Those who think fratricide is Halal are wrong. Here's why: Prophet Muhammd (Peace Be Upon Him) said, "I do not want to see you after I am gone reverting to disbelievers, striking the necks of one another (killing one another). No man is punished for the crime of his father or the crime of his brother." (Nasa'i) The meaning is simple. You are not the owners of someone but Allah is, and Allah says in the Quran: "We ordained for the Children of Israel that if any one slew a person -- unless it be for murder or for spreading mischief in the land -- it would be as if he slew the whole people; and if any one saved a life, it would be as if he saved the life of the whole people." I ask these scholars some questions, and they're unable to deny this explanation. Did Prophet Muhammd (Peace Be Upon Him) do fratricide? Did Hazrat Abu Bakr, Hazrat Umar, Hazrat Usman, Hazrat Ali, and Hazrat Hassan ibn Ali (May Allah Be Pleased With Them), commit fratricide? No! Because they were pious. They were religious. They were the true Caliphs of Islam. You can not defend anyone just by seeing their achievements. You can not defend figures like Suleiman the Magnificent, Selim I, or Murad IV just because they were kings. Even imperialism is disliked in Islam. Syedna Nu'man bin Bashir (May Allah Be Pleased With Him) narrates that Hudhaifah (May Allah Be Pleased With Him), the confidant of the Prophet (Peace Be Upon Him) said: I have memorized the sermons of the Messenger of Allah regarding the rulers that the Messenger of Allah said: "Prophethood will be amongst you as long as Allah wishes, then He will lift it up when He wishes to lift it up. Then there will be Caliphate on the way of the Prophethood, and it will be as long as Allah wishes it to be, then Allah will lift it up when He wishes to lift it up. Then there will be an inheritance rule, and it will last as long as Allah wishes it to, then He will lift it up when He wishes to lift it up. Then there will be a coercive rule, and it will last as long as Allah wishes it to be, then Allah will lift it up when He wishes to lift it up. Then there will be a Caliphate on the way of Prophethood (i.e., the Rashidun Caliphate of Imam Mahdi before the Day of Judgment)." Here, the term "inheritance rule" includes all of them: the Umayyad, Abbasid, Mughal, Timurid, Safavid, and Ottoman dynasties. So, you can not defend anyone, even a king, as long as you are not sure about their character. Similarly, you can not defend a sin using weak evidence.
