Jonathan Tan it is, Uber terminated drivers who violated their terms of service for cancelling rides without cause. If your not going to accept the requests and rates Uber has set, they're not going to let you butt in and get the good surge pricing.

I don't see the problem, both parties are free to peruse their own best interest. Uber has lots of rules in their terms of service, perhaps the drivers should read them.

Except these particular drivers were manipulating the system at the airport for surges. The surge at the airport does not work like the surge anywhere else. They violated the terms and conditions and were rightfully terminated for that reason. Uber does not have a problem with legitimate surges, but manipulating the LAX system for a surge is shady and only hurts passengers who just need a ride.

This is why I went from full time to part time. We are treated as employees and NOT as independent contractors. They have raised the cost to customers & we as drivers are NOT seeing any raises.

But the drivers all turn off their phones at once to create a surge. So they are in essence manipulating the Uber algorithm to create a fake surge. That’s what Uber has a problem with

Uber wants to say drivers are "Independent Contractors" so they don't need to pay them and then Uber gets mad when said drivers take action and go to surge areas to get paid? Riiiight....this company is a piece of shit. Take care of your EMPLOYEES better so they wouldn't need to do stuff like this.

Alex H. I drove for Uber for a year. They don't care one bit about thier drivers. They built their business model on passing all operating vehicle costs to the drivers, ALWAYS side with the customer on disputes (which some customers knowingly exploit to their advantage), and their corporate "support" is a joke. Not to mention, constantly raising their "base" rates that immediately goes back to Uber AND lowering their mileage rates several times while I drove for them. They constantly reset surge areas at peak times so the company doesn't have to pay drivers for surge rides (the only reason to even drive for Uber.) Uber is a super predatory business that should be disbanded. The only reason they still use human drivers is because the company thought they could kill local taxi companies, replace them with Uber drivers out of lower cost convenience, and then replace the Uber drivers with driverless cars! Their business practices can be followed in any news outlets by their constant legal dodging to subvert paying money to either the state, local, and federal municipalities and depriving their drivers and customers of money that is rightfully thiers. Uber is as trash as their corporate executives.

Youre not an employee.. youre a contractor. Youre being paid to drive. If you are not willing to drive, with or without surge, UBER has the right to NOT do business with you... welcome to the free market. Don't like it? Get a job.

The whole point is that they're NOT being paid to drive. Not a fair amount anyway. Believe it or not, some jobs have you busting ass for minimal pay. Not everyone is as fortunate as you are to have a high paying job. That's why we need *GASP* compassion for these people.

I drove for Uber for a year and a half...even used their services as a rider in several different countries. This company couldn't care less about the driver. For every driver that leaves the app or has their account terminated, at least a few hundred more new drivers come on board that very same day. It's a 24/7 cash cow for the company.

Because an uber driver is driving more than people just driving to and from work and a few errands here and there. More gas is used. More wear and tear. Turing the car on and off all day. Wearing down the brakes and tires faster. If you buy a newer car for uber and pay $12,000 for it and you rack up 10x the mileage then you would if you didn't transport people to their destinations and only focused on driving yourself to destinations then you would have that car 10x longer. It's a loss esp when the uber driving doesn't get paid much.

Tallal Labanieh haha who has a car 10 times longer. Statistics show most people get a new car every 3 to 4 years on average. Who said I had to buy a 12000 car. I brought a 8k Camry 2010 with 90k miles on it. In 1 year working part time maybe 10 to 15 hours a week. I paid the car off and only have 120k miles on it. Yes I put 30k miles on it between uber and my personal driving but it's paid for now. Oil change every 3 months no big deal and 2 tire rotations no big deal. I have no car payment and minus that and gas it's still netting me 13 bucks a hour on a part time job when I can work when I want and don't have a boss. That sounds good to me

Just like any business, you can write off expenses when filing your taxes. There are apps you run to compensate for miles, gas, wear & tear, etc...

