not if you're in removal proceedings. you will get denied. USCIS is not going to approve if you have a pending case with a judge

my husband is a US citizen. we will choose the I130 route (Consular Processing) however since I cannot yet join him due to being caregiver to a parent in end-of-life stage. We don't know what that timeline can be so we haven't done anything at all. We both take turns to travel back and forth every few weeks as circumstance allows since I do have a valid B visa. When we file, my I130 is approved, I get my consular appt and I am successful, I cannot enter the US and stay there for an extended period of time while any final paperwork is done, again with a parent in end-of-life stage. Any advice?

Yes once he is living in the USA. I didn't know before and my case took like 2 plus years to approved.. I filed i130 and 1 year after I filed i485 and the process took longer

Once you came in legally you can file the i130 and i485.. if you came illegal you cannot ajst your Satus from in the US you would have to go back

Question.. if the beneficiary entered illegally when Biden was allowing them to do so, and she was granted TPS after entering, (she's from Venezuela), we are married, and have spoken to a lawyer, we have paid a few thousand dollars and we're about to file forms.. what do you think we should do?
