Why is it that pain and suffering should not have been considered? True, pain and suffering can be an expected outcome of a surgical procedure but that doesn’t necessarily mean that the pain and suffering could not have resulted from a failure on McGee’s part. What’s up with that? Am I missing something?

Probably just a feature of contract which has different damages than tort law. Today, this case would have been a negligence tort and Hawkins could have gotten damages for pain and suffering.

We are not given enough explanation of the description and function of the hand before and after the operation. After the operation, could he use the hand more or less than he did before? Was there more or less pain when he used the hand after the operation? Forget the look of a hairy hand. The hair can be plucked out and shaved. If you forget the guarantee of 100% improvement, would there have been a lawsuit? So the result is that all doctors should only guarantee their success up to 99%.

None of this has anything to do with why this case is studied. It is simply an example of Expectation Damages awards. There’s no need to look any deeper
