The plaintiff used to babysit for the defendant’s children. She says the defendant owes her money for the day care services, but the defendant won’t pay, so she’s suing. The defendant argues the plaintiff wants her to pay for sessions when she didn’t even send her kids there.

This sounds like the babysitter wanted to take the mothers place…. She did everything but say “Omg how can you treat such a handsome amazing man like that, he needs a real good mom to his kids like me”. Which doesn’t make the mom a good mom. Of course she should respect the person taking care of her kids… But clearly some professional lines were crossed here where she decided she was a better mom and wife than her…

That plaintiff never said anything negative about the husband. So you already know who’s side she’s on. She should mind her own business because she doesn’t know what the heck is going on with that couple.

I agree, mainly because the mother remained very calm and respectful the entire case. Meanwhile, the babysitter ran the full emotion- spectrum, and not one BIT of it was based on fact or law. 🤦🏾‍♀️

The plaintiff is the paid babysitter, NOT the grandmother, she got too involved and got too personal, whether she did or didn't like the mother or father, she was not there to judge, she was there to do a job. And how was quitting her job as the babysitter a good thing for those children, she got just a petty as the parents, well now she won't be seeing those children again...

Maybe it is for the best. The babysitter should not take sides in the parent's divorce. Her job was to only watch the children and provide a safe environment.

When you spend all those hours, years,caring for children. You get emotionally involved. It doesn't matter if she was being paid, child care workers spend more waking hour time with the kids than parents or grandparents do. (Most Grandparents do not see them daily for 8+ hours a day.

That mother is obviously not a Mother. She got one eye closed during the whole trial. She’s a severe alcoholic and needs help. Even has empty beer boxes in her background during the vid sesh. Fucking crazy world.

That mother is manipulative and totally played her. Many parents like her stiff their daycare provider. That's why now it's so expensive and why they WILL NOT ever give anyone a break or give time to pay any fees. At the same time, the provider should've kept if professional. Even if she thought certain things. She should've kept it to herself. Keep in mind, there's a reason the mother had a restraining order. That gives a hint to her character.

How could she stiff her if it was obvious via text that the babysitter quit. Also, as the judge said months had went by that the babysitter never billed and enforced the late fee. You can’t enforce a late fee later in the future when the relationship goes sour.

I have known a few “bad story tellers” like the plaintiff. They would, for one, use lots of pronouns w/o first establishing who is who, in relation to whom. Also, they’d start spewing out specifics w/o first setting up the big picture or vice versa (too much general info w/o the specifics).

I am surprised that the older women is trying to act all "sweet old lady", then pops off in the text like a trucker. IT is very stressful to raise kids with a full time job and putting them in daycare when you would rather be home with them. I'm not surprised by the younger women snapping. But I'm not falling for that old lady trying to act all sweet. I believe she was an old busy body, and not just watching the kids and minding her business.

I can attest to Mother's/Father's putting their babysitter in the middle of their marital fights. It comes up in Family Court all the time.

@@karenneill9109 Years ago one of my daughter in laws owned a daycare. In 5 yrs, she had 1 noticeably troubled child. All the issues came from the parents. Always chatting her up about the other parent. Always dragging the daycare into their business. The worse part of the job.

The people in this comments section (especially most of the men thus far) remind me that being single isn't too bad- if there are men like them that I have as "options". Rather be single than to be belittled, hit on, and everything else under the book. So judgemental for men who's only companion is probably their hand 🙃just saying 😒 Anyways Milian is right. If you haven't been sticking to the contract, and abiding by the rules- then you can't suddenly decide to enforce it when you get mad. It's no longer applicable since the contract was broken. Be stern or move on. End of story. Both of them lack professionalism and basic courtesy however.

I was home for 1year for each of our 4 kids could have stayed for 18 months ,also gave me a break fom the hospital seeing soo much and injury and pain .But i also miss my patients and coworkers a year was ok for me

I was on the Plaintiff's side up until the text messages came to light- if anyone who works for me spoke to me via text the way the Plaintiff did (and I'm not saying the Defendant is innocent, either, but she's the "employer') I would fire her immediately. If she speaks that way to me- how does she speak to the kids?

Sounds like the plaintiff might have gotten paid by the ex husband to do this for some kind of proof in family court by what she had said in the wrap up. She wasn't interested in the money, she wanted it known that the woman is a "bad mother".

@@chelseamonet5432 Not all of the time, sometimes Cps will remove children for much of nothing. There are thousands of horror stories about children being removed from the biological for minor reason or miscommunication and going through hell, they are meant to help and protect children but they are not always for the better. I think the Plaintiff is to invested in these peoples personal life and is painting the defendant as a terrible mother while singing praise to the father.

I would never sign a contract that penalizes like that if I had kids and worked. that's a recipe for disaster. nothing goes to plan with time if you have kids

Good luck finding any reputable daycare without those terms. If you want flexibility then you need to work with private babysitters or nannies who agree to some degree of flexibility with hours.

It's too bad that you cannot predict beforehand what life will be like if you have kids with a particular person. This is why everyone should do their due diligence to find out if this is the right person before deciding to get involved with someone. This defendant is in this circumstance because she picked the wrong man to get with.

The plaintiff lost the case when she mispronounced Judge Milian's last name twice, I don't understand why so many people come on here and do that,( pronouncing her last name is just not that difficult) even though she told her it was no big deal, to mispronounce someone's name represents disrespect, and you most certainly don't do it if that person happens to be the Judge 💯

I would NEVER disrespect my daycare provider. At the end of the day, there’s a contract so abide by it. You don’t need to rant about your life or get them involved in YOUR problems. Keep it professional & you won’t have these problems 🤷🏼‍♀️

Right, I’m going through charge disputes atm with my daycare provider but that’s via email. Nothing is discussed in person, especially around the kids & at the end of the day my child’s safety is the priority and you need to respect them.

During the testimony when the plaintiff repeatedly forgave the late fees I thought of the principles of gratuitous promise and equitable estoppel, and JM mentioned the principle of waiver. Is this the US version of those principles? (Not a lawyer or law student, I’ve just read a bit about Canadian contract law)

Completely different concepts: Gratuitous promise: a promise to give something in the future without requiring any consideration in exchange. Generally, if it created a reliance, it is enforceable as a quasi-contract. Not relevant here because there is an actual contract and an exchange of consideration ($) for a service. Equitable Estoppel: A remedy the law provides where there is no written remedy available. It is designed to make one whole, and is not always financial. It is also a quasi-contract concept and not relevant here because the actual remedy is written right into the existing contract. Waiver: A remedy or defined consideration is written into a contract but, with apparent consent of both parties (or at least with the consent of the party who benefits from the clause) that portion of the contract routinely is not enforced. Relevant here because there is an actual contract with an actual penalty clause, but the babysitter (the one who gets the benefit of the clause) routinely "waived" (ie: didn't require payment of) the penalty. Hope that helps. Btw: if you are really interested in learning these types of terms, I highly recommend a copy of Black's law dictionary. I've been practicing law almost 20 years and don't think I've actively used it for the last 10, but it is one of the few books that has never been out of easy reach since law school. Perhaps earlier. Every term the Judge uses on this show is easily found in those precious pages :).

The sitter obviously does not watch the peoples court otherwise she would be able to pronounce the judges name. The judge even corrected her during the case, and yet in the after case commentary she mispronounced it again
