This was done near where I live and the subsequent flooding caused the rock in the stream bed to move to the low water bridge below my house to clog up and keep the bridge flooded. Very inconvenient for the kids riding the school bus and their parents. When you change the stream bed it changes the waterway in ways you wouldn't expect.

About the same thing happened to us many years ago. There was a shallow berm building up and it did make a nice swimming hole. We were set to remove the berm that had formed but people got all uppity and stood between it and the machines. The mayor showed and told us to git. Three months later the river changed path and funneled into Main Street and took out city hall and some other business. The mayor got recalled.

Back in the early 80's......we had a couple men running a good dredge for a few weeks in a river here in oregon......they may be moved a 100 yards of rock......few yrs later the river changes its course and people down the river lost acres of land..

Very unlikely the dredging had anything to do with downstream flooding. Most commonly you will see an UPSTREAM erosion issue due to headcutting. Unless something like a large log being dislodged and jamming a culvert happens permitted dredging or bankwork is rarely an issue.

@warren michael , Judges can apply the law whichever way they want if it makes more money for the government. I watched a Judge make a statement to a defendant and then with the very next defendant , completely reverse himself . Yes , the Judge did fine both defendants ! It was a case of guilty if you do and guilty if you don't . I got a speeding ticket one time for doing 50 in a 35 zone. I was following right behind four other cars that had also just gone pass the deputy ! Being car number five I could not possibly have been going 15 miles an hour faster than they were . The situation was that we had just crossed the county line. The deputy was at the end of his patrol route. I was his last chance to issue a ticket. I explained all of that to the Judge. He did not want to hear any of it ! Yes, of course I had to pay the $130.00 fine. But , I'll tell you what . If I were to come upon that deputy and see him laying gutshot at the side of the road. I would simply turn my head so that I could not see him and just drive on by. Maybe the Democrat deputy could call his Democrat Judge to come and help him. As if the Judge would do that . lol

Seems fishy to me that the game warden shows up 30 minutes after the work starts claiming that land owners had called and complained, yet had already spoke to the judge about the permit. How did she know to talk to the judge? I wonder if the dozer crew was being paid by the hour? that would explain a lot.

IN Ohio we have the Ohio State Highway Patrol, the Ohio Department of Transportation and then the PUCO Motor Carrier Enforcement Division to screw with truckers. More likely is a fine from the state, despite the nice wardens. One decent fine and it's gets hard to secure future permits. This was a very dumb idea. Any legit, experienced operator should know working in an active channel requires planning and permitting. Be glad there were no anadromous fish present.

captainvideojw no sir, Texas is different than other states in the union when it comes to property rights when they entered into the union. Texas did not give up its property rights as part of the deal as becoming a member of the United States. With that being said though, the only time the bed under a stream or navigable body if water can be privately owned is if the propertys chain of title comes from a Spanish Land Grant. If your property is Spanish Land Grant you own it and can do whatever you want to the bottom. The things you cannot do is block its navigability off by fencing and you cannot stop people from fishing or boating through it.

Standard game wardens, they rule over all land and animal, according to them. The game wardens have been given way too much power. In NC they can come on your property unannounced without any form of warrant if you have a fishing pole leaning up against a barn. I understand we live in a nation of laws but law abiding working folks should have refuge from this type of "police work". The sentiment argument has no weight, those 2 tractors couldn't produce the amount of sentiment in a month that a 15 min TX thunderstorm could.

roy hoco in Texas the bottom of all rivers are state property except for some very old Spanish land grants. There is a process to follow when doing this type of work. Follow them and you will have no problem.

The Frio is a navigable river therefore it belongs to the state and within the natural channel even when dry it is public land. Therefore you cannot just decide to dredge the river bed. TECQ and in the case of the Llano river I live on the lcra need to sign off on any dredging big or small. I am not sure which water authority governs the Frio. You can't even remove river rocks legally without Tecq permission on any navigable waterway which is all they were moving not sediment.

