Don't let the big boys bully you, Only just found your channel, and I'm loving the out in the field aspects. With regards to teaching us proper noobs how to go through the process of finding a claim and going about registering it etc. Have you ever thought of doing a theoretical one, what I mean is pick a random site (doesn't have to even have anything valuable there) and go through each step in good detail. That way we can see how its done without risking any of your proper sites. Also I'm in the UK, so things may be a little different, but I'm sure there will be similarities. Keep up the good work, you have a new subscriber.

If there is no claim filed with the BLM, they don’t have any claim at all! Filling with the county means nothing until BLM accepts the claim paperwork! Just because someone files a mining claim, it DOES NOT give them exclusive use of the land, especially if they have no plan of operation approved by the government agency involved. Their plan of operation would have to specifically state that they had exclusive use, usually for public safety purposes. They have no legal standing and if they try, you need to bring it to the attention of the land manager. Also they can not do any exploration involving anything more than hand tools with out a plan of operation. Their plan of operation is public information and you can request to see it! I’ve been doing this for many, many years and have had to deal with large mining companies trying to get my claims from me. They never succeeded!

Sorry but this is not correct, I hadn't planned on replying originally but it's upvoted 4 times now so I feel I need to correct this because I do not like incorrect info conveyed. While you must file with the BLM to satisfy the federal requirements, most states explicitly outline in the state statutes that the county filing is the legal filing by all measures. One example, the Nevada state mining statutes clearly describe what I explained above: "NRS 517.190 Notice of location: Filing; evidentiary effect. A locator of a mining claim or a claim for a mill site or tunnel right may file with the county recorder a notice of location which is prima facie evidence in all courts of justice of the first location of that claim." for mining claim disputes it is never the BLM paperwork that is used, it is always your filings with the county. That is why they have an official recorder stamp and are notarized. The BLM is just adminstrative, not official. Further, the BLM allows up to 90 days between filing with the county and filing with the BLM, so for 3 months your claim is entirely valid even if the BLM doesn't even know about it yet. That is because they are only a management agency for public lands, they are not a legal or legislative branch, they can only make "rules" and not laws. They can require you to submit duplicate paperwork for them as a result of the FLPMA, but that paperwork is not by any means what perfects a mining claim, it is the county paperwork. You are however correct that a mining claim does not convey surface rights, I addressed this in a prior comment. I'm not sure why people who see this video keep making that assumption because I've never stated that, in fact I've said the opposite, and I clarified that in the first question regarding that issue that was asked. You can use more than hand tools with a Notice of Intent though, which is less than a Plan of Operations. For mining and exploration disturbing less than 5 acres of land. I've done this before myself in a mining operation on a federal claim I permited, bonded, reclamated, and sold.

I have feathers and wedges, they do not work on nephrite due to it's fibrous nature. It will not split, it just sheds or exfoliates irregular layers when enough pressure is applied from the wedge, and eventually they go all the way in and just get stuck (I have one such piece in my backyard). Nephrite is one of the strongest occurring natural substances due this.

Please help me to understand the reason/s why you can`t prospect your own land .. just because somebody {supposedly} claimed the surrounding land? I would guess that it`s because you can no longer get to your land? And ... did your land get surrounded before or AFTER you sent those pieces to be reviewed? {*maybe somebody lied to you about the quality, and swooped in for a kill}

You did not get skunked! You have made a wonderful find! Don't give in to a psyche out. Use a rock saw clean up the slabs and put it on Ebay as a test. See what happens. And next time you place a claim do as prospectors did in the past; claim Talc or Quartz. Don't give up, just keep educating yourself, and keep to yourself what you find of value. At 11:55 it’s possible it’s been blasted previously like 100 years ago and that could be why the fractures are there now and are mostly diversed out down that hill. I, or anyone else, can still travel across their claims as a federal mining claim only conveys mineral rights and not surface rights. I just can't prospect on them. I still need to go out and look at their posts to determine exactly where they are at as I only recently spoke with them on the phone.

I'm also confused about the 360 claim issue. Are you able to walk to your claim, or drive machinery onto your claim? Or is there some law that prohibits you from driving trucks on top of another claimant? Because as long as you can access your portion of the land, and the rocks you found are actually jade or another high value mineral you should be able to profit nicely from this find

See above answer on surface rights. The issue I raised isn't about lack of access, it's about lack of ability to continue prospecting. If everywhere I go people instantly claim up all around me then my ability to make further mineral discoveries in the area is eliminated and I must stick to my small claim and pretty soon I have nothing left to explore. I can still mine my claim, but I can never expand beyond it when this happens. Some of these discoveries take me years to find so it's not a matter of just moving on, yet it takes only a few minutes for someone to find me and paper stake around me like this. And I'm not rich enough to just paper hang an entire square mile or two like these mining companies are, which gives them the ability to spend as much time as they need to prospect the area even though they haven't really made any valid discoveries by themselves yet (which I will note, is a legal requirement to perfect or make valid a federal mineral claim) and have instead relied on my work and merely staked around me on the guess or assumption that they will find more, while simultaneously preventing me from exploring my discovery further. My discoveries aren't limited to just the small claim boundaries, it's simply all I can afford to stake, and I personally don't believe in staking land that isn't already proven first to contain economic quantities of minerals so I wait until I am able to make a sufficiently economic discovery first. By the same reasoning, I don't recognize mineral claims without a valid discovery to be valid mineral claims either, so interpret that statement as you may...

