If someone walks up on you and squares up they can't cry about you blowing smoke in their face. I don't care if they have a badge. I'm very pro-cop but I think it's important to call out cops when they're being overly aggressive. He's not the one that called 911 so they didn't immediately have justification to start trespassing into his garage and pushing him into a corner until he exhaled his cig and call that aggravated battery. What they should have done was leave him to cool off in his garage for a minute and go talk to the lady that actually called them to get her side of the story. For all they knew at the time it could've been someone crying wolf and they might not have even had the question him in the first place. Act right officers. Don't be so overly aggressive and definitely don't get angry and use your badge to retaliate just because someone is questioning your authority

Those kinds of persons just try to get the power over the situation and you need to make sure as a police officer, that they do in fact not have the power to control the situation as soon as they arrive because he already seemed to intimidate someone else. The female cop even asked him "do you wanna talk to me instead" but he just ranted off about the cop that stood there. And the cop did NOT arrest him for blowing smoke in his face. He even pushed him back twice. If someone gets to close to comfort, thats absolutely okay to do so and police officers especially cant allow people to get to close because they can be dangerous. He was outraged and aggressive all the time. The policeofficer asked him TWICE to not come to close. He arrested him because he actually threw something at him. Thats just plain not okay. The officer never attacked him. Maybe you could say "he can just accept that behaviour" but actually no. You could just have a little respect for the peace officers and not be like this and it would not end like this. They are all screaming for their rights but I know 4 year old kids who do not throw such a tantrum. Shameful for an adult to behave like that. I still do believe like you, your approach of letting him cool down would have been better. Sometimes a person just cant stand a male officer or someone especially so just disengange out of the situation before escalating it. Still, I dont think this approach was wrong at all.

Hm, I don't usually side with the criminal but I have to say it sort of wasn't his fault but he did eventually escalate it a bit. For one they invaded his space and property, I know they were there cause of a 911 call but I don't think they have the right to demand he can't smoke a cigarette in his own private dwelling. They can probably request he doesn't but I don't think he has to abide by that request, also the cop did put hands on him first but I know he pushed him back cause he kept stepping closer into his face. Now he could probably fight that in court cause he was only trying to smack his hand away from him since he was technically defending himself from unwanted touching. Although it wouldn't probably hold up since he kept getting closer in an aggressive manner, but I still find a lot of these cops do shit like this to provoke the person into doing something like that and having a reason to arrest them.
