Once upon a time there were many, many people who thought drink driving was OK, or that speeding was OK, or that not wearing a seat belt was OK. Over the years, fewer and fewer people thought like that. Eventually the same thing will happen with mobile phones, and Mikey is doing a great job in helping society to move to that point. In years to come when people look at this segment, they will find it strange that it was even being debated, and particularly strange that this slimy lawyer was used to present another point of view. His argument was completely specious. What evidence does he have that prosecution is having no effect on mobile use, or that it is increasing friction between drivers and cyclists? Never mind the whataboutery of cyclists who break the law. Mikey can't do anything about them because they don't have licence plates, duh. The law is the law, drawn up by a democratic parliament. Mikey is not a vigilante, the word used both by the lawyer and the presenter. He just passes the footage to the police and it is the police who prosecute. A vigilante is a person who takes justice into their own hands.

I don't think any sane person would disagree with the principle. The trouble is he doesn't just film quietly and submit the footage. He actively stops vehicles and confronts drivers. He tries to 'educate' them. That's not the job of a random member of the public. Who is he to offer advice, guidance or direct other road users? He has no qualifications or credentials to do so. Yes...he's often 'morally' right. But that still doesn't wash. Ask yourself this. If he were to get injured whilst filming a confrontation, and tried to sue, what would the defending lawyers say? I suspect they would argue he had no right to 'detain' people without authority. I suspect they would also say that by filming in and amongst live traffic, whilst providing a running commentary, he himself wasn't paying due attention to the road. His ethos is fair enough, but he goes about it in the manner of an insufferable arse.

However can I cycle around London with a camera strapped to my head, checking whether drivers are distracting themselves while in a stationary queue of traffic. Absolutely I can! The rules of the road don't apply. After all how can a cyclist possibly be distracted by anything.
@dr_ned_flanders Жыл бұрын
@@TheLowerIntestine I guess it depends how much it distracts you from your driving. If you were reading a newspaper or a book while driving then I expect that you are not paying attention to the road and so you could be done for that quite reasonably. You as the driver are in control of a machine that weighes around 1.5 tonnes and any incident could cause a lot of harm. A distracted cyclist is not going to cause nearly as much damage to a person as a car and it is a bit hard to be distracted in the same way on a bicycle since it necessitates you to balance and concentrate on the dangers of the road so your argument seems to be invalid.

Commenting as a cyclist and a driver. It's not news when a driver mows down and kills other drivers or pedestrians, but it is if a cyclist ever kills someone, because it so rare, it may happen only every 20 years or so. (eg. the guy riding a track bike with only one brake, that hit and tragically killed a pedestrian). Car drivers don't like to stop or be slowed down by anyone apart from other car drivers, and in my area they will still drive at you, even if you are on a zebra crossing. Driving one tonne plus vehicles carries certain responsibilities. Paying vehicle excise duty does not confer extra rights to drivers over other road users.

I am not convinced by this residual "impairment" after someone had used their phone, especially in more or less stationary traffic, it's preposterous. I have to disagree with Nick saying that using the phone while stationary isn't dangerous. How many times have you seen a driver not realise the car in front had moved off, leaves a long gap and suddenly rushes off. Not checking mirrors, no awareness of pedestrians, filtering motorcycles. How is not being aware of your surroundings not dangerous? There cannot be a defence. Leave the damn phone alone ffs!

I’m curious to hear what Mikey has to say about this. Using a phone yes, causes a cognitive distraction. But I’d be curious to know why he then chooses to engage with said phone user, likely causing a further cognitive distraction for both the driver and himself, and likely further increasing the short term risk?

The facts of the matter is, Mikey is targeting the very easiest and lowest end of lawbreakers. If you were really trying to decrease deaths on our roads, wouldn’t you campaign towards prevention? I’ve also noticed that Mikey will upload entire videos of people’s reactions, embarrassing them publicly when enough evidence was already obtained to gain a conviction. As a lifelong cyclist I used to admire his campaign. But then I saw footage of him walking and cycling whilst filming in amongst traffic. I sent him a message, asking whether the very act of filming meant he didn't have 100% of attention on the road himself. I believe he uses a helmet cam, which by it's nature means he is looking into vehicles from an offside position, when really he could be watching for oncoming vehicles, dangerous overtakes, or listening for the screech of brakes as something ploughs into stationary vehicles. All of these can happen whilst your lane is stopped and deemed 'safe'. Using a phone whilst driving is dangerous...but how much more dangerous than using a camera to take close up footage on a 'live' road? Surely it must be up there with using headphones in traffic? Yes...the risk might be minimal...but it is a greater risk than NOT using a device in traffic. The arrogance of his response was staggering. He would not accept that what he was doing could have any inherent risk attached. He refused to accept that there was possibly increased risk filming from within traffic than from the pavement. He came across as very holier than thou, and that what he was doing was perfectly safe. That's clearly nonsense;. Anyone on the road is at more inherent risk than on the pavement... otherwise we wouldn't have pavements! Other European countries prove this...keep vulnerable road users at a distance from cars, and they are safer. We are not that lucky in the UK, but until we get better infrastructure, surely we should be advocating ALL road users to give 100% attention to the road? Not sneaking up on the offside blind spot to take some footage. That's asking for trouble, even if it's morally admirable. It just felt like he was incapable of accepting critique. That's the same dangerous blind spot that makes people believe they are a 'good driver', rather than seeking ways to improve their skills. The final straw was when he started adding the 'Jaws' music on some of his clips. It was this that convinced me that he's not just interested in safety. There was absolutely no safety justification for this, leading me to believe he wanted to add entertainment value, because he has an agenda for KZbin subscriptions too. At some point he's going to meet a nutjob and get run over. Yes, it will absolutely prove his point about cycle safety...but martydom is a difficult victory to enjoy.

Only just discovered his channel, although he's technically in the right, one thing I've noticed from his newer videos, he now seems to take an arrogant, even perverse pleasure for catching people out.
