Hello, this the case:: I'm a US Citizen and my wife also. 1 year ago, my brother-in-law (wife's brother) came to the US on a Humanitarian Parole for 2 years. It is expiring in Oct. 2025. Does he need to adjust his status by the I-485 form only? Or does my wife have to petition him first with the I-130 as sibling and then the I-485? Can these forms be filed concurrently or not? Will he need to leave the US while the forms are pending? I'm not sure which is the best route for him. Appreciate you taking the time to read this.

What if the immediate spouse's I-94 expired, and only the I-130 was filed (not concurrent with the I-485)? Can they still stay?

My wife is a usa citizen. She lives here in Canada with me. If I filed my I-130, could I technically move to the USA with her until it’s run its course through the system? Or is that illegal? I know as a Canadian citizen I get up to 180 days or something close to that for “vacation” time to stay in the us as well. So I don’t know if I’d be allowed to move down there under those terms and then stay because my I-130 was filed. Thank you if you get back to me. I’ll likely be giving you a call sometime in Jan to clarify some questions as well.

I won the green card lottery in 2018 and came to America. I just got married and she lives in Turkey. I am applying for I-130. What was your date of admission? city or town? state? . I did not understand this question. Should I write the date on the green card? Or should I write the date I first stepped into America and the airport address?

Hi Jim, for immediate relatives of US citizen, can they remain in the US after the US citizen files I-130? Or must they also file I-485 in order to remain here? I’m asking because as of December USCIS no longer accepts I-485 without I-693, and yet the beneficiaries cannot file I-485 due to I-693 complications from TB testing/treatment which can take months, meaning that the immediate relatives are being forced to stay out of status until they can obtain medical clearance. I’m asking because your video seems to say even if they don’t file I-485, they may still remain as long as the US citizen sponsor files I-130? Correct me if I am wrong.

I would really like to hear this response. I am a long term permanent resident and have a pending i30 for my wife and kids who are currently here in the USA with me. However there b2-visitor visas are expiring in a month. We also are wondering if we need to file form I485 for them to remain here, cuz we too are waiting on medical clearance for form I693 so we can submit the green card application. I’m worried that the visa will expire before we are able to submit the I485 application and we will be out of status, and have our application rejected.

Hi, I filed I-130 for my Canadian parents while they were in the US. Then they they left for Canada because their 6 month permission was coming up. Then I communicated to them asking to change for Consular option through US embassy in Canada. Can I ask them again to revert back to being in the US? Thanks.

I had my interview at the U.S. Embassy, and after the interview, they gave me a paper stating that my case was going into administrative processing. After about two months, I checked my case status, and it was marked as "ready." I then received an email from the embassy asking me to complete my medical examination. After I did that, they requested that I get the COVID-19 vaccination. At that time, my case status was still "ready." However, it has now been more than a week since the status changed to "refused," but I still haven’t received any email from the embassy.
