no balls to show up in court? it's a preliminary.. its extremely rare for the parties on either side to be present for a preliminary...they are most often advised not to by their legal team. maybe you should learn the judicial system before making accusations I certainly don't support the laundries, but to throw around accusations or pronounce guilt because they weren't there is going against everyone's constitutional rights

@@nataliewest9084 im an Editor-in-Chief of a news outlet, trust me, I have followed this from day one and no doubt have more details and more knowledge of the case then you. I have also been in HUNDREDS of court rooms for HUNDREDS of trials in the over 20 years I've been in the industry and have extensive knowledge of the judicial system. I am well aware of how the Laundries have acted and responded to the situation, and as much as it sucks, and as shitty as it feels, they exercised their constitutional rights that we are all afforded. We all hate how they handled it, but, the way it sits at this moment, they are not guilty of anything. All we can do is hope they do face repercussions, such as responsibility for their lawyer's public comment on their behalf as their agent. You can yell at me all you want, that doesn't change the law or our constitutional rights. Yes, it's awful, it's hurtful, I don't support them one bit, but on all honestly, them exercising their right to remain silent is what they were advised by their lawyer to do and is what everyone should do. You ALWAYS use your right to remain silent. You're making a huge mistake if you don't. It's that simple. Frustrating for others, but still that simple.

@David Wang You certainly live up to your name! Totally missed the point of the original post. Obviously an injustice as immense as the murder of Gabby Petito by her fiance Brian Laundrie can never be put right. Nonetheless the concept of justice is very important in tragic cases such as this. The closest we can ever get to justice is through the courts. If you are a lawyer you should understand that! Many people share Gabby Petito's family frustration that her killer cheated justice with a gun, and escaped a murder trial and life sentence. But the despicable parents who protected him from consequences are very much alive, and should not escape consequences for the despicable role they played in the aftermath of this crime. Chris and Roberta Laundrie went to great lengths to be human shields to their scumbag son, hiring a lawyer to put a barrier between him and the desperate Petito family, the police and the media. They obviously did that because Brian had told them what he'd done to his fiance. And while the Laundrie family was clearly, fully aware Gabby's lifeless, strangled body lay rotting, undiscovered and vulnerable in the open air, they continued to prioritise not her the victim, but their son her murderer. There can be little doubt these parents facilitated their son's cowardly suicide, providing a cover story for his disappearance, and a gun to do the deed. Bad enough for her family, that the scumbag who made their beloved Gabby's life hell in her last two weeks before he finally killed her was never charged with her murder. Thanks to his molly-coddling parents - and police incompetence - Brian Laundrie never had to answer for his horrific violence against the defenceless woman who had agreed to be his wife. It would be another terrible injustice if his callous parents also got away with their serious crimes against Gabby Petito. Like millions of decent people around the world, I wish the late Gabby Petito's family well in this legal fight for a small, belated and fully deserved measure of justice.

Their son committed a heinous crime murdering her, they did not aid in finding the missing girl, they kept her belongings, they covered-up, and hindered the rescue and investigation! They caused suffering and damage to the Petitos. They enabled their son to escape justice and take his own life! The couple wasn’t even married and yet Gabby (& her belongings) is somehow ‘owned’ to be abused by The Laundries? This is far more than a moral issue. @@TheWalkbyfaith413 If the people from the restaurant are going to make a statement, throwing out someone’s character to be stomped on, at least have the guts to show your face. Otherwise nothing you say , IMO, is noteworthy. A couple sitting not far from them tell a different story. Their story is much more believable. For the simple fact that when they were at that restaurant and all that was going on , they came home and the guy said it was bothering him because for some reason Brian looked familiar but he couldn’t place him. So they were already home and it was a few days later when the guy was getting ready for work that it hit him, he said oh my God. And he came out and woke his fiancé and he was like oh my God oh my God wake up I know who that was and she’s like what are you talking about and she immediately did a video and she was half asleep. So then she did another video saying OK wait a minute I need to calm down, And she did another video. News did an interview with he. Here’s the deal , she never once didn’t show her face, she didn’t once not say who she was, and her story never ever changed all three times. She told her husband that guy is giving me the creeps. She said because he was so angry and you could feel it off of him. Now I’m gonna believe her and her husband who have nothing to gain or lose.whatsoever none. They were there only because they were in the area for a wedding the same wedding that was going on where those two girls got killed. So my point is they have nothing to gain or nothing to lose. But that manager at the restaurant sure did and it was probably her boss telling her you gotta get out there and say something. So I’m gonna believe people that show their faces and story never changes then, an interview done with someone who doesn’t want be identified, and works there. It’s her word against two other peoples words.

