In today's episode we yet again dive into the squatter situation that seems to keep coming up, often times in California, and we look at the story of Flash Shelton who has found a very unique way to get rid of squatters. Flash had squatters at his mother's house last year, and he came up with a plan to get them out by squatting with the squatters. It's a very interesting angle and strategy, but it worked!

Squatters rights came out of a congressional compromise in the 1800s. All 50 states are required to allow squatters, including "adverse possession" titles after so many years of occupancy. The actual laws vary by state. That's where the squatter laws came from.

easiest way to change the squatters laws is for people to squat in the homes of senators, government officials, etc. You'll see a change in the law faster than the illegal immigrants were deported from Martha's Vineyard.

And that’s where squatters should be squatting, at the rich folks homes rather than the typical working class and small time white collar workers. The middle class shouldn’t be squatted on. The rich class upper class or whatever they are should be having squatters show up to their multi million dollar homes they don’t even use

You have to remove squatters immediately on the day it happens. If they stay for an extended period without the owner not doing anything due to lack of knowledge it becomes a squatter situation.

Anyone can pull off squatting. Paperwork is very easy to fake. VERY EASY. that being said, I see no problem in someone taking over AN OBVIOUSLY ABANDONED HOUSE. legally. It's only trespass if its posted. And tresspass is null and void with very easily produced papers.

One really quick way to get these laws changed is to get some squatters to move into the houses of the lawmakers. Once they personally feel the effects of this situation, they'll be fully on board with changing the laws to solve this problem.

Unfortunately that probably wouldn’t fix the problem. Many of these cities where squatters are a problem the politicians would have special reasons to actually get the squatters removed by the police.

This is one of the many reasons I tried to tell my ex that she didn't need to announce on social media everytime we would be away from our place. It was basically announcing to people that we wouldn't be there to prevent being robbed.

Then when I would say she shouldn't post all of our life on there, she accused me of not wanting people to know we were together. Along with complaining I didn't like and comment on her posts, even if we were sitting together. Can't fix crazy unfortunately haha.

@@suzubee9602 I had no issues of her posting vacation pictures or what not after. It was the "Hey, we will be leaving for vacation tmw for a week", or the "I made this for breakfast" posts. Me not commenting on the FB post was a kin to saying I didn't enjoy the food to her. Or any fight, the entire details were posted online, from her perspective of course, followed by friends of hers bashing me, then 3 hrs later a "I love him so much" post. The exact type of person I hate on social media haha.

The State of Florida just passed Bill 621 that give the sheriffs the right to go in and remove squatters from the home right away.

Pretty sure The 4th Amendment already confirms every property owners power to protect it. If The People agreed to restrict the Government from unlawful seizure of property, how much more egregious the offence by your common man. This wouldn't even be a dilemma in Free America. Squatters rights seems like it's some law from 1876 where you'd find a Shack in the middle of nowhere that was overgrown and you assume no one's living there so you move in. It doesn't seem realistic for metropolitan areas.

@@lordchaa1598 right! I later looked it up and I wasn't too far off, but it wasn't an unreasonable law back then imo, but in 2024 if I leave my house unattended for a bit it doesn't mean that I've abandoned my house, especially if I own it outright or currently paying a mortgage

@@DaSmoothClutch My question is why do they need a bill to deal with squatters? Why can't the police just use decrement and discretion to figure out who is telling the truth. The home owner can provide a copy of the lease and if it's notarized thats even better. They can also provide utility bills, Title, and even proof of hone owners insurance to the cops. More than likely your next door neighbors can even vouch for you and confirm that you live there and that they never seen the squatter before. If it's out of the cops league then they could have a detective sent to your house to investigate the situation right away.

Because the police are not judges who interpret the law. Police enforce the laws. Police departments probably do not have resources to assign detectives to every alleged squatter scenario. Squatters by squatting become residents who therefore have rights under existing landlord tenant laws. New legislation would disambiguate legal tenants from squatters.

@@lordchaa1598 no. squatters rights and tenants rights are one and the same. They are there because this is a civil matter, not criminal. Cops are not judges, so if the squatter forged documents (which they almost always do)the police have no choice but to believe the documents, even if you are there and have the actual documents. Criminal charges for theft or trespassing can/will not be filed until after the civil case is done. Squatters rights don't actually exist, its just tenants rights rebranded for the situation, its slang in a sense.