Businesses along the river in this area make a lot of money off of tourists who come out and stay in cabins and buy food and ice and beer. All rivers in Texas belong to the state. No, your property line doesn't run into the river. The only folks that have a problem with the law are law breakers. I grew up next to our local game warden that has since died. I road with him for years and he was always treated folks with respect until they became belligerent. I have the upmost respect for game wardens. The man having the river dredged knew he was wrong and so did the judge. I wonder if he got a permit from the boys in Austin. Does anyone know?

John Maxwell the the river beds in the state of Texas are property of the state in almost all areas. There is good reason for that too. In this specific region of Tx there are multiple rare plant and water species that are a part of the Frio river that are crucial to that river.

In Texas the initial contact would be TCEQ I believe, depending on scope and METHOD it may require a nationwide permit. Which depending on scope and METHOD is a straight forward application. Regarding METHOD, as a rule backing a dozer into the creek is not an acceptable method in a running waterway anywhere in North America. That significant time was spent filming the dozer in the water and posting it on KZbin shows a complete disregard for the process. Before I get a bunch of negative comments, ask those in and Houston if sediment transport and flooding is a concern.

I did not see any hydraulic fluid leaking out of the earth moving equipment. I seen no oily film on the water to give me an indication there was oil leaking from the equipment. If equipment is properly maintained, like you car for example. It will not leak oil, transmission fluid on.

My company I work for in NY.in order for us to do a stream job we have to pump the water around where we are working in the stream.one big ass pump.with a big ass pipe that divert the water.(this is nothing new).been doing stream work for year's.you can't just dig in the water and dirty it up.or you face heavy Fine's.30,000 and up to 100,000.you have only 2 Chance's too dirty the water and that is to dig a hole and set your pump.and at the end of the job to pull the pump.and ya the pump run 24hrs around the clock till the job is done.i am surprised they let you go without the proper paperwork.as a contractor they should know this.so some of theses comments are retarded.i have been doing this for 30 year's and the law has never changed.do the job right and you make good money!! just have to go through a long process and get the right paperwork 😉

They're not "cleaning out" the river for flood control... where I come from that us referred to as gravel mining. Anyone notice the empty red dump truck parked up the hill? That will be loaded to sell the rock. As sediments, including coarse gravels/rocks migrate towards the ocean, the "holes" they dig will just fill in quickly., and do nothing for flood control or native fish. This technique is good for one thing... making cash by selling river rock for gravel and black top.

That's a river? I'll give you a creek, but not a river. When I was young I could have pissed over that creek. Hence it does not qualify as a river. As person should not be able to through a rock over a proper river.

Navigable waterways belong to the public. These hillbillies have no right to dig up the river without approval from a public agency, ie:DNR.

It's good to make some holes in the river and make some Eddies. It give the fish a place to hide and recoup there energy. It's pretty simple stream or river management but some how the DNR knows how to mess it up and make it more complicated then it needs to be.

old greg NO ITS NOT GOOD MANAGEMENT. IT destroys all the other river life. Here in Washington, they have mutilated the river and its estuaries leading to many anadromous Salmon, Trout Steelhead, Dollyvardon and others. they dredge up the eggs and move logs that provide protection.

There is nothing that a person can do, ala bulldozers and excavators, that will 'make a river better'. The 'ecosystem' is not just fish swimming in the silt filled water stirred up by the machinery,,,, the machinery just scraped away all the bugs and algae the fish need to eat. Rocks are places eggs are laid, bugs hide under and behind, newts, salamanders, worms, flat worms all hide behind rocks and logs on the bottom. And flood control? I have never seen any flood control, TVA included, that was effective and not damaging of something else. Nature does a better job.

Sailor376also I agree. Here in Washington, Tribes have battled for years to stop all the damage done for decades by the non tribal entities with clear cutting and other actions that cause siltation, low oxygen and other problems like diking.

When ever a game warden comes on my property first thing they hear is "get the hell of my land" followed by the slamming of the gate. No authority on private land in TN.