Its 400 dollars a year for a mining claim. They are spending 16000 a year just to maintain those 60 claims. PLUS annual improvements are required on all claims. My guess is theyll quickly prospect their claims and ditch the ones of little or no value.

Sorry about the constrictor snakes that are hot on your trail!!! They suck!!!! I do like the fact that you are willing to help us understand geology and how to Identify minerals. I have bean looking for Michigan greenstone. Been finding a lot of stuff that looks a lot like it but at a lower quality. I am carving a sculpture from a piece that so far everyone who sees it is stunned at how it sparkles and looks. Will be wet sanding soon😀. But I get a lot of people saying that it’s not greenstone even thou it looks a lot like it it’s not the isle royal green stone but it’s still really cool stuff. Oh on another note that green stuff you had examples of I found a few of those around here but it’s a smoother waxy looking stuff with some tiny red vines in it, I can see veins under the surface but when I put the led flashlight to it no transparency.

Howdy, I'm a beat up old Marine and going to be retiring soon. At 62, I am not one to sit around and as sore as I am, once I get warmed up, I can still work like a draft horse. I plan on starting to hobby prospect. Can you please tell me some decent, good value metal detectors to start with or buy. My budget right now is for a Gold Bug II or Garret AT or maybe an Equinox or s good used detector. If spending a little more is wise, can you let me know and why. Of course, I am looking for a gold prospecting detector.

in the late 50s or early 60s a friends father found a large deposit of that material in wyoming. he set up and sawed out large blocks of it. he loaded a large truck with his haul. took the truck back to new mexico.. turned around to get the rest.. by the time he got back.. somebody had moved in and dynamited the entire deposit and removed it.. hopefully you have found another deposit. not just rubble from the claim jumpers. my friends father is dead as is my friend so there is no way to know more..

USMiner, I have watched and enjoyed all of your videos. Had something similar happen and it is a bit frustrating! However, my Brother found a pretty rich deposit n the Cascades in Oregon. He located a ledge deposit of Au, Cu, and Ag, but made the mistake of talking to one too many people about it. He went to file a claim, looking to map out the extent of the ledge he found, and discovered a 40 foot long, 10 feet wide and 10 feet deep trench where he had made his discovery. He learned the hard way what you are saying, many Miners/Prospectors keep their lip buttoned up when they do make a discovery!

I've found tons of what appears to be nephrite up here in Canada but failed to get a positive ID on what I found because I wasn't willing to give the gemologist the exact location of my find, judging by how pissed he was that I didn't reveal the location indicated to me that it was of a significant value. At least I did get a positive ID on the cat's eye 'jade' before he shut down the conversation. I posted some vids of some samples I'd love to hear your take on it

Wouldn't it be nice to have an XRF handheld spectrometer like the one Cody from codyslab just got. 20 flippin grand for one though. Oh and whoever surrounded your claim seems like douchey stalker. I could see someone wanting a piece of the pie, but 60 claims surrounding you! They're just using you as their prospector ruining it for the rest of us. Hope you find a way to make more videos soon.

Definitely, I've been trying to get an XRF gun for years, I tried talking ThermoScientific into manufacturing a less expensive one for prospectors a while back, but the price point still would have been $12k. I posted a comment on Cody's video about why his assays didn't match the XRF results, there are real limitations using one in the way he's trying to do due to the small sampling window. In the field they should be more of a qualitative tool instead of quantitative, ie, just an indicator of wether certain elements are present or not, and not an actual assay. However, still a very useful tool to own. I will be making more vids, this is only a minor setback since I had already prospected that area fairly thoroughly and in the wider scope doesn't change a lot for me since they are drilling and looking for hidden exposures mainly that I don't have the resources to look for on my own anways.

There are things happening but I can't talk about them unfortunately. Hopefully in a year or so I can show some cool stuff, but for now this jade series is on hold and I'm having to find some other things to concentrate on. I'm going to prospect some different parts of the state for jade this fall, but I'm not expecting to find much worth filming.

Father Inlaw,s cousin found one of the “ rare earth minerals”. Claimed it. And was approached by a large China company that mines that mineral offered to purchase his claim and would pay him xxx dollars for each pound they mined from his site. But in the fine print it did not list a time to start mining. Had they started mining the value would have gone down so they sat on the patented claim so no one could mine it and the guy died penniless.

Yeah, looks like a form of adventurine (green quartz but with some small mica schist flecks) WY stuff looks a little different to me as far as structure, at least on video. Top quality chrysoprase (Australian & Tanzanian) is much more valuable than adventurine.

