Me: Your honor, do I have to watch this? Like, really? There's a murder trial going on next door and I would really love to get in on that. (Oddly enough, in a few months my city will begin vetting jurors for a really high profile murder case in a few months. Everyone is praying not to get it because even though it is really nationally high profile, the jurors would have to be sequestered and it could take weeks.)

@@adam_stanheight it just felt realistic. but after watching the same pissing baby commertial 10 times I changed my mind, and I just wanted a baby that could eat. instead i got a bottle that, when it was turned upside down, appeared to lose the liquid inside of it, so it looked liek teh baby was drinking it, but when you turn the bottle right side up again, the liquid reappears. it was crazy and i liked it far more than i would have liked a shitting baby, especially after my sister was born. I had had enough of that lmao

I guess for me, being a adult, that decision would be a lot easier but i suppose for a little kid, a month ltierally seems like forever and Netflix is pretty much the new television medium. So of course it's a difficult decision for a kid. EDIT: yea I did phrase my first comment wrongly. It was Fingerling, but month without netflix or netflix but no toy

Charlie, the reason Weird Al is so respected is that he DOESN'T need permission to make his songs, but always gets it anyway. He's a cool dude. Shockingly enough parody is completely fair use, with or without permission.

It’s slightly more nuanced than that. In order to make it fair use, he needs to provide some sort of criticism and/or commentary on the original song. This is true for some, but not all of his songs. Taking a popular song and switching the lyrics to be about food doesn’t automatically fall into fair use.

Parody laws are wild. It's why Weird Al can do what he does. Technically he doesn't need permission (although he always gets it) so when someone in Coolio's team gave him perrmission for Amish Paradise and then Coolio got upset about it Weird Al won the lawsuit because he was protected. He just didn't do them when artists told him no because he's a nice dude.

There are limits to it though. The kid that made Buttface merchandise as a parody of North Face lost his case. If this is a commercial toy and the parody could be interpreted as merely existing as a commercial soundtrack, it's not really a parody legally. If this is just on a YT channel to advertise the product and not in some kind of long form content, it's not as easy as we made a parody.

Weird Al even credits people he got permission from even if he doesnt end up making their song into a parody. I remember one FAQ/QnA he had where someone asked why a band was credited in one of his CD booklets yet their song wasn't on the album. He explained that he had gotten the permission, but when it came time to make the song (i think it was one of his polka ones where he mashes up a bunch of songs) he couldnt figure out how to put their song in, so he ended up leaving it out but still wanted to credit them

Weird Al asked for permission voluntarily because he's a King, not because he was afraid of being sued. He just didn't want to hurt any artists' feefees and create bad blood. Almost all artists were happy to let him make his parodies so it was never an issue.

@@ryanarttmo It is parody, using its own lyrics and music, and is not a substitution to the original / does not negatively affect the market for the original. Like I'm sure some lawyers could have a big court case and argue about it, but it would likely reach a small settlement rather than going to trial and being a big win for whoever sued him.

The company was sued by Louis Vuitton for selling Pooey Puittons, poop-shaped purses that looked like knock-off Louis Vuitton bags. The Poopsie dolls were discontinued a couple of years ago. That's why they're so expensive. This video sent me into a research rabbit hole. I now know way too much about a pooping unicorn.

Correction: they preemptively sued Louis Vuitton expecting to be sued in the future by the luxury brand and they wanted to strike first. LV apparently had no plans of suing, since a plastic children's toy was in no way competing for their sales. MGA, creator of the Poopsie line, has a long history of blatant copying... basically everything and everyone.

The Weird Al thing is out of respect *and* an overabundance of caution, and because he's a pretty cool guy. It's been argued that the vast majority of Al's music would be protected fairly decently since a lot of tracks strongly falls into parody and satire. Al considers it the 'right thing' to ask and so always does

Question, where so covers of songs fall in all of this? I know there are KZbinrs like Caleb Hyles and Jonathan Young do covers of various different songs, and just about every band out there has at least one song that is a cover from another band.

​@@howardbaxter2514 Normally a cover would need to be licenced, but a lot of artists and labels realise that youtube covers are generally good promotion so wouldn't pursue anything. But legally they would be in the right to sue cover song makers who did not licence their song.

I just went and listened to it as well as refreshing my memory on my humps. Now, I'm no lawyer, but in a music industry class I took we did spend a lot of time on legal things in regards to music. I think that the fact that Poopsie's song is different enough that it would easily be considered distinct from my humps and the fact that parody is protected will likely result in Poopsie winning the case.

being around the toy community i can tell you right away that basically everyone in the circle completely resents this era and prays it doesn't return now that fashion dolls are saturating shelves again (their absence being what sparked this toy genre in the first place) another note is that mga is notorious for receiving lawsuits for playgarism (often which falls under parody law) which from my knowledge they're able to bypass (girl group T.I. not long ago also tried suing the company for a line of their dolls due to having a similar style and outfit composition that inevitably ended in mistrial due to how broad the accusations were) whether or not its done for publicity and the creation of lawsuits like these, mga is a company that loves creating parodies (using this loosely bcuz its a fashion doll not an artistic commentary on the sociopolitical significance of the fame monster by lady gaga) and callbacks to moments in pop culture in their products so i see this lawsuit as just another example of all of the above.

