Holding people accountable for the extreme acts of putting oneself above the law at every turn is a good thing. If trump had not acted like a mafia dictator then he would have never ended up in this situation. He broke egregious laws, he did every bit of this to himself and had many chances to stop pressing forward with the illegal conduct but chose to continue. Now he has forced the government's hand and they must prosecute. If there are no repercussions for his actions, the next time a president will do whatever he wants, whenever he wants because he will know that they won't do anything, and a lawless president just because, he wants to be is not acceptable.

No. His argument was that "imagine" folks charge Biden for an official act. Trump is not being charged for official acts. He's being charged for actions he took that were not within his responsibilities as president. Literally his case in DC is being evaluated for which crimes he committed were valid official acts and which were not. Once the judgment on that is made, he will not be charged for any official acts. Also worth noting, holding a "campaign rally" is not an official act of the president, especially not one in which you instruct your crowd to "fight like hell" and disrupt the certification of votes.

"Does The Constitution say anything about a corporation being a "person?"" No, it does not. HOWEVER - the constitution isn't the totality of law in the United States. It is the HIGHEST LAW, the defines the parameters & boundaries of all other legislation in the country, but it isn't the only law. And other, lower forms of law DO recognize corporations as being "persons". And if you don't like that... well the establishment of a federal legislature, & the process by which they create federal (as opposed to constitutional) law IS in the constitution, as is the powers granted to the States to govern themselves, & thus create state law.
@tomterrell1761Ай бұрын
Separation of Powers is a "description" of how the 3 branches of government each have their own, unique function. The Legislative branch, Congress, writes the laws. The Executive branch, the President, enforces the laws. The Judicial branch, the Supreme Court, interprets the law. The idea was that no one person or branch would have complete power. The Constitution doesn't need to say "Separation of Powers" if you have enough brains to figure out that it is what having 3 separate branches with individual powers creates.

When you have a situation where the ruling party acknowledges that their candidate is unfit to fulfill the role yet allows him to continue as president-reveals a significant disconnect and raises questions about political motives, governance, and accountability. Here’s an explanation of the logical inconsistencies and potential reasons for this disconnect: 1. Acknowledgment of Unfitness vs. Continued Leadership If a ruling party publicly or privately acknowledges that a president is mentally incapable of fulfilling their duties, but takes no steps to remove or replace them, it suggests a major contradiction in governance. Logically, if the individual cannot perform their role effectively, continuing to allow them to remain in power compromises the functioning of the government and the welfare of the country. The decision to retain such a leader despite concerns may suggest that the party is prioritizing other considerations, such as political optics, party unity, or maintaining control, over the actual well-being and capability of governance. 2. Political Stability vs. Practical Governance One potential reason for this disconnect could be a fear of political instability. Removing a sitting president-even if deemed unfit-could create a leadership vacuum, fuel divisions within the party, or weaken their standing with the public. The ruling party may be trying to avoid the perception of chaos or disarray by keeping the president in office despite reservations about his fitness. In such cases, the party may calculate that the appearance of continuity and stability is worth maintaining, even if the president is incapable. This would be a short-term strategy to preserve power, but it creates long-term governance risks. 3. Power Dynamics and Control Another explanation for this disconnect could be internal power dynamics. If the president is mentally incapable, they may be more susceptible to influence from key party members or advisors. This allows those behind the scenes to wield more control over decision-making without having to deal with the disruption of replacing the leader. The party may be reluctant to lose this control by installing a more capable leader who might be more independent or challenging to manage. Essentially, the continuation of the president’s tenure might reflect a desire to hold onto power through a "figurehead" leader rather than address the unfitness openly. 4. Public Perception and Political Costs The ruling party might be wary of the political fallout from admitting that the sitting president is unfit. Acknowledging mental incapacity could damage public trust, harm their credibility, and offer opportunities for opposition parties to capitalize on the perceived weakness. By allowing the president to continue in office, they can avoid public confrontation over the issue, even if it compromises effective governance. 5. Legal and Constitutional Barriers In some cases, the ruling party may be constrained by legal or constitutional requirements when it comes to removing a sitting president. Even if the party believes the president is mentally unfit, they may face hurdles in initiating a formal process (such as invoking the 25th Amendment in the U.S.) due to political divisions, lack of support, or fear of backlash. This could explain why a party might allow an incapacitated leader to remain in power despite acknowledging their unfitness. Conclusion The disconnect between recognizing a leader’s incapacity and allowing them to remain in power reflects a combination of political strategy, power dynamics, and concerns about stability. While logic would suggest that an unfit leader should be replaced for the good of the country, parties often prioritize maintaining control, avoiding internal conflict, or managing public perception, even if it means allowing ineffective leadership to continue.

