Please answer my question... I want to know about CSPA law specifically for F4 category under consular processing.I have deeply studied and researched about this topic on uscis websites, discussed with many attorneys. I studied that CSPA age equals (Age at time of Visa availability in Visa Bulletin Chart A) - (Pending time until case was approved by USCIS) My main question is, does CSPA age freeze or becomes locked for F4 Consular Derivative applicants until you get interview date from embassy if you have fulfilled the "Seek to acquire" requirement by paying AOS fees when Visa becomes available in Visa Bulletin Chart A ? For example, my age is 26 today and my pending time of approval is 4 yrs. I was below 21 when Visa became available in V.Bulletin Chart-A and I fulfilled "Seek to Acquire" required within 1 year by paying AOS fees to get CSPA benefit. So will my age be freezed below 21 until I get interview date from US Consulate/Embassy ??

Hi Tsang, great content! I don't see the way of applying for the CSPA benefit through the portal my dad was directed to when receiving the "Notice of Immigrant Visa Case Creation". How can I apply for that benefit? I'm now 28, but when my grandma (U.S. citizen) filed the petition for my dad I was 15.

That new law about cspa doesn't work in consular processing just adjustment of status.... in consular processing they still use just chart a which is total stupid. We outside us are not worse than inside USA... That stupid law separate families...

@TsangAssociatesPLC can we file a lawsuit against this bad policy ? My son aged out due to his nationality, place of birth and PD, when I filed EB5 petition he was under 21. We filed DS-260 and paid NVC fees within a year after approval.

@aaronmendonsa3481 that's change nothing even if you paid fees and provide documents in time. If your son is aged out in the day when visa is available (visa buletin) and you cannot use CSPA you have to wait for your time. That's it. Lawsuit against department of state. Who's gonna pay for that. Previously some people wants to use filling dates in consular processing to calculate cspa but DoS still don't allow to use it. They don't care about our immigration process although we have US CITIZEN families inside USA...

My U.S mom applied for me the I-130 and it has approved when i was 16 y.o. I have entered the states with the IR when i was 16 years old as well but for some family reasons i couldn't reside in the states. I am residing outside U.S since then with my mom. Can she apply for me the IR again ? Is my age frozen under the CSPA ? thank you

My father has been selected in dv lottery 2025 , and we filled the form in the last October I was 20 yrs and 6 months old, two weeks before 7th may 2024 (time that names listed) I turned 21 so still im eligible for the visa along with my family?
