Carvana was buying cars with salvage titles, "fixing" them at rock bottom prices, then selling them as "clean" when the state would not issue a new title because the work was so shoddy.

@@renegaderay4658 For a period of time the State of Illinois would not allow Carvana to sell cars until the cleaned up their title mess. I believe that the issue has since been resolved.

Happens all too often. Big car dealers have an unbeliveable amount of overhead regardless of sales volume. One month they may make a million, other times they may well loose a million. The lenders well know the risks, and normally get higher rates across the board to cover such losses. I don't believe that the dealer himself was trying to scam anyone, but his creditors had him by the short hairs! And grabbed everything in sight!

This kind of activity has been going on for decades, it’s not new. I had this problem when the sales tax on the vehicle was not paid to the state, so I couldn’t get new license plates when they expired. I was told by the state that I was responsible for the sales tax whether or not it was paid to the dealer who was their licensed agent to collect tax. I thought about it for a while and then I told the state, “Tomorrow I am going to have checks printed to the department of revenue for the state and if I am in fact responsible for sales tax, when I make a one dollar purchase I will make a check for six cents in case the merchant doesn’t pay the state” . And I also notified them I was going to contact the news organizations in my area and they asked me to please not do either of those things until they had a chance to resolve the issues. About a month later the renewal for my license plates came and I didn’t owe the tax any longer. The $25,000 tax bill that the dealership owed was settled for $6000 and they went out of business. This was decades ago so this is not a new deal.

where is the state in this. aren't dealers licensed in this state. plates mean nothing. i want the title, which in michigan comes from the state. they should be arrested for fraud. sounds like the state is lax to let it go on so long.

Titles do come from the state. Only after the flooring company is paid for the loan will they release the title, which has to be reissued in the new owners name. You would be surprised at how long that takes.

@bradbradshaw-i4n The title belongs to the owner. If the car dealership has used flooring to purchase the car then the dealership does not have a clear title. The customer pays the dealership. The dealership pays the flooring company. The flooring company gives the title to the dealer. The dealer submits all the paperwork with the title to the state. The state issues a new title. That title goes to the new owner which is either a bank or the new purchaser.

@@karrielangston4005 i have bought many new cars. the title comes from the state to me in 2 to 3 weeks. when i buy a car from a individual i go with them to the secretary of state and transfer title.. again i get the title in 2 to 3 weeks. i have bought cars in michigan and florida. never had a problem. this dealer is the problem and should have their license revoked, and then investigated for fraud.

In our state, you must have a title or a lien title, insurance, proof of taxes paid,inspection, & prove that you are a resident of the state before you can get plates or a temp tag. You don't have it, you go to jail on the spot & car is impounded.

Not so rare. I had a dealership (literally a stealership) try to pull the same thing with me in Massachusetts. Fortunately, with a little detective work I managed to find the floor plan company and gave them a heads up about how we were both being scammed. The dealer called me and boy was he angry. But I managed to get the title 2 days later.

Car dealers in CA (as well as most other states) are required to post a surety bond to protect the public against such unlawful activity. Unfortunately the bond amount required is pretty out dated, as far as I know it's only $50k. With the sales prices of cars these days that bond amount needs to be increased.

This is why I like private sellers. They have the title in hand. I can hold it, check the watermarks, check it against all three VIN locations on the vehicle, watch them sign it over, and be done with it.

Now it’s a buffet of laws, you go through the line and pick and choose which ones you want to follow. On the other hand, law enforcement picks and chooses who they want to prosecute and to what degree. As always, money does most of the talking. Sad but true

Selling cars out of trust . Dealers start using money from other sales to pay off other vehicles . And it snowballs . The floorplan company should be doing audit monthly on all dealer lots REQUIRED .

Not new, going back there was colonial, and duffy's, and there was legislation to correct that, but you still hear about them. Its crazy industry. 25 years back I bought a used car from lhm for 400$, but then they told me the title cost another 300$. Bad form, that, but still a nice cheap 50 mpg car.
