This scene with Elena in the market kind of makes you wonder why Don Rafael didn't imprison or execute the niñera/nanny twenty years ago where he arrested Don Diego, burned down his hacienda, and kidnapped Elena as an infant. If you look closely in the scene when Diego loses everything twenty years back, you'll notice that the nanny is detained by Rafael's men, and she sees Diego get sent to prison in the distance. She witnessed the whole thing and it explains how she recognized Elena because of the resemblance to her mother, Esperanza. Rafael was a corrupt and ruthless villain who was obviously jealous of Diego and Esperanza's marriage and persecuted the peasants of California, but he still left the niñera unharmed. Good thing Elena still remembered the scent of the Romneya flowers and hearing her real father's voice before learning the truth.

Most Nineras were powerless uneducated peasants. They couldn't read or write or had the wealth or position to be a threat to Dela Vega. She probably got another job or went back to her village
