Keys are not handed over until it is recorded. Both sides have to sign agreed. Granddaughter seems emotionally tied to the house. No keeps at signing unless it is recorded.

I think this goes over looked a lot. And you’re the first to mention it. It’s not a one sided transaction, just like I could take a while to read over everything- so could she. I believe between her selling her home, dealing her family, and her grandfather health she might have been overwhelmed. I just hate it impacted me in a negative way. It was recorded the following Monday.

At signed usually the buyer signs loan docs. At signing seller is usually signing over the deed. All h th r large read documents were long before final signing day. Nothing to take home to read at signing. During the 60 day escrow all the disclosures. Home inspection appraiser and escrow documents are given long before closing. Anyway sellers not moving before at closing is not that uncommon. Suggestion: next time if a seller is. It out before closing , have escrow leave in escrow 20k of the seller proceeds and they get it release when u notify them the seller has moved out.

So i bought a house the seller wanted quick close . My offer was above asking price, all cash , as is where is and 30 day closing. The owner accepted. Everything went fine until we were at the closing table. She was willing to sell the house but wanted to stay until her other place (out of state) was ready. Well that shut the whole process down. In my state you can do that for a maximum of 5 days and have to pay an exorbitant daily rate and put money in account ( like a security deposit) the agreement was 10k. Once all the additional paperwork was drawn up we preceed with the closing. On our move in day guess what????...... Yep she was still there. We didn't know what to do at that point. The neighbor came over and seeing the situation tried to help us. Eventually a family friend showed up with a u haul and moved the rest of her stuff out. She was yelling and crying we stole her house...cops came . It truly was a spectacular event to behold. Even her realtor came.

Did you all not do a walk-thru the morning before the closing? There is no way the funds should have been transferred without them being there to hand over the keys. That’s definitely on the agent. In this age of squatters, while you’re at the closing leave someone outside the house to lookout and then always rekey your new home.

We did a walkthrough with our realtor before closing. Changing the locks was the first thing we did. The attorney's /title office had the keys. We were waiting for her to sign. I sold my last home at the height of the pandemic and had a mobile notary public come to my house as there was no way I was driving back 14 hours for the rescheduled closing. I think we did the walk through that Thursday evening to make sure the few things from the inspection was fixed; That Friday morning was the closing date and the escrow/attorneys office had possession of the keys. Yes there are fees the lender charges on home loans as the process progresses, There's only so much they can roll into the loan, we paid for every thing as it went along, we have a list of what we paid for, also ALOT of sellers don't like fooling with FHA Loans. We moved in with zero Ernest money, zero down payment using a USDA Loan AND seller paid closing costs, We got cash back at closing and from a post closing audit, been here ever since and we found this house in late Feb of 21, closed on the house in April of 21.

Always, always, hire your own inspector as the real estate agent and inspector are usually in cahoots. That was a direct conflict of interest. You have to look out for your own interest. Hire the person you can trust. Always ask for all of the closing documents before your arrive for the closing. It's your right to have ample time to review the documents prior to the day of closing or I'm not going to closing. You need that time to have your attorney to review them on your behalf.

We closed in morning at 9am and moved in right after. We had two 26 foot uhaul trucks and toter for my car waiting in hotel parking lot. Never thought of owner not moved out before selling house. Thanks for info again - we’re getting ready to move across states again to new job location. Selling our first house. WE were told before selling… have house inspection, document it, & fix everything identified. Anything questionable - fix it. Put seller insurance on appliances and such for following year. This kind of happened with my first house close to close. The seller decided that she no longer wanted to sell, but I made it very clear if that that's what she wanted to do i would sue for damages and she closed. There's a lot of legal ramifications for any seller that tries to back out of a contract once you're in escrow up to forcing them to sell you the house. Unless it's excluded in the sellers agreement anything that still in the house is part of the deal. Normally any good agents gonna advise their client against trying to back out of the contract because it could be quite costly for them.

We almost bought a house from a couple getting divorced. She claimed they couldn’t take less than a certain dollar amount. The house was two years since they bought and we could see what it sold for. They had done almost nothing to it (we could see the previous pictures ) so not much rationale for a lot of gains. It was not a new build. I prayed and said okay, we will give you full asking price even though comps show you are too high if you throw in ten fake plants. They had a bunch of silk plants decorating a high shelf - like 40 of them. They countered that we had to buy the fake plants. That told me they were being greedy and lying about having to get that price to be able to sell. Our agent called and said we will walk. We bought another house that day. The next day the husband called back and changed his mind. Our realtor was worried the wife would refuse to move out. It took two more years for that house to sell and it sold for less than our offer. Our realtor was right. The wife didn’t want to move. The house finally sold when a court order was issued to force her to sell it. It was two blocks from where we bought so we watched the process play out

@firewater365 that's correct. The owner of the house was under conservatorship, so each time it had to be approved through the court. The first buyer never made it pass the inspection stage because of that. The first buyer walked away because he needed to close in 30 days, not because he got to closing day and they refused to give possession.

