11Alive Investigator Rebecca Lindstrom has spent the past six months talking with homeowners who truly are powerless when it comes to their HOA. She shows how the law protects the people who create your community - rather than those who live in it.

Some work very well, and are noticeably nicer than the non hoa neighborhoods near them. I guess you need to do your homework and really check it out before buying. The Del Webb communities seem to work well for example . I have 3 of those near me and I have heard all good things from people living there

@Billy Ray Valentine I think the Del webb communities are set up well, I would stay away from the small ones like these.. if you want to live in a nice gated community with pool and clubhouse, in your retirement, it has a HOA , and lots of people want to live like that

@ HOAs are not good for you. They control your home and private property with too much power and no accountability. I'm glad you've had good experiences but we have moved around lot with the military and lived in about 10 or 12. Only one was truly good. The others were at best a pain in the butt and at time nefarious in their intentions. A good HOA is always one vote away from doing harm to homeowners.

With what money do they each do this? Between property tax and HOA fees and retirement no one person has enough to make it worth a lawyer's time. Needs to be a class action law suit. But legally Pearson has it wrapped up with a nice big bow so it will take legislative action to make a change. Always read every word, especially the fine print of any large purchase (and small ones, too). Me? I have always steered clear of HOA as much as I resent neighbors who do weird things to reduce my quality of life and decrease my property value. I'll take that over someone else telling me what I can and can't do and making me pay through the nose for the "privilege".

This guy got to write all the rules in the contract. He's probably got a clause in there in which he can raise the fees residents pay to offset the costs he incurs in a lawsuit. All the rules are tailored to benefit him alone and the residents are stuck with it. They can't even sell their homes.

So true. Trying to move out now. I have fought those inward thinking folks a few times and won in each case. Nothing that went to court though. Once I wanted to move my fence line since I live on a corner lot. I contacted the city first for approval. Then I completed the request through the HOA. The guy at the HOA Headquarters (me being facetious) was giving me the runaround. He said he was going to deny my request because I wasn't allowed to move my fence because it would extend beyond the front of my house. I said it wouldn't because it wouldn't go past my driveway. He said I was wrong because my driveway was facing the front. I told him no, my drive is facing the side. We argued and I finally told him that I have been here for 4 years and I am pretty sure I know where my driveway is located. He got all huffy when he realized that the builder never showed the plot plan for the lot. I finally agreed to approve my request. After that day I told him on two additional occasions where he and the HOA could go with their mess. That management guy left the HOA and were haven't been bothered since.

I lived in Houston Texas years ago I lived in a subdivision that had a HOA. In Texas the HOA's have a lot of power. If you didn't keep up with your HOA dues and assessments the HOA could and would put a lien on your property and eventually even take your house for past due association dues. They could evict you from your home even if it was paid for. HOA's should not be allowed to be controlled by the builder of the community. It creates an endless pipeline of money to go into his pockets. And a HOA should be run by a board of directors that own and live in the community.

If your waiting for state legislatures to pass new laws to fix this problem, you will never see it. Most lawmakers are in the pockets of these rich developers and their lobbyists. The only way to stop this type of corruption is to break them financially. And you do that by not buying a home that has an established HOA. There are plenty of homes on the market. I made a point to build my home in a development that doesn't have a HOA. A couple of years later, some of my neighbors started a house to house campaign trying to encourage the homeowners to start one. I convinced them otherwise. I will never belong to a HOA.

@dbadaddy7386

People fall in love with the property and don't want to know about problems. At closing, it's far easier to just handwave away the HOA and any other problems and take ownership of the dream than to think clearly about any problems. Then they ignore the HOA until there is a problem. How many HOA members actively participate and regularly attend meetings? Sometimes the initial rules are heavily biased, but a lot of times failure by members to actively participate results in a few people getting and abusing power, and sometimes they genuinely believe they are making the community better by petty enforcement.

Yes, the HOA houses look a bit better and have a slightly higher value because they were built a bit fancier. However, I've saved thousands of dollars over time not having to pay HOA dues while the surrounding streets are nicely maintained. Plus, more prosperous people have moved in on my street because the entire area is doing well and it's starting to look a lot more like the nearby HOA areas. Avoid HOAs if you can.

I'd never live in an hoa. It's my property and I sure don't want anyone telling me what I can and cannot do or charging me a bunch of fees or fines. They make them sound attractive at first but they can change anything they want. I personally think they all should be regulated and have their abilities limited.

CC&R's (Conditions-Covenants&Restrictions) are the rules that govern all activity in the HOA (HomeOwnersAssociation). CAUTION; The rules are written BY & FOR the Developer. Developers often abuse their power and use unsuspecting buyers to fund their dreams. NEVER BUY INTO AN HOA without reading and understanding every line of the CC&R's. This scam has existed since the 80's in California.

ANOTHER SOLUTION if the contract does not have his signature on it when you get it, scan it, alter it to your wishes like he has the pay you 100000 in HOA dues every day. and no premission for anything {install a golf court in your yard, APROVED, add 10 stories to your house: APPROVED} then take it to the office have him write his signature on it, you write yours then he has no legal ramification to take you to court, since he signed it HIMSELF. if he wants to make unfair contracts, all you do is alter them to make them fair for you

The “Committee” is comprised of the developer and a few people who bought the property early on in order to exploit tenants or newer home owners. This HOA business is just a way of stealing from people. They should reject HOA or any properties that fall under HOA.

My Palm Springs HOA (about 350 senior only homes) has two pools (one with a lift), 2 Jacuzzis, 3 tennis courts (how many 65+ seniors do YOU know who play tennis?), a full gym, steam room, party pavilion and banquet hall that seats 200, library, gated entry and armed patrol guards, and HOA fees are around $240 a month. Yeah, every election the new board gets whiney about parking or house numbers, but it could be worse. During the election Trump supporters were warned NOT to post pro-Trump signs lest the mostly gay community (I'm literally the ONLY straight man living within 2 blocks) vandalize your home.