WRO indeed people seem to forget there's also a thing called "engine hours". You can easily have 2 cars next to each other both with the same miles, but one could have over 200+ more engine hours. That 200 hours extra is a lot of wear and tear on the engine, especially the transmission depending on the speeds. Additionally that 200 engine hours can easily equate to a thousand or more miles on the another vehicle that does normal commute.

IRS guidelines allow you to set your own work schedule when labeled as an independent contractor. If they are truly independent contractors they should have the ability to accept jobs as they see fit. Now if uber wants to set standards on drivers only driving on surge, it should be uniform, clear, and set in stone across the board for all their contractors, not singling a few drivers out. I hope the drivers sue the shit out of uber.

Try dealing with there support when something goes wrong. uber will self implode and get regulated out of bizness talk of $1 per fare rideshare machmakinging tax baked into cost. that ups a pool cost. think of all the money for the states.

Go to craigslist and put an ad in under services and charge $1/mile. When someone needs a ride, you go in and figure out what the mileage is, and give them a price. Don’t take short rides, if they ask tell em you’re booked and move on. Eventually you’ll get steady work. I found a lady that needed 3 round trips per week at $135/day. Sweet.

Nice logic, the drivers are making real money, meaning uber is making money too, so why would uber get rid of them based on your logic? The real answer is the hard working drivers who put 8 or more hours a day, and service all of their customers all day regardless of surge pricing, should get first crack at the riders. Uber does and should not give out work to people who are trying to scam the system and the riders and other drivers. Not the hugest uber fan as I feel they take too much from the drivers, but I am a fan of this. It's like if a 9-5 worker didn't want to put his 40 hours in and just demanded he be paid overtime while laughing at the other workers.

Actually its quite the opposite, he thinks he knows what he is talking about but is actually having a largely negative impact on the system he is trying to play. When drivers head into areas to hit a surge, that increases the number of available drivers thus lowering or cancelling the surge. Also like someone else said, abusing it like this makes uber more expensive than regular cabs

You should check out how banks work... Rothschild's have 500 trillion, yet they still put the world in debt and demand interest paid on top of the original loan being paid back. this is incredibly misleading, these drivers aren't simply working when they want and turning off when they want, they are outright canceling trips not in the surge area, or not accepting trips outside the surge area,, this screws over the other drivers that accept all incoming "pings". Drivers are required to accept trips, these drivers have been fired because they have a high cancellation rate, not anything *directly* related to surge pricing

After knowing a few friends who've done the UBER thing, it's almost impossible to make any amount of money unless you reap peak times, surges, whatever they call it. After fuel, amenities for passengers (from what I understand necessary to maintain higher average rating to stay in business) and time. The company has made it increasingly difficult for people to even benefit from the service as a side job or hustle. To make it worth your time hourly there's almost no other option than to stay out longer hours more often. It's a glorified part time retail chain. More people on the ground + more limits on workable hours = the same strategy as home depot or mcdonalds. Max people, minimum hours per person. Buku dollar for UBER, peanuts for drivers.

LOL. You just described Capitalism. When I'm a customer, I DEMAND the lowest price. When I'm a seller (whether it's online selling or stocks), I hold out for and will take nothing less than a great profit or the highest price I can get. Capitalism is all about "buy low, sell HIGH" Uber has the leverage. They know that people who drive for them are desperate for the most part and need the money bad. Anything in life where the barrier to enter is low, you will not make money. Don't like it? Be smart enough to make more money somewhere else. It's not Uber's fault that you are not smart enough to figure out how to make money. They are just taking advantage of, or Capitalizing on the situation! That's what businesses are SUPPOSED to do. Don't like it? Don't work for them.

Drivers are declining rides to make the algorithm think no one is around the area. Thus creating surge areas so the drivers make more. They are cheating the system. This attitude can not be tolerated. They are scamming tons of Riders so they can make a even bigger profits off of them. This is why people are being fired for surging only.