I bought my home and I never met the seller, which was a good thing cause it avoided any discrimination. What a nightmare. I've had a couple crazy closings. First house I bought was a divorce sale. Both parties showed up with a lawyer and started arguing about who was paying what (mind you, the were small fees totaling less then $300-400). Could hear them fighting two floors up. My last house I sold was a nightmare. Not only was it constantly being delayed but on the day of the closing my lawyer was late, the buyers insurance cancelled his policy (house has a 100yr old slate roof that passed inspection, but they didn't care) so he had to scramble to get insurance. Then they cut the checks wrong and had to redo them...what a PITA. I had to run from that closing to the one for my new home...that went so smooth were were in and hour in less then 30 mins. Glad it all worked out for you.

We had sellers do that to us. We were at the settlement table and they hadn't even started moving out. The moving truck with our belongings was at the curb and they were having their coffee. They had asked the day before if they could delay the move for a week. We told them no, that all the arrangements had already been made. Their agent suggested we rent them the house daily until they could move. My agent said absolutely no. We had a dry settlement, meaning we completed the paperwork but no money would change hands until they were out. A truck showed up hours after the scheduled settlement. What do people think a settlement is?? People are crazy and they will cost you time and money to have things their way.

When we have bought & sold, the buyers do a walk thru the same day prior to closing. At closing, the seller signs first and hands over keys then the buyer signs & receives the keys. Our last buying experience we drove by the evening before closing & the sellers were there and the garage door was up & we could see they were not packed to move. I called them & they said they thought they could live there until they closed on their house in 3 weeks…..that would be a NEGATIVE!!! The next morning I called the lawyer to say sellers had not moved out. He said closing was cancelled & never ever sign & transfer money because the sellers could stay there as squatters & would require court proceedings to get them out which could take months. Sellers we’re pissed. They wanted our money for their down payment on new home. Not sure where they went but they moved out that week.

When we got to shed that we had never seen because she claimed she had lost the key during the initial showing and the inspection, she also said she was worried about expensive tools during showings, so it had been locked . So, I as the buyer demanded her agent open the shed inmediately. HOLY Crap!!! Rats!! there were huge rats, almost cat sized rats in there and it smelled like hell poop everywhere and a broken freezer . I lost my shite, my agent almost fainted 😂😂😂 so told my agent that unless seller got a biohazard crew and cleaned that mess up we were walking away from the sale. We threatened lawsuit as we had trusted that everything was fine in the big shed and it was only a broken /lost key issue. She did clean it spotless but took her sweet time vacating property.... We only got access next day. That shed is about to become my guest house /art studio so I can host family. But I will never forget that horrible gigantic Rat. First, congrats on your new home! May it bring you many wonderful days and memories! As both a first time homebuyer and first time home seller I have shady closing stories! On the buyer side, the house was being sold by the original owner who was in a nursing home. His oldest son who was his legal guardian sold the house without telling his sibling (brother), who was promised the home by the father when he died. The sibling showed up at closing and tried to stop the sale of the house. Eventually, things worked out and I got the house, but there was a delay of several months! On the seller side, at closing the buyer of my house didn't have enough money to cover their closing costs which meant that both agents (mine and the buyer's) would have to wait to get paid. My agent was pissed and caused a scene at the closing table! Luckily, they did have enough money to wire the funds into my bank account. I've learned when it comes to what is often the biggest financial purchase of most people's lives, you need two important things money can't buy, patience and a sense of humor!

OHmyFreakinGosh! The nursing home part is similar to mine. That isn't A guarantee of no problems. Our friends once bought a brand new house from a builder and at the walk through before closing it was full of unfinished work. Their realtor wanted to hold back some money until the contractor finished but proceed wth the closing. Their attorney advised against it, saying the builder might not show up to finish the work and just let them keep the money. They would need to then hire someone else to finish the work. They wisely listened to their attorney and the builder finished the work with his entire crew the next day, as he needed the money from the sale.