​@luvbug1318 There isnt a 'situation' that should allow someone to steal another person's home and/or property regardless of how destitute they are. The commandment isn't 'Thou shalt not steal, unless you you think you need it more than the rightful owner." If it's not yours, it's not yours.

Our enemies want us to have a civil war but we won’t fight each other until we hate each other. So while the squatters are wrong, I’m not going to hate them or harden my heart to them. The homeowner did what he had to do and I sympathize with him too. We may just survive if we can harden our resolve and soften our hearts. Peace.

Woman here. So many of us have fallen on really hard times. I lost my house, and so had to give away most of my furniture. I ended up living in a caravan for a year and a half and also lived in a shared house with 4 male mates for a couple of years while I saved to get myself back jnto my own place. Never once did i feel entitled to steal someone elses home. What a wicked and gross thing to inflict on someone.

I had squaters..lost my house for closer and chapter 11.. when I saw the guy finally get kicked out he smiled at me and gave me a hand signal..I gave him one back in the form of a Glock...

a very rare occasional few of these people - but probably fewer than 1% - are signing false leases by scammers. but that's an exception to the rule.

A friend of mine in Texas went over and removed all the doors, some windows, pretended to be fixing the electric and water to disable it and they left that day. They screwed up the sheet rock and carpets but they were out.

Squatters can, (and do), produce rental agreements. Fake or not, cops are not judges in determining the validity of a rental agreement. This would fall under the jurisdiction of a civil court of law - which requires the homeowner to sue. The "squatter's rights" are actually tenant rights until it is determined by a civil court of law that the rental agreement is invalid. This process could take thousands of dollars and months and months as they secure lawyers, file documents, and wait for the court date.

​@@juliefall2892in South Africa you are not even allowed to change the door locks or turn off electricity and water. You are also not allowed to remove any of their belongings. It takes many months and a LOT of money for an eviction order from the courts.😢 😢😢😢

Squatting is a good thing. Giant investment companies own entire empty neighborhoods, having complete control of the amount of money they charge for rent. They are putting these stories in the media to popularize the basically non-existent issue, so when the collapse does come, we legally will not be able to live in their empty properties. Florida is super close to passing House Bill 621, which criminalizes squatters through an immediate affidavit eviction through the Sheriff's Office, without delays like a typical eviction notice. Not a single member of the State Senate or House has voted nay, meaning Florida is one of the closest states to finalizing a solution to this problem.

You call the cops, tell them you place is being burgled, tell them you think they are armed, and all the items in the house belong to you if asked! I guarantee they are going to be all arrested with force by the cops! Turn up just before the cops and quietly break a rear window. They will be arrested and removed, and the second the people are gone, have a truck waiting around the corner, completely clean out everything as quickly as possible and change every lock ASAP... Dont even use the terminology of squatter, its burglary with a weapon, break and enter, and tresspass.

Yes - I helped friends with, with 15 people we just waiting outside, squatters went out and we throwing everything out of the house in the sidewalk, cleaning upper floor - changing locks, put a sofa and Tv and we gaming ps5 until police coming… The squatters call the police ! We just showed them the ownership of the house, saying we don’t now what these people want and that’s all.

I had squatters last year, and after 6 months, and returning from overseas with my daughter, they had absolutely destroyed my house. Left feces in the guest bathroom, 3 different shape/size/consistency, they also left a dead raccoon, in the oven ( I can only assume it was.) The level of vandalism, is hard to describe, without sounding like I'd exaggerated the story... had 0 help whatsoever in regards to fixing it and or saving it from having it rebuild. It goes without saying, that after they left, they also stole everything my daughter and I had. Yeah, yeah, I am hunting the squatters. Some squatters look up homes for rent, pay the first or second monthly rent before they stop paying completely. My sister told me that her friend’s dad had squatters once. Dad called the police and all the police was able to do was ask, “do you have proof you’re allowed to live here?” They said, they have been sending checks to the aunt (seems to be an accountant) to pay their rent. Aunt had to say “what checks? Never got the checks?” And they said “but we sent you the checks” and she said “but I never cashed it”. And eventually the squatters were removed. It’s crazy.

