Pensioner Couple’s Bid to Sue UK Government Over Winter Fuel Payment

Two pensioners are seeking to take the Scottish and UK governments to court over the cut to the winter fuel payment. Peter and Florence Fanning have raised proceedings against the Scottish government and the UK work and pensions secretary over the policy. The couple will lose out on the winter fuel payment this year and say they are worried about the implications on their health.

Lots of pensioners and disabled people have lots of health problems. If the government does not reinstate cold weather payment pensioners and disabled will have to choose between heat or eat. If the government were to simply appy the fuel allowance based on a level of tax you pay. It would prevent higher income pensioners from receiving the fuel allowance. Come on, this is not rocket science.

Not that simple as pensioners that retired after April 2016 can flexible access their benefits. Meaning they can change the income they take from their private or work pension to be under the higher tax threshold and thus qualify for winter fuel allowance, which does take into account cash savings or how much their pension or other assets are worth. You could end up in a situation where a millionaire could be taking an income of below £12,570 from their pension and end up paying no tax and claiming WFA

My young neighbour next door admittedly she works in a shop for a few hrs aday, 5 days a week, she has her heating on most nights, puts the washing on 2-3 times aweek uses a tumble dryer, and she says she pays about £35 a month on electricity and about the same on gas, she’s with octopus and has told me to switch to them as their pricing is good.
