How can he bring a case up that was never brought to court because the attorney's office refused to prosecute? If Warren wanted to dismiss a case he had the discretion to do so but he can't dismiss all cases under a blanket policy.

Where in the' Florida Constitution does it say a lawyer doesn't have to enforce certain laws? Warren has acted a law unto himself by instituting a policy during his current term of presumptive non-enforcement for certain criminal violations, including trespassing at a business location, disorderly conduct, disorderly intoxication, and prostitution.

Both the governor and the attorneys are entitled to discretion. But just like getting a warrant it has to be with cause. Not prosecuting a repeat offender no longer fits into that category. Discretion is applicable per case not every bicyclist or every this that or the other.

Correct; he should be free to exercise prosecutorial discretion; and arresting the homeless for being homeless is just simply an example in proving some laws are dysfunctional…in the first place.