Ugh... all of that is completely irrelevant to the Petito's "intentional affliction of emotional distress" argument. Those are allegations relevant to a criminal case not a civil case. This is a motion to dismiss, the judge has to accept the allegations as facts! so nobody is arguing whether or not the laundries knew that Brian had killed Gabby. Assuming that the laundries knew that Brian killed Gabby and assuming they knew where her body was, do the laundries have a "duty" to divulge their knowledge to the Petito's!! That's the only argument here. Morally, of course they have a responsibility to tell the Petito's where Gabby's body was! BUT legally they have no duty to speak! They have a 5th amendment right to remain silent, especially considering that they were being accused of harboring a fugitive after Brian disappeared. The laundries will be held accountable for their actions eventually but it's not going to happen in a courtroom. The judge is most likely going to grant the motion to dismiss. I have truly believed the whole time even when the public first heard about this that the Laundrie Parents knew much more than what they said they did. What did they ask their son when he came home in her van without her? Did they even wonder where their future daughter in law was? Nothing about that in any way is normal. If the Laundries claim that they knew nothing, then why did they choose not to answer Mr Petito or Gabby's mother when they tried contacting the Laundries numerous times to just ask if they heard from Gabby? Their kids were engaged! Gabby even lived with the Laundries for a while! Choosing to Not answer is Not normal! In fact it's very odd. The Laundries even took extra steps to make sure they could not be contacted in any way. Why?? It's because they knew the truth and they were protecting their son and helping him try to disappear. The Laundries knew much more and caused Gabby's parents to worry and wonder for more than a month before she was found.

You're absolutely 💯 correct! There are people on here commenting that the Laundries weren't obligated to or that they're putting the blame back on Gabby's parent's which is absolutely heartbreaking and asinine! They (Laundries) absolutely knew a lot more details about what Brian had done earlier before has been reported. His own sister has stated that some things weren't adding up with all of it including how her parent's were acting. That should tell you and everyone who has been keeping up with this case from day one that with all the interviews things have slipped up/out about that Brian had killed Gabby before the authorities found her body. Brian is guilty of her murder and so are his parent's for NOT coming forward to what happened to Gabby sooner. Looking back, all it seems is that they were trying to figure out a way to get their son either out of the country and/or away from all the media. How did he escape the house without anyone realizing that he was gone with all the media there almost 24/7....the parent's leave at different times but come back in one vehicle (their truck). Oops, when the 👮‍♂️ 🚓 want to talk to Brian, he's no where to be found. Wow, his car is found at the Nature's Reserve that Brian has always goes on a hike...but NO BRIAN. The car is looked over by the authorities and then turned back over to his parent's within that day if I'm not mistaken. So, how did his mustang get there when NO ONE SAW HIM LEAVING DRIVING THE VEHICLE..LAST PERSON SEEN DRIVING IT WAS BRIAN'S PARENT'S!! GO FIGURE

I'm sorry but you people have absolutely no understanding of this case. This is a civil case for "intentional affliction of emotional distress". The conversations between Brian's sister and his parents is completely irrelevant. How do conversations between the sister and the parents afflict emotional distress on the Petito's? Nobody is arguing whether or not the laundries knew Brian killed Gabby. This is a motion to dismiss! The judge has to accept the Petito's allegations as fact! Assuming the laundries knew exactly where Gabby's body was (the court has already accepted that allegation to be true), did the laundries have a duty to indulge that information to the Petito's? That's the only question here. Nothing else is germaine to the civil case or the motion to dismiss. Morally they are guilty but legally they are not. @David Wang If you don't understand how it's a fourth amendment violation to use the civil discovery process to search for criminal charges, then I don't know a better way to explain it to you. If the cops wanna charge them with a crime, get warrants, and pursue it that way, I have no problem with that. As for the fifth amendment violation, that's related to the supposed duty to inform the Petitos of their alleged knowledge of the crime. Something the Petito's lawyer asserts as fact in his court brief, but provides no evidence of other than the fact that they retained a lawyer and stopped talking to them. The Laundries are not being charged as accessories after the fact, yet. If the Petitos are allowed to assert that they knew about the crime simply because they stopped talking and hired a lawyer, that's a huge problem for the fifth amendment. There's no way that would be allowed to be used as evidence in a trial, in fact the lawyer might face a fine or even disbarment for even suggesting it in open court (in front of the jury). See the Rittenhouse trial for an example of a very angry judge dressing down the prosecution for exactly this argument. I've said this already, but imagine if people were allowed to sue everybody they suspected of a crime, then use the discovery process to fish for evidence of said crime, simply based on the fact that they didn't say anything about the crime to the victim, and/or retained lawyers. This would utterly destroy the right to due process, because people would be afraid to hire a lawyer, lest they be sued and charged with a crime on that basis alone. It would destroy the right to avoid self incrimination, because it would imply that everyone has a duty to inform on themselves, and it would destroy the right to be secure in our property and effects against unreasonable searches and seizures, because it would provide an easy way to simply do an end-run around the fourth amendment, and use the civil process to provide law enforcement with criminal evidence.