The driver's are correct that they're private contractors. Not employees. What's funny is that Uber messages drivers when surges start happening. "Hey get out here and drive! We need help!" But drive too much and we'll deactivate your account without warning.

I think the surge is based a deficit between supply and demand. Drivers may actually manipulate the surge by going offline in certain areas and waiting for the surge to kick in. The thing is, the supply of drivers can balance with demand quickly, and the surge disappears.

Cameron Johnson most people seem to be wrongfully referencing the Sherman antitrust act in defence of the drivers... But this act makes it illegal to artificially raise prices to hurt consumers, so drivers who only pop up during surge are actually causing the surge pricing in the first place, thereby intentionally creating a surge and artificially raiding the prices, making those drivers in violation of the Sherman antitrust act... If they were honest about being on the Uber system would know more drivers available and their supply and demand algorithm may not have issued a surge, but instead these drivers artificially deflate the # of drivers available and then pop up when the price rises.

Bryant Woods On top of that the fares for cabs are significantly higher. Which means that you didn't have to wait for surge to make money. Without surge you basically waste your time and break even.

My husband is an uber driver. When there is surge half the time he gets regular request. And riders actually pay surge but driver get money for regular request. Uber keeps the surge money. Uber is playing a dirty game we'll see how long this last

Uber deactivating drivers because they are doing their best to try to earn something that can barely resemble a living wage! While they keep exploiting drivers who are desperate for work…and over charging passengers by using UPFRONT PRICING and paying drivers the per minute and per mile rates that usually end up in Uber/Lyft keeping up to 60%+ of what passengers pay!! this is how Uber explains upfront pricing : “We estimate the upfront price by considering a variety of factors that typically affect a fare, including surge, traffic, and tolls. We’re able to use past data to estimate the likely cost of the trip, and can present that price to a rider before they request. With upfront prices you cannot book a car without approving the cost beforehand” this is what I, an Uber driver in Chicago, see on regular basis: a ride in down town Chicago that lasted about 5minutes and for a distance of less than a mile costed the rider about 6 dollars!! there was no surge charge in this example!! Uber kept about 57% of this fare!! Drivers, do you think fares like this discourages tipping? I sure think so. let me explain what we drivers make (this can be higher or lower depending on the city, the information below is for Chicago) : uber x rides: ( per mile (95 cent) + per min (20 cents) + 1.7 usd base fare) minus Uber % cut, for myself is 25% uber pool rides: ( per mile (95 cent) + per min (14 cents) + 1.7 usd base fare) minus Uber % cut, for myself is 25% How Uber exploits drivers on uberpool rides: the driver does not get paid for overlapping time, base fare and mileage, let me explain this in an example: suppose I receive an Uberpool ride request at ohare airport, and the max number of paying passengers, which for my 4 passenger+driver car, is four. Now suppose all these four paying passengers (passengers are four separate uberpool riders who do not know each other) were headed to a baseball game at Wrigley field. Each passenger will see an upfront uberpool price (a discounted price when compared to uberx upfront price) I tried getting a quote for this trip around 6pm and I was quoted about 30 for pool and 35 for uberx!!! no surge this is just regular pricing!! Now let us add up that pool fare for FOUR paying pool passegers 30X4=120!!! minus airport fees 120 - (5.65 per fare x 4)= 97.4 travel distance and time for the time I got this quote was about 14miles and 45 min….now lets be generous and estimate uber paid 24 usd for the driver for this uber pool fare (yeah, I counted that 1 USD extra pickup fee for 2nd and subsequent pool rider that UBER was so generous to pay us drivers after they wrecked their brains trying to figure out where they went wrong in their relationship with their drivers-partners during their infamous 180 days of BS, I mean change) , they would still keep =97.4-24 (or so)=73.4 (or so) in their pocket !!! now, is it any wonder why the ride share companies love to push pool/line on the drivers!

