As a law student, I also find this problematic. How would one define Consent? The presented case gave the definition a broad term that leads to ambiguity. Similarly, broad definitions of consent can lead to ambiguity and potential misuse. The challenge is to create a definition that is both comprehensive and precise enough to protect all parties involved. Equality Before the Law (Section 9): Section 9 of the South African Constitution guarantees equality before the law and prohibits discrimination. This principle should indeed be considered in cases involving consent to ensure that both the rights of the victim and the accused are protected. The court must balance the need to protect victims of sexual violence with the rights of the accused to a fair trial. Tacit Consent and Alcohol: Situations involving alcohol can complicate the issue of consent. The law generally requires that consent must be given freely and with full capacity. When alcohol is involved, it can impair a person’s ability to give valid consent. Balancing Interests: The technique of severance can be useful in narrowing down broad terms to avoid endless litigation and ensure clarity. In the context of consent, this might involve specifying what constitutes valid consent and under what circumstances it can be considered invalid (e.g., due to intoxication, coercion, or incapacity). Public Interest and Legal Protections: The court’s role is to balance public interest with individual rights. While it is crucial to protect victims of sexual violence, it is equally important to ensure that the law is not misused for spiteful agendas. This requires careful consideration of evidence and circumstances in each case. Basically, in relation to freedom of expression, the law clearly stated that the term Hurtful is broad in term and for hate speech to be amounted it should have a narrower definition in order to avoid endless court proceedings. Therefore, the technique of severance was applied to Harmful for a narrower sense. This resulted protection for both freedom of expression and hate speech creating a balance of interests. The point that I am trying to make is that protection should not come at the cost of innocent people. What about section 9? Equality before the law when it comes to such matters. The court in the presented case should have also considered both sides when it comes public interests, yes, rape is real, and it is occurring at an alarming rate however it should also consider that some women use the law for spiteful agendas. Imagine tacit consent in a situation that involves alcohol.

Granted in these situations the abuses were normally not sexual in nature. Unfortunately sexual abuse is often less public so one has less opportunity to know about it and act.