It’s pretty simple. Home owners should have to register a lease with the county. If the renter doesn’t have a lease that’s registered . Then they don’t have any right to be on the property.

Florida legislature is in the process of approving a law that will force squatters out of the home and the sheriff's office will have to remove the squatters once the true homeowner supplies paperwork proving ownership. HB 621 is expected to pass and be signed by the governor and go into effect on 7/1/2024.

I know someone who set up a tent in FL in a building with no roof or floors. It was brick walls & everything else was gone. The police made them move out even though they pretended to have permission to be there.

Change what laws ? You don't even know do you ? So how could you say who all is in agreement ? But for starters , changing the laws about adverse possession would not solve problem one with these devious minded people who search out and move into what they view as easy pickens . Although it would probably be good to work on a national list of reference to then be able to prove someone is guilty of serial squatting and had the mens rea it took to do it . I've been thinking one way property owners could protect themselves would be to publish an add in a news paper , or some other public notice instrument . To say they would not rent / lease or let someone habitate in said property without such n such documentation from this date . Which would then help alleviate the courts doubt on there being an oral agreement or implied lease . But simply taking an active interest in your property while vacant and having a good report with the neighbors would be a great line of defense against the breaking and entering / trespassing moment .

This happened to me back in 1997 through 2005 in New York City. She called the cops on me many times, threatened my life, and all the horrors you could imagine. She lived for four years, rent free. Once the problem was resolved, I sold out and in 2005 left New York City FOR GOOD! This problem has been around for decades.

Yes, but back then, they could only occupy. The new 2024 laws in NY, Oregon, Washington, etc. say that they own your home after squatting for 30 days. They can literally sell your house after proving that they have been illegally occupying it for only 30 days. And you can't do anything legal to kick them out in less than 30 days. Imagine how many more squatters that will motivate? And they won't be leaving the house to go to work, they'll just show up with 30 days worth of rations and camp out until its theirs. Then they'll sell and repeat the process. Why would anyone do anything else for a living?

Hi I just read your story. You can't have property in living here in NYC like me. I still have 2 squatters occupying two 6 room apartments at my three family 12 ago. Covid19, the eviction moratorium made it worst getting stuck with these destructive squattters. They try to trump up small violations so they can live here forever one told me. Mayor de Blasio offered fee hotels remember 2020? They refused to go. So One of them I feel had me attacked by one of the pizza store friends now I'm crippled on one side of my body destroyed left leg's meniscus. The currupt🎉 Police wouldn't even make a report so I get my 150,000 medical bills paid for with this 'Victims compensation fund' because they're good friends with store owner. As a senior o have Medicare which paid less than 80%. I'm still in pain with every step these past few yrs. Yep I've been a victim of elder abuse intimidating and bullity me with threatening extortion try to blackmail me ect. Not even the Brooklyn DAs office could give a damn about helping victims of senior abuse. They're still there driving me close to the edge. I've been looking for a lawyer who can use these threats l, intimidation, harassment to get them out faster. I hope this works I got plenty of evidence. I'm too tired 73 years old I can't enjoy the rest of my life being tormented by these horrible excuse for human beings. The police I called many times and they told me Brooklyn is the worst place with these squatters. Don't know if squatter hunter can help. The rules here the Laws pretty much demonize the landlord. I’ve heard of some people, even a few people I knew of in Tennessee, who had squatters get in their house when they went away for a business trip… Do you know how they got the squatters out after their bank and the government wouldn’t help them in even when they went to get papers they refused to allow them to evict them … They just stopped paying their mortgage and their property taxes and the utilities even though they were told they weren’t allowed to stop those …. The house closed because why pay for something you’re not allowed to be living in?! They saved the money they were paying for those things to put away to be able to buy a house outright and start all over because they were gonna have to whether they went to court and paid the money so they decided to stop going to court and just save the money from the mortgage they were already paying…. Took a couple years, but it got them out because the bank sure as hell isn’t gonna let anybody stay in there once they take possession of it… It’s odd to me that a bank would be willing to help you get back your investment because once the house is foreclosed on, usually those tenants will destroy the house …. Which makes it less valuable than it was when you were living in it.. Apparently we have a problem of people not caring about what’s best in the long run and just care about immediate catering to what looks good at the moment…. In the end , everyone loses, but at least someone can start over.