You get personalized customer support over the phone or at their greenlight hub. They always take care of my problems with rare exception. The machine does care about the driver and demonstrates that every day. You are commenting on a guy who is gaming the system and delivering a poor customer service experience. The machine shouldn't care about Assholes. I have no problem working within the rules. I work in the same territory as this assclown. I make 2000 dollars and more per weekend. Thats just the weekend. This weekend was 3250. How is that not taking care of the drivers. They also provide me quarterly with 1220 dollars in health care compensation and offer a free college education at ASU plus discounts and benefits galore. You don't even know what you are complaining about.

I don’t know how Uber still have drivers. I did the Uber thing for a few months and they treat their drivers like crap with all the fees and percentages taken away. They treat you like an employee but list you as a independent contractor just to screw your taxes on top of it. I did Lyft for 2 months and it was way better.

GANTZ100pts it’s not that. People can work surge hours only, but that doesn’t allow them to only accept surge rides. The people getting in trouble would work during surge hours, and decline any rides that weren’t increased in price. If you do that you are completely useless, especially since price surgings entire goal is to flood the area with drivers bringing it back down to a standard rate of available drivers in the area. Now if drivers flood the area, but won’t accept any ride with a surge fee below 2.5x profit then you have a big problem.

Uber deactivated (fired) me as well after a passenger disputed the cleaning fee for puking in my car, and Uber claims it was fraud on my part... really? Uber makes excuses like 'fraud' when they simply want rid of a driver(s) it's a discriminatory system and more of us former drivers should file law suits.

You are never an employee dumbass. If you choose a short ride and you are below the five percent cancellation rule which is part of your contract, you can cancel. If you are not you cant. Its not good for any driver including this driver to be constantly cancelling. But worse it creates a bad experience for the customer, the other equally valid component. Uber is a service more like Tinder. It puts two people who need each other together for a half hour. There are rules to using tinder. But your not an employee of Tinder when you use the app. With Tinder you get a fuck. With Uber you get some cash. Uber provides me 4900 dollars in health care benefits which is given in the form of cashFree college tuition with ASU, free roadside assistance, discounts, and freebees. You are clearly not a driver.

Nobody has to work the airport and nobody has to take a ride in California where I work. Once you take a ride even then you can cancel. But you will get booted from UBER if you are constantly cancelling because your rides aren't long enough. And that is a good thing. I never work the airport because its idiotic. Anytime you don't have a passenger in your car you are not making money. Driving back to the airport and waiting in a queue means you are not making money. driving to the passenger at a large airport takes more time. If you take a passenger 40 minutes from the airport...a dream run. It will take you 40 minutes to drive back. Driverrs that work the airport are not intelligent and they don't make the kind of money I do.. Last year I was making 2000 plus just working the weekends driving Uber. Three days. sometimes four. Then I would get four days off. The new economy is awesome you dope. We don't want to be employees. Get that through your thick skull. I work in the movie/tv industry which I love but there is no job I can work in that industry or any other where I can consistantly make that kind of money and choose my own schedule. As an employee I don't get control of my schedule. If I choose to work overtime its my choice. If I work overtime as an employee its not my choice. And have you ever seen how much your overtime is taxed? I find almost all the people who bitch about Uber are not drivers. Drivers who are not making money in the profession are typically stupid or lazy. Stupid includes deciding to drive full time outside of a major market.

I never work the airport because when you have no passengers in your car you are not making money. You are not making money driving to the airport, you are not making money waiting in a queue. You are not making money driving into a large airport for a pickup. You are not making money loading and unloading luggage. If you get your dream run like 40 minute ride, you are now 40 minutes drive back to the airport. Why would anyone with a brain in their head work the airport. There are no airport drivers that make more money than me. If you think you can game the system working the airport and cancelling short rides you can't. I am the one making 2000 dollars for the same effort as the airport guy making $1200. That's the answer to your question.

If you consider yourself an independent contractor, then sure you have the right to accept or deny any ride requests. But at the same time as an independent contractor, your contract is what's called an "at-will" contract and Uber has the right to cease doing business with you.

