And let me just say, these gang drug task force officers are in a position where they deal with federal law as well as state and local laws, so they are in a higher tier of responsibility because of federal laws they have to work under and enforce. Because of drugs and guns involved in those type of crimes. So , they absolutely had almost no reason to be involved in a normal traffic stop that didn't involve a known drug dealer or illegal gun runner. Tyre Nichols was not involved in any of that. 1st, Thank you for covering this. Next, you glazed over the part that captured my interest. "You never told the driver the purpose of the stop". This tells me, there was no reason for the stop. So, how is this only 2nd Degree? Even if he didn't know the victim. The reason was NOT in the course of his duties. The police chief has stated that they have not found any evidence that shows reckless driving (which is what the officers claimed was the basis) on the part of Tyre Nichols. For first degree murder, it's the following: 1) A premeditated and intentional killing of another; 2) A killing of another committed in the perpetration of or attempt to perpetrate any first degree murder, act of terrorism, arson, rape, robbery, burglary, theft, kidnapping, physical abuse in violation of § 71-6-119, aggravated neglect of an elderly or vulnerable adult in violation of § 39-15-508, aggravated child abuse, aggravated child neglect, rape of a child, aggravated rape of a child or aircraft piracy; or 3) A killing of another committed as the result of the unlawful throwing, placing or discharging of a destructive device or bomb. Second degree murder is: 1) A knowing killing of another; 2) A killing of another that results from the unlawful distribution of any Schedule I or Schedule II drug, when the drug is the proximate cause of the death of the user; or 3) A killing of another by unlawful distribution or unlawful delivery or unlawful dispensation of fentanyl or carfentanil, when those substances alone, or in combination with any substance scheduled as a controlled substance by the Tennessee Drug Control Act of 1989, compiled in chapter 17, part 4 of this title and in title 53, chapter 11, parts 3 and 4, including controlled substance analogs, is the proximate cause of the death of the user. In this case, for first degree murder the prosecutor would have to show premeditation or that they intended to kill Mr. Nichols. While the video shows that they intended to hurt Mr. Nichols, the prosecutor may feel like it will be difficult to show that they intended to kill.

This is PERFECT. What CJ Davis is describing, in detailed writing, is proof that she knew this officer was going off the deep end, committing 1st degree murder, and it's signed by her on January 25th, 2023. Her only concern is how the department (she) looks. There is no concern on her part that Haley may a public threat, even after describing his actions. She's trying to get him under control with the hearing threats. The letter from the police association is correct. CJ Davis jumped the gun, reacted in a correct manner so fast, because she knew what Haley was, and she was trying to do damage control to save her own a$$. Like I said, she'll leave behind a HUGE paper trail of evidence against herself. 🤣

@@jlorde8838 I f you read the decertification it said Hemphill lied when he said Tyre was driving reckless. TBI asked him to clarify that he said no. Also he said Tyre was violent when he deployed his taser the video do not support that also he snatched Tyre from the car himself. Did not ask for ID or registration.
