I mean even if he hadn't, the fact he mentioned the gesture to backup, and she admitted to it when he mentioned it, and then he chose to arrest over a traffic violation that frankly is common af says a lot. Texas and my state (GA) have similar laws regarding traffic infractions/violations. I've been caught speeding, that is considered a criminal offense in GA, only got a citation, and I was super speeding. State law may allow an arrest, no reasonable officer is gonna arrest solely over it though (barring like 20+ over with multiple violations that would become reckless driving). Plus he admitted he was treated her differently because she was who she was.

Yup, happened to my brother n I on the streets. He had a past case and was beefin with the corrupt dept. Alotta aryian brotherhood members were in there. The dept was investigated and a couple were put in jail I think. The rest were all fired. Went back through there a few years back n its all different officers.

I believe they are interpreting the law incorrectly in this video. Traffic violations are considered “infractions“ in Texas, and therefore are not crimes. All of the laws cited in this video specifically used the word “crime”, when referencing the ability for an officer to make an arrest.

The Constitution does too, as highlighted in the video. Texas doesn't say it's prohibited, but for states that do, it's a state issue. A 4th amendment lawsuit could not be brought against police in any state for an arrest over a traffic ticket.

Fine, I can give you that, but considering when a cop meets with a CI, typically it’s an arranged meeting to which there’s zero need for a body cam. Now I’m not attacking you or trying to be rude, but anyone with a brain has to see how cops abuse the system every opportunity they get and turning off the body cam is one of those things they do way too much. A body cam is t to protect a cop, it’s to protect the citizens and their rights. Something’s cops take away from us on a daily basis. This video also clips out the officer's reckless driving while chasing her down too. He did far worse things than "failing to signal" during his pursuit. Swerving into incoming traffic, speeding, illegal right turn from the left lane(while cutting someone off on the right lane too). All for a bogus made-up reason+his feelings getting hurt. Story time: The lecture from the sergent was so icky it reminded me of when i was in a criminal justice program in high school and a male classmate wrote me a threatening note after i rejected him and cut his wrist over the letter and then slid it into my backpack the next day. He got suspended for 3 days and then they kept him in the criminal justice program but moved him to PM classes. Then in the second year of that program (which you have to be accepted into - and he was) my instructor, who was an ex cop that i really looked up to, asked me if it would be ok for male classmate to come back into AM session and since most of the time we're at our internship youd only see him a couple days a week. So I was wondering if the cop was claiming that she failed to signal BEFORE driving past him where the body cam doesn't show one way or another, but on his ticket, he writes, "She flicked me off THEN failed to change," which is clearly AFTER passing him, and the body cam DOES show she signaled. Easy win. It is objectively false. She definitely needs to fight and sue.

Watch the body cam from the beginning. When the cop is walking to the back of his car, she is moving from the right lane to the left lane and no signal is observed (although it would be hard to see). In the body cam the cop says she failed to signal left when she moved over to the left lane. After she passes the squad cars, she clearly signals when she moves back into the right lane, but by then the infraction for the stop had already been committed. Admittedly, arresting her for failure to signal a lane change is a pretty low thing to do and most likely in retaliation for getting the middle finger.

@keylimepie904 nope. For 1, we don't witness her do the lane change from right to left as she approaches the cops. She's already in the left lane at that point. For 2, in his WRITTEN report, he states word for word that the supposed traffic violation occurred AFTER he saw her flip him off. I don't care what he says off-hand on camera. The only thing that matters is the official report. The fact that he got it wrong in his written, even if (and that's a big if, because there's literally zero evidence) she had failed to signal beforehand shows his mindset: "I'm going to say anything that needs to be said to justify arresting her for hurting my feelings."

I live in Texas. It is RARE for someone to get arrested for something like this. He was clearly retaliating against her. I don't know what he did to her in the past, but you can hear her panic and fear when he tells her HE is taking her into custody. This guy needs to be fired. He is SCARY! Also, in Texas, flipping off cops is perfectly legal.

She did signal, although briefly, when pulling into the right lane--but he was already chasing her by then 3. She did signal the right turn and her turn signal was still on during the altercation.

I was arrested in San Antonio TX. when i was homeless for spitting on the sidewalk and telling a cop to f**k off and spent 6 months in jail before i even made it to court. Got time served on a 3k $ fine.