2.5 is not 250%, you imbecile. Base for driver is .72/mile. Multiply .72 by 2.5. -- .72(2.5) = $1.80/mile. Is a $1.80 250% more than .72? Stupidity. At a $1.80 a mile, that's still far less than a cab.

Dude. ppl are soo greedy when it comes to giving rides. I've only worked UBER and LYFT a few times (overnight). I've often been told drivers 2am-6am pull up to pick up a passenger (take 15-20min), and if it's not a "long ride" or airport ride, the driver cancels the ride, and the potential passenger has to wait for another driver to arrive. And sometimes the new driver does the same thing (cancels) When a driver pulls up to the location, they can see the passengers destination

Honestly, Uber charge way cheaper compare to taxi cabs in LA in general. The drivers have to pay gas, mileage, repairs, insurance, depreciation, registration and pay TAXES and much more. Plus they put their lives on danger not only driving but also dealing with rude passengers as well. So its not worth it unless they charge like a real business and care for their drivers.

Recent dodger game, took 40 min to pick up rider at "capped" 2.5 surge was terrible to drop of rider 1 mile down road. Uber dont care about drivers. They would win a lawsuit. They're refusing to drive for less than a certain rate. That's free market capitalism. Also Uber can't fire contractors, that isn't even a thing. Rather they can discontinue business with them, but if they do it for reasons not outlined in the contract, the drivers can sue and WILL win. They did not apparently violate any terms here.

I never take a surge price. I take a cab instead. It's cheaper. One morning my regular Uber was $99 when it's usually $25 because it was raining. I took a cab for $40 flat rate.

I am a driver for uber . Thank God I have a couple incomes per month besides Uber.As a part time driver I see uber more as a community service rather than a way to make a living ,they even have a new service for the elderly gogogranny. You get to meet a variety of people but make a little extra money for living expenses.I don,t do too many surges which I see as a way to avoid auto accidents during rush hour.I feel sorry for those that drive just for uber to make a living.

My brother does only surge nights, Friday and Saturday night. Earns a couple hundred bucks a week for around 10 hours of work. But the other thing they don't talk about it what happens to driver star ratings. My brother sometimes gets 1 star ratings, simply because of surge pricing pissing people off. They should require a written explanation for a low rating.

IRS rules state that an independent contractor decides when and where they will work, an employee the company decides when and where the work happens. Uber could be on the line for not withholding taxes for their employees. (I don’t drive for Uber)

Clearly you don't driver for Uber. Drivers are not employees. Uber is more like Tinder than anything else. It puts two people together who need each other for 1/2 hour. Uber takes a percentage for providing that service. That's it. Nobody ever makes you use the app. You use it when you want. Use it three times or a thousand times. You can put it down forever, or pick it up again. All we have here is a guy gaming the system in clear violation of the contract rules for both parties. The equally important component in this story is the customer.

I've email Uber several times, suggesting they reduce the surge and increase the basic fare to off set the discrepancy. driving for .70 a mile and .10 a min doesn't make what's needed to maintain the cost of the maintenance of the vehicle much less the profit of making a living driving people around. I suggest they PAY the DRIVER $1.25 a mile and .27 a min and cut down the "surge " to a max of 2.5x. people need to pay for the CONVEINENCE and the service provided. Keep in mind the drivers "pay" isn't including Ubers "cut"! Uber TAKES a MIN of 30-50% of the ride. so the client isn't paying the driver the "whole" amount that they pay to the ride share.

A surge happens when there are not enough cars for the customers. They increase the prices to incentivise more cars to go on the road. That's the whole point of a surge. Now more cars do go on the road, and Uber fired them for doing exactly what they incentivised them to do. How does that make sense?

The same BS here in Maryland in the airport, late at night sunday it be surging and they charged the customer but not the driver. I send then a message get they act together and haven't driven for them till they rectified the situation.

