I remember couple summers back, after my lengthy divorce, I needed a good boost to help my business stay afloat, hence I researched for license advisors and came across someone of due diligence, helped a lot to grow my reserve notwithstanding inflation, from $275k to approx. $850k so far.

@@ethanbishop5762 usually sellers have some type of underlying motivation that they need to sell. Distressed property, foreclosure, financial hardship, medical ect ect. If there is equity they typically can capture it if structured correctly and depending on condition of property.

​@@ethanbishop5762 Most of the time we talk about people who can't pay their mortgage, there is danger from foreclosure. They will lose the house and may still have to pay the 30-50% loan amount. If they resell the house price will be like 10% less becose all the brokers fee and seller, if a market is little down the may have to pay from there pocket like couple of thousand dollars to close the mortgage. If that moment someone come to them and say I will take the pay6of your mortgage and give cash is big win for them. Buyer can possibly lock a good interest rate like 3 % on that rate almost evry house become a good deal.

An amazing conversation!! I just learned of Pace from a Rich Somers podcast that you, (Grant) were also on not long ago. Both interviews were amazing! This conversation got me extremely excited! Grant is thinking correctly about this situation. Expecting the Lender to do nothing when the asset's title changes hands is skeptical. Not to mention the Seller has 0 assets and ALL the mortgage liability risk if you stop paying.

@Dan Williams You are basically playing the bank by hoping that the bank doesn't enforce the due-on-sale clause (alienation clause). The alienation clause in a mortgage contract gives the bank the right to request the full and immediate repayment of the loan, including principal and interest, when the borrower sells or transfers the ownership of a home (the deed) to a new owner. The clause makes it a requirement to repay the balance before the property’s title (deed) can be transferred to the buyer. This is the case with most mortgage loans, exceptions are assumable mortgage loans. With "Subject to deals" though, which are the kind of deals that Pace does, the seller is not ''released'' from the alienation clause and the clause therefore still applies. Pace has said on multiple occasions though that the clause is rarely triggered. If the bank all of a sudden stopped receiving those mortgage payments though, that would most likely make the bank investigate things further. I am not sure if evading this clause while doing ''subject to deals'' is a loop hole or something that the banks do not care about though. The previous owner (seller) still carries the mortgage liability though and if the deed is transferred to you, and a promissory note is signed, then you will still pay interest but to the seller and not the bank. If anything, you wanna do your deals via a LLC to avoid personal risk.
