriate, call your legislator/councilman/whatever for that jurisdiction.