Drowsy_ Mouse yea but that doesn’t work if people are only accepting surge prices. The entire purpose is to get more drivers in the area so that the surge price returns to normal, but if people are only accepting fluffed up prices then the regular price rides in the area will go unanswered, which in turn will cause the area to go into surge pricing because the algorithm is under the impression that the area is understaffed, when in all reality it has more drivers then the other areas. It’s just that those drivers are only accepting higher rates and don’t do the normal prices area, making them useless leeches. I’d fire them to

This could go both ways. Yes, the driver’s can choose the fares they want. On the other side if the driver’s only take the fares that make more money, the people who need them in areas that don’t make the money, get screwed. It’s a 50/50 debate.

Bus drivers get paid hourly though but Uber drivers just get paid per rides which are cheap as hell and unrealistic price. The least you can do is tip with your broke ass. Makes a huge difference.

Uber should allow the drivers to set their own rates and the riders can either accept the rates that driver charges or cancel and request, again. The drivers who charge too much will sit idle while the drivers who charge more competitive rates will be busy - and, that is the way it should be. The app could even list the available drivers in a rider's area along with the rates they charge and let the rider choose which driver they want. Each driver is an independent contractor. That means that they should be able to set their own rates.

The issue is a majority of people are not intelligent, patient, or knowledgeable enough to know how much to charge to sustain business and i imagine it would turn into a price war with people just wanting to win, driving prices potentially even lower. Its just supply and demand.

Shamim Ahmed Yes I agree. Uber should be socialized or be very highly regulated and their commission should only be 4-5%, and drivers should be able to set their own rates. Supposedly they are only a platform where drivers can facilitate their rides, how expensive could that be to administrate?. Uber provides no capital to their drivers, and the drivers are the ones who incur all the cost while the investors and executives reap all the wealth. They take a huge chunk of 20%

Don't hang out at the airport to much try to avoid the strip as much as possible and download the kickback app so you can no where to get that extra money. And also friday, saturday, sunday and monday mornnings are the busiest days.

Same thing happens at regular cab companies. I can be working peak hrs. 2-3 am on weekends. Fares average $ 22- $ 25 . I'll get pulled away two zones over for a $10 fare

So let me get this straight.....more demand needed for drivers, they provide that demand, and uber says that's not right? The whole point of the "surge" is to match demand with supply, when thousands of uber drivers flock to the healthy multiplication factor, the supply increases drastically, driving the price down......that's the point. You can sit and wait to be round-robined in a surge zone, or you can go flat rate somewhere else and get steady money.....it's practically the same. uber is stupid.....contractors are stupid.....humans are stupid.

What is actually happening most likely is drivers are waiting in a surge zone, then get a ride request from someone outside of the surge zone, then decline that ride. You can get requests like a 10min drive from where u are for a pick up. Declining rides is definately frowned upon and this is stated in the rules when you join as a driver. This is bad for the service because riders outside of surge zones will keep getting matched with a driver and get canceled. I honestly don't see a problem with this at all.

This is from drivers overly taking advantage. The Uber/Lyft lot would be full with no parking for other drivers trying to work because they are sitting there offline waiting on surge. It's best to just keep Rollin ride for ride. Around town you can get away with only surge. But not at LAX

A drivers job is to make as much money as possible and be smart and honest about it. How is positioning yourself for the best fares fraudulent or abuse? How about drivers that don't drive during peak traffic, is that fraudulent or unfair? If you don't cover your costs Uber won't reimburse you because you drive peak traffic. When Uber gives you incentive to go to an event you usually earn more, so what's the problem when you predict the surge or best time to drive? The fact that bit may be surge only driving shouldn't matter, after all we are independent.

I looked into driving for Uber and it looked as though I’d have to take on additional insurance on my vehicle since it wasn’t just for personal use anymore. I’d sign up for Uber to be a driver if I can set a trip profit minimum. And, if riders don’t accept the cost, I go home making no money. That’s not unreasonable, is it?

I still don’t see why uber would care about this? Either way they are getting drivers to those surge locations which therefor would lower the surge since more drivers will be going to that area, which is where they are needed the most.