Congressional oversight does not apply to the Executive due to separation of powers. The only thing congress can do is decide not to fund something. I think the appointment of judges, by the parties, individually, poses a problem.
@rayman1230Ай бұрын
I would suggest, Judges whom fail to follow recent case law set out by courts above them also poses a huge problem. Because as a veteran, allowing ideology and policy that inherently goes against the US Constitution, by definition makes it a domestic threat and enemy. Bottom line is, the modern day Democrat party and those supporting it are enemies to the Constitution. Therefore go against anyone who swore an Oath to protect and uphold the Constitution. That’s ALL military, elected officials, and LEOs. We can’t continue to pass law and policy or fight policy that doesn’t jive with the Constitution. That’s the largest threat to the American people. Elected officials not upholding their position and acting with extreme personal interest

Here's an argument from Kirkland's perspective on driver's licenses, traffic infractions, and the distinction between commercial and private: *Driver's Licenses and Traffic Infractions: A Constitutional Analysis* As a citizen, I, Duane Kirkland, assert that driver's licenses and traffic infractions have been mischaracterized by the government, blurring the lines between commercial and private activities. *Commercial vs. Private: The Distinction* The Constitution recognizes two distinct categories: commercial and private. - Commercial activities involve interstate commerce, subject to federal regulation (Article I, Section 8, Clause 3). - Private activities, such as traveling within one's state or locality, are protected by the Constitution's guarantees of liberty and property (Article IV, Section 2). *Driver's Licenses: Unconstitutional Expansion* Driver's licenses were originally intended for commercial drivers engaging in interstate commerce. However, states have unconstitutionally expanded licensing requirements to include private citizens. - The Supreme Court has upheld the right to travel without restriction (Shapiro v. Thompson, 1969). - Mandatory licensing for private travel infringes upon this right. *Traffic Infractions: Criminalization of Private Activity* Traffic infractions, such as speeding or running a red light, have been criminalized, subjecting private citizens to fines and penalties. - These infractions are not commercial in nature and do not harm others. - Criminalization constitutes an overreach of government authority. *Constitutional Violations* The current system violates: - The Fourth Amendment (unreasonable searches and seizures) - The Fifth Amendment (due process) - The Fourteenth Amendment (equal protection) *Restoring Constitutional Balance* To restore balance, I propose: 1. Repeal mandatory licensing for private drivers. 2. Distinguish commercial and private activities in traffic laws. 3. Limit fines and penalties for private traffic infractions. 4. Protect citizens' right to travel without restriction. *Conclusion* The distinction between commercial and private activities must be upheld. By recognizing these differences, we can ensure that government authority is limited and citizens' rights are protected. *References:* - US Constitution - Shapiro v. Thompson (1969) - Supreme Court decisions on commerce and travel - State laws and regulations *Copyright:* 2024 Duane Kirkland. Perhaps it is better to hobble the president and actually have them think through the legal ramifications of their obtuse decisions. And yes, perhaps Biden SHOULD be prosecuted for negligence. How much evidence do you need to acknowledge Trump had nothing to do with the events on Jan 6th? They just released transcript where Trump said on Jan 3rd to have National Guard or military at the capital to make sure everyone is safe. The Pentagon decided not to because of optics. There was no fighting or riots until the police started shooting gas and rubber bullets into the crowd. There were over a hundred undercover agents in the crowd, inciting violence and broke windows. Not one person has been charged with insurrection. Since the 2020 election, plenty of evidence has surfaced that election fraud did happen in several states. Mainstream media just didn't feel it was necessary to inform the American people. With just a little research, everything I stated can be verified. Why are so many people too lazy to do the research themselves and continue to put their Trump derangement on full display? Nobody will fault you if you can admit that maybe you were wrong and had been brainwashed. That shows you still have some common sense. But to continue to embrace a narrative that has been debunked where even Wikipedia has changed its definition of Jan 6th several times is crazy. If the left said you could fly, you just need to repeat it constantly to make it true. Are you gonna jump off a building when they ask you to? Cause that's exactly what's happening now. A vote for Harris is finding out the hard way you can't fly.
@charlesharris9965Ай бұрын
He was ACQUITTED by the Senate of any misconduct on February 13th, 2021. This means that he was charged and declared innocent of the charges. He cannot be tried for anything he did as President without getting the official permission slip from the Senate first. Every "case" that is even remotely predicated on his actions while POTUS are unconstitutional garbage 🗑. This means both of not-so-special prosecutor Smith's "cases", Fani Pack Willis' "case", Fat Alvin Bragg's "case", and even Mad E. Jeanne Carroll's Bergdorf Delusion "case" are doomed to fail at SCOTUS (if they ever get that far). All of these "cases" suffer from multiple constitutional violations (Articles I, II, III, VI, and Amendments 1A, 4A, 5A, 6A, 10A, and 14A).
@charlesharris9965Ай бұрын
Since President Trump was ACQUITTED by the Senate of any misconduct regarding the riot and the election on February 13th, 2021, he is not "disgraced." That is your own personal opinion that has the legal authority of a speck of dust. All of the so-called "cases" against him are garbage 🗑. SCOTUS will shred them into confetti. They all violate numerous constitutional Articles, several Amendments (1A, 4A, 5A, 6A, 8A, 10A, and 14A), and several SCOTUS Decisions.
