Whether the private organisation or NPO can choose not to provide provident fund and gratuity to their employees? it is not binding upon employer right?

Mr. Shahn thank you for sharing insights. Please guide in case of skilled employee he have 60000 salary. while calculating gratuity, will we consider his gross salary which is 60,000/ or basic salary which is 40,000/-?

Bhai mere aik galati kergae ho who ye ke companies financial generally jule to june hota he naa ke jan-dec. Agar aik shaks april me resine kerta he tu is tarah woh 10 mahine pore ker chuka hoga aur puri gross salary ka gaqddar hoga gratuity ke liye. calendar year compnies me applicable nahi hota. mind it.

I worked for Mindbridge Lahore for more than 10 years and I had applied for Gratuity funds but they said that I am not eligible because I was a part of management. Please assist.

Company must provide either PF or gratuity. If you are getting PF then that's fine. If both benefits are not being provided then you should talk to HR or authorities

Sir gratuity formula is last drawn salary*15*no of years/26. I am little bit confused

No need to be confused, it's very simple. Last Pay will be multiplied with the number of years served. If after one year the service is more than 6 months then that will be considered for complete one year.

Har Saal Aik Salary ka Bonus law mein nahi hai.. na hee usko gratuity keh saktey hain. Gratuity at the end of employment milti hy. Aur agar company gratuity ya PF pay Nahi Karti to HR sey ya company owner ya senior management se baat karein.. ye apka legal right Hy.

Gratuity agar company offer kar rahi hai to wo apko pay karney ki paaband hai. Medical ya Kisi bhi aur waja ki bunyad pey company ney agar employee ko "let go" Kia hai, to company pey ba'qaida 1 month notice/pay aur baqi tamam wajbaat adaa karna laazim Hy.

Only if your company had this policy to provide gratuity. Please contact your HR Department and check the company policy.

A gratuity is voluntary for good service and should not be assumed a wage subsidy and demanded.