I am looking for a fixer-upper. I ASK THE SAME THING!!! I lived in an apartment that had the devil's brother in it! It was horrible and terrifying!! I was tormented for much of the year that I was there. Years later, I moved to a rental house, where a man and a woman appeared frequently to my 8 year old son. He constantly told me about the appearances. One morning, I was awakened with them standing over me smiling. Kind spirits who dressed in black and white. She had on a long black, long sleeved dress with a white bonnet and long white apron. He had on a black suit and top hat with a white shirt and a black shoestring-like tie. She was holding a large wooden bowl and a wooden spoon. I immediately called my landlord, who had purchased a new house and rented that one out. She confirmed that her young son had experienced the same thing and had described them the same way. I did not move immediately because the spirits were kind, and they never appeared again. As a child, my parents moved to a haunted house that was a nightmare!!! That evil spirit kept slamming the doors in the house and would try to set the house on fire when something was cooking! The fire department finally condemned the house and had it torn down because of the horror stories and attempts at burning the house down. Those incidents occurred when I lived in Arkansas. I don't know how this video popped up in my feed, but thank you @oh_sheena2312 for sharing your experience. I have learned so much from you and the various people posting. We sold and bought a home a year ago. We didn't have to attend the closing for our house sale as we signed all the papers at our attorney's office days beforehand. The seller of our new house did the same, so we just went to our Attorney's office at that closing. We had to wait an hour afterwards for the seller to finish moving out. They were doing it themselves with a rental truck and their teenage son as they were only moving 8 blocks away and it took longer than they anticipated. We waited patiently at a coffee shop so we weren't breathing down their necks pressuring them. Our moving company with our furniture wasn't coming till the next day. We just wanted to clean the insides of the kitchen cabinets and fridge, vacuum the floors and shampoo the carpets before our furnitue came. We immediately called a locksmith to change all the locks. There was some debris in the basement and garage that our realtor contacted the seller to remove and they did so the next day. This was the third house we bought in our lifetime and was by far the easiest one over the entire process. Our previous experiences had some unexpected nightmares, so we appreciate what you went through. Enjoy your new home.

You must do a video inventory of the entire property -- inside and out -- after your offer is accepted and just before you take the keys! That way you document condition and what fixtures are present or expected to remain.

3 things I've always done when buying a house... before closing, get a pin and stake survey of the property. Have a locksmith there upon closing to change and Replace ALL locks and closures on the house as well as any out buildings. Double check the title, any easements/ formal and informal, use of the property by non owners, utilities, neighbors by foot or vehicle.

I had a bad experience as well, similar to yours. I closed and expected to meet and get the keys. Hours later after closing I found out the seller's realtor left the key in a window didn't want to put the key in my hand. 😑Im sorry you went through this. Its sad we are in 2024 and experiencing this.

My dad and step mom were selling their house. They moved out and the day before closing the buyer said they wanted to rent until the loan went through. They had four large dogs. My dad and step mom said no. Turns out they never had any intention of buying. They wanted to rent it. My dad and step mom refused to release escrow earnest money. They took my parents to small claims court. They showed all the receipts and counter sued for the excess cost. They had to move into a rental and move back. They won and the buyer ended up having to pay thousands in damages. Their realtor tried to talk them into giving up the earnest money. Nope.

I’m glad it worked out for you in the end, and sorry they put you through it. Minimally, the selling agent was incompetent. That said, as a buyer, always have your own attorney to go over the final paperwork and attend your real estate closing in the event something comes up (as it did here). I’m guessing yours would have read the selling agent the riot act for failing to bring a signing power of attorney to the closing. If the bank brings an attorney, understand he/she does NOT represent you, only the bank. Relative to the cost of the purchase price, the attorney fee would have been pennies. Prior to closing, the seller had a responsibility to remove absolutely everything they were taking (including the trailer) and was described as an exclusion in the contract, broomed clean, and allowed you do an independent walk-through to ensure nothing’s changed or broken since your professional inspection. Allowing the seller or his family any access after the closing was very risky.

This is why you write into the real estate contract a large amount per day for the rental if the seller doesn’t vacate on time. $500 - 1000 per day usually works. If they don’t vacate typically you are going to have to go through the eviction process and they will owe the rent.
@oh_sheena2312

@@oh_sheena2312 lesson for the next time.. Frankly, it’s also a lesson on how even the realtor representing you is really just representing the “sale” otherwise they would have “coached” you regarding a clause about rental fee if the property wasn’t vacated timely. In many states that is part of the uniform real estate contract. The last time we bought a house OUR realtor said “what about the children” regarding the SELLERS kids when we were working out closing/vacancy I’m like “what about me being in a month to month rental for two times what this mortgage payment is going to be”? (The sellers wanted a fast close but delayed vacancy). It became painfully obvious to me that someone I’d spent time with didn’t have my best interest in mind in the transaction.

Your home buying story isn't the same as my home buying story. If it's any comfort. You are not alone. When I moved into the home that I live in now I was depressed. I was overwhelmed and had buyer's regret. A few months into living in the house, I was planning my leave. It was not a happy experience for me. I have been living in the home for a few months now. I feel better. I thank God for the blessing of nice shelter. It 's been an experience. I pray that if I choose buying again, Honestly I may rent sonething. I sincerely pray the next experience is a whole lot better. It's my prayer.
