In recently released decertification documents, former Memphis police officer Justin Smith states in an affidavit that he reserves his rights under the fifth and fourteenth amendments. Justin Smith was terminated as a result of his actions relating to the death of Tyre Nichols on January 7th.

I retired from Law Enforcement after 30 years of service in 2020 and the officer's statement you are reading won't fly. I'm a b/m and worked on specialized units, which they are hand picked and possess the mental and physical toughness needed. My department made sure we also possess the right mind set to deal with things and represent the department values at all time. First of all there weren't any attempts to de-esculate the matter by assuring the citizen that he was safe from any harm. They initially used verbal and physical force to get corporation. They were trained not to tase and pepper spray the same subject at one time unless a life or death situation. They didn't use the two man or three man restraining or handcuffing techniques taught in self defense class. They violated every department policies they were taught. They used excessive force which they don't have any defense for regardless of his statement. The main question for that officer, once you arrived on scene, what did you do to protect that young man's life? Nothing!!!!!!!

Make sure to have Former Officer Smith identify which squad car is his. In this statement he says Mr. Nichols was leaning on his car to breathe better. That same car was on the scene the whole time which would place him at the scene from start to finish. In the video Smith is thee one with black shoes with the white borders around sole and its seen holding Mr. Nichols as Mr. Nichols is kicked in the face.

Evil Smith says he wasn’t sure whether the OC spray was effective. Even a child could tell it was effective, because it dazed and confused Tyre, and they had already been punching and hard slapping him. The OC spray left him even unable to protect his face, at that moment following the pepper spray, one sees a confused man just sitting there helplessly, he even stopped calling out for his mother. And the deadly beating, the head punches, kicks, the violent use of the baton stick, all directed to his upper torso, continued. They had switched off their police video cams, all of them, including this thug, but they didn’t count on the street light sky video cam recording what they thought would be their secret. Those that were limping, were doing so following all those violent kicks.

There is no way Justin Smith wrote this. His defense attorney did. Given the little legal loopholes, in legal jargon, the attorney is admitting he knows his client is guilty, and has no way of proving his innocence. That explains taking the 5th. He's taking the reasonable doubt path instead. The actual statements of Justin Smith with regards to his actions is very edited. That's a typical defense attorney preparing for a federal case...I recommend this attorney gets an independent psychological evaluation of his client. You should probably know exactly what you are defending, for yourself.

Can i share a truth here that nobody seems to ever mention? Police officers who are " On Duty " have NO 5th Amendment rights. They are a " public " servant. doing the " Publics " business. On the " Publics " dollar. Everything a cop does is a matter of public record. As such , that information in no way has any right to privacy , and those officers have NO right against self incriminating. They agreed to making all of their action public record, period point blank. If a police officer on duty does something , and then refuses to disclose what they did to the general public , or agents of the court..... Long story short the chief of police was trying to say I needed to have a State registration tag on a garden tractor that is exempt from registration insurance and state inspection and of course as an implement of husbandry it's exempt from the driver's license requirement. I got arrested for all four of them and then resisting arrest, you will see the rest of it in the video I've taken the initiative to put the relevant statutes within the video as it goes along. I watched former Officer Smith, easily distinguishable due to his limp. Watch the video again and see for yourself if his behavior/actions are dissimilar from his fellow Officers. At one point he can be heard saying that part of the time his knee had stopped hurting (possibly due to the adrenaline pumping thru his body). My opinion, what he was doing was completely in line with his fellows. Don't know how his attorney is gonna prove his FOS statement. If I was on the jury, he'd be marched out to the gallows along with the rest of the modern Slave Patrol!

A police officer shouldn't be granted the right to plead the 5th in incidents (crimes) they're involved in while in uniform. I have a problem with individuals violating others rights but want to use the laws to exercise their rights. Not really a good source of info. It's pretty clear she isn't informed on the current information available, outside of these documents. And when her understanding of these documents are "preliminary." Additionally, this information was not "released by the police department." They were filed in process of decertifying the officers and since they're public record, they are simply accessible. The police department has not been transparent about any of the information in these documents.

Miss does imply a single lady, but her channel name is Ms. Ms. can imply a single, married or unknown status. It also can imply simply a young woman. I think she would want someone that knows the difference between the two titles.