Here where i live there's not such thing as squatters rights, so this situation looks insane to me. It would make sense if it was legal to occupy abandoned property, but people moving in a house that is currently for sale and claming rights to it is straight up a corporate raid.

@@FreedomTalkMediayour furniture does disappear when you become homeless because you sell it since you have no place to store it and no money to store it. Or you sell it to pay for a place to live. Sorry but homeless people don’t travel with that many clothes, furniture and a rental truck. What, did she lose her house the same day she squatted? And again if you’re losing your house you get notices saying you’re not paying your bill/rent for months in advance before being evicted or foreclosed on. Normal people sell everything they can so they can pay their rent or mortgage plus they start looking for something smaller or less expensive that they can afford. You don’t put your stuff in a storage unit and then look for a house that’s for sale to squat in and then hire a rental truck to move your stuff from storage unit. She knew what she was doing was wrong and criminal but she also knows that criminals are getting treated better than law abiding citizens. She knew exactly what she was doing. And it’s my understanding that she worked as a prison guard, so she had a job and prison guard jobs are usually good paying ones. Plus she had nicer stuff than I own furniture wise so again she wasn’t down and out. If she was then she obviously has a spending problem. She’s a straight up CRIMINAL and the only reason she was being sort of nice was because he had got the upper hand and she didn’t want her furniture given away to others. She’s ok with breaking in and stealing a house from somebody else but not ok with her stuff being given away to others. If you watch the whole video of this, she never really admits that she’s did something really wrong in breaking into the house and squatting, she just plays the victim most of the time and only says “she let things get out of hand” when she’s trying to negotiate more time to get her stuff out. All she cares about is herself and her stuff.

@@Real.Estate.ReportMy company has done this type of work for the last 4 years as a branch of my Private Investigation Company. I'm pretty sure Flash got the idea from us as I remember talking to him a while back and he asked a lot of questions. After I told him to check his state laws but most states will not kick ANYONE out who has a legally signed lease I remember hearing about his situation. It seems as if Flash has gotten kind of "soft" since his first deal when he kicked the squatters out of his mother's house. I suppose he is a bit afraid of getting sued or hurt. We go in with 6-8 big guys. We just march right into the home and tell the squatters we have a legally signed lease and we are taking over. They can easily see that we are all armed. Then we go into the bedrooms they are using and we "claim them" for our own use and throw their stuff out into the main living area. Then we install wireless cameras (for our own safety against being accused of illegal things) and we crank up the music really loud. We also set up "party lights" aka high-wattage strobe lights in the areas the squatters have been relegated to. We tell them they need to watch out at the parties we will be hosting starting that night because they get huge and out of control. Some of the guys that come to them have been accused of SA but never convicted LOL. At that point, 90% of the squatters start gathering their stuff up and leave. We have had a couple that lasted up to 12 hours and only two who lasted longer than that. One made it 23 hours and another made it 29 hours. We keep track of our success record for advertising and pride reasons. We are 137-0 against squatters. We do NOT break any laws but we do give the idea that we might. We have been known to bend a few. We also alert law enforcement before we go to a property and they always want to see the videos of how we do it LOL. By doing it this way and with our successful track record, IF the cops have to come, they are always on our side. We also do not hesitate to call CPS if we feel there are children in danger and often we tell the squatters with kids to have them go outside to play while we get "settled in". We don't want children to be traumatized. One of my Investigators adopted 3 kids from a squatter addicted to crack a couple of years ago. She willingly gave them up to foster care and also gave up her parental rights. We will always help squatters secure housing if they ask and act reasonably, especially if they have kids. I have even "housed some of them" in a guest cabin on my property for a period of time. But I do warn them about bad things happening if they try squatting lol. Most of the squatters are just losers looking for a free pass on housing so we don't help them at all. We have only had a handful of times where things got hairy and it turned physical. We called the cops right away and with our video we were able to charge them with assault and of course, they got taken to jail which means they are gone from the home.

This changed when states and cities decided they were going all the way Lefty. In NY, Washington and some other states, the new laws say you just need to prove residence (such as with a bill of some sort mailed to your name at that address) for 30 days and you can legally own and sell the house. A bunch of these homes have recently gone up for sale by the squatters, which is why these squatter stories are suddenly trending.

