She claims the defendants walked back on their promise, so she’s suing for what she’s owed. That's called promissory estoppel and the plaintiff needs to prove that reasonable reliance on that promise was detrimental to her. If the plaintiff went into debt and spent $3000 on replacement earrings because she relied on the defendant's promise, there's a case to be made. If the defendant promised $1M and the plaintiff went into debt on a shopping spree, there would be no case since that kind of promise would hardly be deemed reasonable.

Admittance of agreement on a loan or buying something is different; there's a clearly defined relationship between the parties in those instances. Here it's not so much. At the end of the day, the plaintiff doesn't know who took the earrings. There were two theories and neither was provable by the preponderance of the evidence. If the defendant [or their son] had taken them and pawned them, then the plaintiff would have had proof of the theft. There's just no proof. I think the defendant offered to pay for part of the earrings because the plaintiff had done them a favor, they felt bad, and wanted to preserve the relationship. The sad thing is that the relationship is likely beyond repair.

I couldn't kick them out without 30 days notice so they lived in my home and did nasty things to torture me on a daily basis. From that day forward (back in 2014) - never again! I live by myself. Even though the plaintiff did not have sufficient evidence to prove her claim, I think it's highly probable that the mother of the son took those earrings The missing piece here is that we don't know how many people actually were in her house during the time that the earrings came up missing. The plaintiff mentioned that she had to spend time at her deceased grandmother's funeral so it's very possible that some friends of the defendant or the defendant's son stole the earrings. A 17 year relationship gone down the drain and this is very very sad.

I had a best friend that I discovered stole my walkman set (when they first came out) and a beautiful swimsuit I bought at Disney World. The only reason I found it was by doing laundry when I went to visit her 5 years later and the suit was in her laundry and the walkman, now 5 years out of date for this technology, was sitting in plain view on a coffee table in her living room. I left to go to the store for groceries, came back and both items were no longer to be found, or in plain view. I questioned her if she ever borrowed or took them and just forgot to tell me (incidentally at the time both items went missing were in highschool) She adamantly denied ever taking either item. It broke my heart but eventually I silently forgave her. We live in different cities and still talk from time to time. Through God's grace our friendship has endured; isn't the same but I still love her. I never mentioned it again. BUT, DIAMOND EARRINGS is a completely different item to just come up missing! Prayers for both ladies 🙏❤️

Ok I'm really confused with this case because JM in the past has ruled where people have made promises and she accepts it as a contract then with this case she did not. So why does she rule yes on verbal contracts sometimes and other times no?

I did not like this ruling but I assume it’s because the plaintiff could not prove the worth of the earrings. Which is unfortunate.

hypothetically even if she could prove that the defendance had stolen the earrings, the best she could do is to get back the depreciated value and if she couldn't prove they were $3000 and then the judge would have to do some rough justice but even if she had an 18-year-old receipt for $3000 for those earrings, they wouldn't be worth more than maybe a third of that 18 years later. They would be old and most likely tarnished and not worth what they were when they were purchased. I can't imagine how people spent that kind of money on earrings anyway. I wouldn't even spend $300 on earrings.

Actually, an appraisal of the jewelry would justify its value. With no appraisal, the best the courts can do is go by the scrap value based on the weight of the gold. Just like oil prices, gold prices vary. But by design earrings don't have much weight to them so .... 🤷🏻‍♂️... I'd say $500 max

Wow they should've went to Judge mathis. A promise of a gift is different than a promise of a debt. Also admission of guilt should've been enough to prove them guilty. They proved her case for her. Even Judge saying the need has to be there. They had no where to stay had repos and in need of cash. That's a need. It just seems like she was thrown off at the amount of money wasted on earrings and furniture and just let that lead the outcome of the case.