It depends if your deposit is placer or lode material, in other words float or in-situ. But first you would need to determine if you in fact have jade, if it's unclaimed, and if there is an economic amount of material there to justify the claim. You don't need a claim to simply collect scattered pieces of material if that is what the underlying question is? On federal land you can collect small quantities of rocks for free without a claim or permit.

USMiner thanks, I am 99.99% sure it is jade i also talked to a geologist at my collage, i will take it in there next club meeting but the samples i took all fit the characteristics of jade, and it is not float, it is pretty much in the ground, i i think i will file a lode claim, there is a bit of it, my problem is that it is a bit hard to get, if i had an ATV it would be no problem, but i dont have one, and i dont think a pickup could make its way to the site unless there is a secondary road i dont know about

You should try micro blasting. It wouldn't be difficult to test for fracture damage on a sacrificial specimen either. Drill a line of holes and set off .5 to 1oz charges and see if you can get it to fracture on a line that way. Comparable to feathers and wedges, but maybe more effective. It's worth a shot. If it's not completely effective it might help you somewhat with a combination of that and the crowbar. :)

You have to do what you have to do to protect yourself. There's a difference in someone trying to make a living for himself and family and greed. You have to take care of yourself and stand firm what are they going to do wait to see what you pull out 1st to see if they are going to go forward? Sorry just venting for you. I stand corrected, I know the county paper work takes precedence and yes a claimant has up to 90 days from date of location to file with the BLM, however if they don’t file within 90 days the claim becomes null and void even at the county level. And yes you can do limited work under a notice of intent, it is up to the land management agency to decide at what level you need a plan of operation, the USFS wants a plan of operation on just about anything, BLM is much more lenient. I have had most of my dealings with the forest service. I even had to allow the public to camp right on top of where we were working. On one claim I no vehicular access to the claim but the public could drive and camp several places. I had to park on the county road and haul my equipment by had several hundred yards.

unpatented mining claims on federal land "BLM"can not restrict access on or across the claim site.And seance the mid-90s you can not get a patented mining claim anymore. laws are very very clear on this.

They can't keep you from crossing their claims, there is still public access that has to be allowed. Cross it as you will and access your claim. I suspect they know that you have the best spot. Make sure they stay off your claim and that prospecting is not allowed on your side of the boundary. I wouldn't let them have anything - just on principal!

Big companies pay for any tips As for the old owners claim you found, During WW2 fed-gov closed all mines industry with the intent to move the mining labor force into war related metals I believe only one mine was open that was not war related and it was foreign owned !. Bureau of Land Management is the agency that regulates mining claims on public land and FLPMA (Federal Land Policy Management Act) is the act that gives them certain management and rule making ability, I'm not sure the BLM existed in it's current form before that act was passed.

Thank -the jade ones are on hold as my claims are under option by a mining company currently, hopefully I can detail this more in the future but right now I'm contractually obligated to say nothing beyond this until they issue a press release. Hopefully I'll have some time to do some more exploration videos this summer if I get lucky with some finds, and I'll probably do a couple gold prospecting videos if I get lucky there too. Right now my goals are swaying more towards acquiring and developing private properties though and less exploration even though that's what I really love, got to make a living.

And you can travel across theirs to get to yours.....they cannot keep you from your claim.....

Why don't you do a release delay date for your prospecting videos, say about 3,6,9 or 12 months. So you have time to prove your claim and decided if you need to expand it in any direction? This will alow you to maintain some socal media secrecy. Give you time to improve and edit your videos. An still share your journey and knowledge. Great work. CL

Thanks. I'm now bound by non-disclosure on this particular claim so I can't really say or show much, but that should probably say something in itself. But I think next year I can show some interesting things that I'm excited about. I hope to get some time to prospect for new claims early this fall again which I can film as I please, but time is slim as my unrelated full time business is also busiest during the summer/fall, time is always the most precious commodity it seems.

why don't you take your green quartz to a carver and a gem cutter and ask them to use them for tests so you can see how it turns out, it could be a nice collab video and you don't have to get great experts just the ability to do something really simple and basic but precisely.

Being smart enough to hide the location in your videos, why didn't you claim enough land to preserve access to your main claim? Was it a matter of the fileing fees?

After watching this, I realize you don't understand how people can look stuff up. Also everything hasn't been found before, I get tired of hearing people say that. No they didn't know what they were doing as much as we know now. Maybe where you are, but not where I am. So please stop saying everything was found once before because it hasn't even come close. Just the easy stuff. Good luck, they can't keep you out of your claim because they have the 360 claims around you. Stop listening to others including me, and do your own research.

People are jealous and thats not cool. If you wasn't nice enough to share you find with us that stuff could have just been laying there for the next 100 years. People want to start talking about how you have to do this and that but the fact is you found it abandoned. As far as im concerned it's yours. You should be able to take your sweet time if you want. Now because of these not cool people you might not share and let us see these great places, not cool. I would have walked right buy those rocks there nothing there it looks like, if one doesn't know.