We had squatters in a rural property that we bought. We showed up, blasted baby shark on loop right outside the front door on a speaker, opened the garage parked a car in there and blasted the horn. They left after about 2 hours.

Just an FYI for anyone who’s ever in a situation where they have squatters: 1-When calling the cops don’t say “there are squatters in my home” that’ll 90% of the time make them hesitate to intervene as they would most likely say “this is a civil matter you have to go through the legal eviction process” 2-Call the police and state “there is a burglary in progress or an intruder in my home” 9xs outta 10 they’ll respond with urgency ready to investigate the crime as such. 3-If you go through the eviction proceedings and the squatter won’t budge remember if they have “squatters rights” so do you with that being said like Flash Shelton move in and make them as uncomfortable as possible (unless you feel it’s too dangerous of course) 4-DO NOT disconnect the electricity or water unfortunately that is illegal in spite of them being there illegally they actually still have rights (unfortunately) 5-If you have a rental property or unoccupied house always have someone check on it regularly and even if you go there sometimes to hang out just to make it appear occupied never leave it unattended for long periods of time that is a squatters dream! 6-If unfortunately you do encounter this f’d up situation DO NOT confront them alone even if you have a legal weapon always get law enforcement involved and document everything! Hopefully this helps someone if need be.

Squatters' rights were intended to apply to fully abandoned properties that were at the point of falling into disrepair, not private residences that are just currently unoccupied. This is another way local governments are siding with criminals to sow division and discontent.

Yeah I was also thinking that if you are truly that desperate and also happen to find an abandoned house that is 100% abandoned(like clear signs that nobody has been there for decades, house is half falling apart, leaves and dirt on the inside of the house etc). Then it hurts nobody if a squatter stays there. But obviously it's not a good idea to go to a house where they know has an owner and be like "ey you moved out for 1 month so it's ours now". Ehhhhhhh the fuck? What is the thinking process there??? They can clearly see the house is not ACTUALLY abandoned by just optics alone.

Part of the reason for squatters' rights was to prevent people from forming up a posse and violently evicting folks, getting things to go through the legal system. Folks get their property back, the sheriff is the guy showing up to escort the squatters off the property, nobody gets hurt. All of that depends on the legal system functioning properly. When the courts take months to get to the case and the police won't do anything, that's when it really breaks down. Unfortunately, this Squat the Squatters approach might be the best option for a while. The big issue will be when it overlaps with gang issues and you've got an armed group inside of the house, rather than just a couple of entitled bums.

Because of squatters’ rights in Spain for example, property owners who plan to be absent from their property will actually go to the extreme precaution to remove windows and doors and fill them in with mortared concrete blocks because even bars on windows won’t keep out a determined squatter. Also, there are “Flash” type guys you can hire to remove the squatters. When squatters leave to get groceries or go to work or whatever, the guard at the door and will not let them back in. One by one, they are eventually removed because the guard does not allow deliveries to cross the door and nobody gets back in. It’s much faster and less expensive in the long run than going to court to have the squatters removed.

I lost my house and everything in a fire that left me homeless. It took almost 10 years to recover and at no point did I have the notion to just check in to some random people's house and make them homeless. When did our nation become beholden to criminals? Since when do criminals have more rights than the citizens who have to live with it? It's chronic, a guy can walk around punching people and causing damage but if you lay a hand on him, you get charged with assault and you go to jail, meanwhile the guy who caused the problem just diddy bops on down the road because he was the real victim here. I'm ashamed of my own country.

I had an uncle who dumped his family and moved to California. He was a lawyer and bought some rental property which was soon occupied by squatters who moved in and then refused to pay rent. Since they had broken the lease he was perfectly free to issue another legal lease, so he leased the house to the Hell's Angels. Squatter problem solved.

My parents used to go away for the winter months. They had an alarm system, a plow driver, automatic lights, a friend who came by and checked on the house, and then my family would come every weekend and stay. It's unbelievable what homeowners have to do to keep squatters from illegally overtaking their home, because getting them out is a legal nightmare. It shouldn't be this way.

You shouldn't have to deal with such people legally in the first place. They have no regard for the law so why take the hard path. Most people will have extralegal solutions either in their direct friendship circle or via a friend's circle. No squatter will remain willingly in an unsafe environment for long.