Yup! Morally they are guilty but legally they are not. It's important to understand the difference between the two. They committed no crime, the government cannot compel them to speak and divulge what they know without a court order. Assuming that the laundries did know that Gabby was deceased (which there is no evidence they knew anything) the laundries were never subpoenaed in any court proceedings and they had no duty to speak. The laundries were suspected of harboring a fugitive after Brian went missing, under those circumstances the parents absolutely had a 5th amendment right to remain silent! This isn't North Korea, nobody can be forced to speak to the police. The laundries attorney's statement "we hope Gabby is found" is insincere but it's definitely not egregious. Things would be different if the laundries had lied to the police or given misleading statements but they didn't. Instead they chose to remain silent and not to speak with the police or the Petito's at all. Even the case law that the Petito attorney presented contradicts their argument.. Someday the laundries will have to answer for what they've done but that's not going to happen in this courtroom.

Then the proceeded to get a lawyer which right then and there is questionable . Just because their son screwed up and murdered Gabby, doesn't mean they keep the truth . If it was the other way around they would feel the same. Brian's parents attorney is not doing so well. ABSOLUTELY, YOU TELL THE TRUTH

This is so sad 😞. Why couldn’t the laundries at least speak to Gabby’s parent’s. I know the must love their boy, but her parent’s needed closure for gabby. If I knew my beloved son murdered his fiancé while on a road-trip? The girl had lived with Bryan’s family for a year. I would have to ask my son to turn himself in. He might be alive today. But how could his parent’s just go off to kill himself too. I don’t think the attorney for the Laundrie’s is not doing a very good job. But, for what looked ignored to Gabbys parent’s . They helped Bryan get away. His parent’s refused to speak to her family. Why? They had to know this was killing Gabbys family.

What a deeply cruel family. I could never do that to someone and live with myself after. Never. And that is fact for anyone who is truly a decent human being with a conscience. The Laundries clearly lack that part of the brain that registers emotion.

This is the thing though let's be honest we all would like to think we would all do the right thing .but if it came to it would we try and protect our own .I am being honest I can't answer because I am not in that situation.I would like to think I would do the right thing but love is a very strong emotion and so is the need for a mother to protect her own .and everyone deals different with emotion. Some would panic and conceal to protect and some would panic and call police and then some would call police but hide say the weapon .and others would just support so unless we are in a stressful situation we don't know how our emotion would be

No decent parent would have the heart to do what they did to Gabby's parents, especially seeing as how the Laundries KNEW Gabby, she stayed in their home often, even living there at one point. Gabby was no stranger to them, so no, you're wrong..

something is terribly and inherently wrong when you can be aware of a murder, aware where the body and murder weapon is, where the perpetrator is hiding and aide the perpetrator fleeing-it should not matter if family or not. it should be the law that u r held accountable.

@David Wang this is a civil case in regards to pain and suffering, how can anyone not take emotions into account? Look at her family, their level of pain speaks for itself. This is just an attempt to try to stop it from going in front of a jury who yes, will have emotions. Bc really, the laundries may not have broken a law but the majority of those that followed this case agree with the petitos, the last thing the laundries lawyer wants is the people to make the verdict.

That would be a very bad law. We don't know what the Laundrys knew. How can you prove that? If you had an adult son living with you and robbed a bank and went back to your house should you be arrested because you obviously knew what he did?

Wow! "in order to invoke your fifth amendment right there has to be a crime or be part of a causation chain to a crime " ...what the judge said changes everything! Bertolino had to know there was a crime commited when he advised them to plead the fifth. You don't plead the fifth "just in case" just when you are involved on a crime and no charges had veen made against anyone when they lawyered up, the next morning of her death.

@David Wang When their lawyer mentioned his clients pleading the fitfh THE JUDGE was the one who said you cannot "plead the fifth" unless there is a charge or a crime being investigated none of which existed at the time the lawyered up. Anything else you wrote after "shut up" I didn't read because I'm not interested in what somone who cannot communicate in a respectful manner has to say... If you reply to me again I will report you.

I hate to say it, but as an attorney I’m more inclined to agree with the Laundries on this. I think what they did was abhorrent, but I don’t think it’s necessarily actionable in a civil claim. It would be more appropriate for a District Attorney to charge them with harboring a fugitive or something to that effect.
