Getting Bounced Into Court

The plaintiff says she gave the defendant a deposit on a bouncy castle for a party, but her car broke down and she had to cancel because she couldn’t afford both. She’s suing to get her deposit back. The defendant says he lost out on another party because of the cancellation. He offered a partial credit for a future party, but the plaintiff refused. He’s countersuing for the balance owed.

When I heard in the first few minutes the plaintiff was also suing for $500 for pain and suffering over a bouncy house - thought that seemed unreasonable and would lose. Then JM caught her in a lie too. I believe the defendant. Good ruling.

Very fair ruling. People should not be allowed to recover a deposit if they are responsible for non-performance of a contract. He is a business man. Her financial woes are NOT his problem.

Most contracts will state that the deposit is non-refundable, for it was change temporally during the worst of the covid but has been changed back in recent months.

How much did she have to pay on the car? I belive If someone had to pay around $700-$800 on car damage, it's likely that they knew that the car was messed up for some time. Therefore, purchasing a $800 bounce house wasn't a smart move from the beginning. I know how she feels as far as trying to make your kid happy for their birthday and the pressures we parents feel and the sacrifices we make for that to happen. But sometimes, you have to take an L and not make expensive purchases like that when you have other expenses to tend to.

How is it that nobody understands what the word DEPOSIT means? I'm less than two minutes in and if that's what the plaintiff considers "pain and suffering," she needs to get real problems. If you can't afford some money to get your car fixed, you shouldn't be spending on a bouncy castle for a party. There are loads of free things you can do instead. When someone starts sending me bible passages, I block them as well. Already read it, and not interested in reliving the experience. You know those people are going to be liars.

Except no. The "product" was related to the case. It's no different than when there's a case about video games and the judge asks what a "3DO" is, or a case about cars talking about brands. It was last week or the week before where there was the case about brakepads or rims or something where it was about whether they agreed to use a specific brand or not and the judge asked about the brand as it related to the case. The judge didn't randomly decide to ask about what kind of shirt the plantiff was wearing, she was asking about dolls since it was part of the agreement and the case. This is something that literally happens everyday in cases, being asked to define or explain something. If the judge had never heard of a bounce house, they'd request that be explained to better understand the case. No idea where you're getting the idea about "judge pitching products" by asking for an example of a part of the lawsuit.