Actually Wierd Al can make parody's of whatever songs he wants, he just likes to make sure the original artist is ok with him doing so out of politeness. Which is part of why he's so well respected in the music industry for going the extra mile.

@@ryanarttmo It wouldn't. under fair use you don't need permission from the original author and it doesn't need to specifically comment on the original work but rather broadly on anything which very much includes the topics of white privilege, conspiracy theories, and other topics his work has gone over. but that's all specific to parody. If it falls under fair use, which it does, then it's protected even if it doesn't fall under protection from parody laws.

I remember reading about that, it was for his parody of "gangster's paradise." Coolio was upset because the song is dealing with genuinely heavy shit, and having someone write something goofy about it was really insulting. Weird Al apologized (which was eventually accepted) and has always asked permission since then

If I remember correctly, the Coolio incident was that Coolio's management gave the go-ahead without him knowing about it, so Weird Al makes it a point of asking permission from the artists themselves, directly, from that point on.

Weird Al absolutely needs permission for a LOT of his songs because in many cases, he changes the words to something completely unrelated to the original song. Parody, by definition, needs to comment on or critique the original work in some way. And as much as I love Weird Al's work, a vast majority of it would not fall under the legal definition of parody, even if branded as such. Look at the lawsuit for Under Pressure vs Ice Ice Baby...that was over a bass line, not the entire tune!

@@StraviradiusI don't think this stands. Parody is not restricted to commentary or critique. Ice Ice Baby was _not_ a parody of Under Pressure, it claimed to be it's own thing. That's plagiarism, not parody. Parody brings attention to the original work, and intentionally stays true to aspects of the original work. Plagiarism brings attention to itself, and "steals" from the original work.

MGA entertainment, the company behind poopsie slime surprise is NOTORIOUS for getting into lawsuits. There was a huge lawsuit back in the day between them and the company behind barbie. Plus, MGA constantly references designer fashion and parodies celebrities in almost all of their brands so at this point if more than a year goes by without at least one rumor of a lawsuit I'm honestly surprised. Edit: I should have mentioned this, but poopsie slime surprise have actually been discontinued for a while now, they've evolved into humans and are now completely detached from the slime and pooping gimmicks.

I just watched the Poopsie video and, honestly, I think they're gonna win. It's one of those things where it's different enough. The instrumental doesn't sound anything like "My Humps", it has a different rhythm, and the melody of the lyrics is just different enough. Kids entertainment does stuff like this all the time, it reminds me of that Mad cartoon show. They had a bit that was a parody of Maroon 5's "Moves Like Jagger" but it had Star Wars characters, so it became "Moves Like Jabba." The melody, however, was completely different, notes went high instead of low, so if you layered the two on top of each other, you'd be able to hear that they weren't the same song. I think Poopsie walks away from this skid mark free.

Why do you think "moves like jabba" didn't have all the licenses sorted out? The moment you're doing something for commercial gain you better cover your ass. The FIRST factor that is considered whether something is "fair use" is "purpose". The "purpose" of "my poops" is selling a toy (for profit). That will be the main argument of BEP lawyers and it will most likely cost the toy company dearly.

@@cinyarko Because I've seen a lot of stuff where the music has been different enough to avoid lawsuits. Like when "Happy Birthday To You" was still protected under copyright law and the holders were VERY litigious, so shows like Futurama would do that whole "What day is today? It's Nibbler's birthday" thing. It sounds a LOT like the song they couldn't use, but it's different enough to avoid a lawsuit. Also, parody IS fair use. Weird Al didn't HAVE to get permission from the artists he parodied, but he WANTED to. He's polite like that. There's tons of videos out there describing why parody is fair use, like the guys who parodied "Got to Give It Up" by Marvin Gaye after the Gaye estate sued Robin Thicke and won. That's the problem with fair use and copyright laws - there's instances where it works like it should and instances where it doesn't. There's so much precedent and they're not consistent. BEP could win. They could argue that it was a commercial, there is something more nefarious in using an unlicensed parody in commercials, that it wasn't similar ENOUGH to be warranted as a direct parody. They still have angles they could play. It's one thing if a Radio DJ puts out a compilation CD with a parody of "My Humps" on it and another when a corporation does it to market toys to children, because then you get the artists involved who didn't authorize the marketing. I think it's different enough though.

I really, really want for someone to make a full video explaining the actual history of how we got to the point that the sentence, "Black Eyed Peas' 'My Humps' Ripped Off by Pooping Unicorn Toy, Lawsuit Claims" makes sense to the average modern native english speaker. Because from the perspective of much of history: A)Black eyed peas are a legume B)Ripped off means to tear something away quickly C)'poop' means 'the rear deck of a ship' D)And 'unicorn' could refer to a narwhal, rhinoceros, or other things, but nothing that looks like this We live in such a wild time.

Ok so I’m a doll collector, and something really funny to me is that one of the best fashion doll lines out right now is Rainbow high. It’s extremely detailed and the dolls are great but they are technically the child of the poopsie slime surprise. Poopsie ended up branching off into smaller lines all owned by MGA and one of those lines was human dolls that came with poop slime, then they took away the poop and focused on just the dolls and then rainbow high was born.

One of the biggest things I respect about Charlie is that when he is wrong (like about the laws concerning free use) he is very good about not only changing his mind but fully admitting with no minced words that he was wrong and confused.
