I called an attorney and hiring what happened because of the other person was at fault he failed to yield the right-of-way and I'm going to therapy is right now and I'm supposed to be having an MRI this weekend I've been watching a lot of videos of how much a case worth I know I'm going to be check on the MRI for my lumber in cervical neck my hands are kind of numb arms are hurting the doctor said he's been seeing me explaining me that from hitting the older vehicle that got into my lane I have my hands up serve it the whole weight of the other vehicle my attorney told me that the older guys insurance which it which it was sent to students for my high school has insurance and it has a bodily injury limit of $25,000 my question is if my case is worth more and what is going to happen with the rest of the money the insurance only has a $25,000 limit thank you very much I hope you understand my question.

Experienced a rear end 0n Labor Day that just recently passed. Our SUV didn't sustain too much damage ($1500+) as our hitch kept the vehicle from actually reaching my children in which 2 were in the very back. With that being said, The accident has woken injuries in my husband from a previous rear end plus added new ones. As for myself, I thought I was fine until the tingling in my right arm/hand wouldn't go away among other symptoms. I'm a fairly healthy young woman and have never been in any accidents or sustained any injuries whatsoever. So it really shocked me when I recently got my MRI results back to find out my C4, C5 discs are bulging, my C6 is herniated and my C7 is also bulging. After getting these results, it really explains the constant pressure on my neck and the headaches it brings along with it...this was very informational as am a Florida resident. Thank you.

i was tboned by a state vehicle after he ran a red light, all on police report here in texas on december 6th 2022, and i was given mri’s last week and i also have herniated disks in my lumbar section and in c5 c6, ive been going to physical therapy for about 2 months. they told me i would speak to a pain management doctor next visit. is there a way to estimate my settlement? or if im even going to get paid for this. my car was deemed totaled and i was paid for that but i guess i just dont know what to really expect from the therapies?

I got rear ended by a tractor trailer going at least 55 mph in Oklahoma Hiatal hernia surgery 2 weeks in Hospital from MRSE infection, MRI revealed Thoracic herniated disc’s and Lumbar herniated discsin addition to cervical disc’s. Hey Justin, I've watched all your amazing videos. You've helped allot of people including myself. I was in a car accident in CA last year in September, going 50mph on a hwy and a pick up truck stopped infront of me while turning left to go the opposite direction. I'm left with a L5-S1 7mm disc herniation that pinches the nerve root, and L4-L5 4mm disc protrusion with no significant nerve root impingement. I was extracted from my vehicle and was taken by ambulance to the hospital. I've done chiropractor, steroid lumbar injection with no noticable difference. I'm currently in the first stages of negotiation of the settlement. I really don't know what to expect, I wish my attorney was more like you, or maybe I'm just anxious.

@@Tekevin 15k after the fees and medical. 50k settlement. Recovery was horrible first year. 3 years later I’m like at 90%. Constant sore lower back like from lifting something heavy, but not painful anymore or any sciatic pain anymore. Don’t go for that second injection. Find anything to lower inflammation that won’t damage your gut.

They said I had degenerated herniated disc. Yet I had no pain was back and forgot in the hospital and even hospitalized after the car accident I lost feeling in my left side. I went to treatment immediately but am having a lot of pain due to an ovarian problem and I’m scheduled for surgery soon. Oscar Cedillo: Thank you for your question. Unfortunately, I don't know the value of your claim. For starters, I don't know what type of accident or incident you had. For example, perhaps you have a negligence claim, or maybe it's a workers' compensation claim. Maybe you have both. Or maybe you have a different type of claim. I simply don't know with the limited information that you gave me. Additionally, a personal injury claim value depends many factors. Two huge factors are liability and damages. Liability is whether someone else (or a company) was negligent. Damages are the extent of your injury. While you've given me some information about your herniated disc, I don't know fully know the liability and damages aspects of your claim. An attorney cannot fully understand liability and damages by reading a sentence (or more) about the facts of an incident. You should hire a lawyer who can: 1. Review your medical records, bills and other documents 2. Take photos of your injuries, damages to vehicle(s) and any other evidence. 3. Properly preserve evidence. 4. Speak with witnesses (and get statements). 5. Reduce the amount (if any) that you need to pay back your health insurer for bills that it paid. 6. Do much, much more. Hello I live in Florida and I was hit from the rear while at a traffic light. The vehicle was totaled and I was taken to the hospital by an ambulance. I have a pre- existing injury to my neck from a workplace injury(ongoing workers' comp case) but the MRI I had after the auto accident revealed that I suffered more injury to my neck. I have several herniated/bulging discs and weakness, numbness, and tingling in my neck plus other areas (left forearm extending into my left hand and fingertips.) I have ringing in my ears, invertigo and a pain that is dull(but persistent) in between my chest area, which I never had before this accident. My attorney submitted a demand for $225,000. herniated disc may not always be traumatic so the insurance may not offer much on them. in nyn a herniated disc does not alone constitute a serious injury.

Thank you for your comment. I agree that herniated discs aren’t always traumatic. In fact, this is one of the arguments that doctors (hired by insurance companies) often make in personal injury claims. In my experience, all things equal, insurance companies usually offer more money for most fractured bones than a herniated disc. At least that’s what liability insurers have done in my Florida personal injury cases. That’s said, herniated discs can still result in big payouts. It depends on the facts of the case. I think this statement is ridiculous and this reasoning needs to be evaluated. I believe that any disc/spine/nerve related injury should be considered as serious. In most cases, it causes a great deal of lasting discomfort and pain along with extensive treatment and rehabilitation. Hours and hours of physical therapy and often times uncomfortable and risky injections and a doctor recently told me that sometimes symptoms will improve in 3-5 months with this type of treatment. We all know that spine and disc issues can affect you for the rest of your life and if your case isn’t so bad, it can give you a lot of problems later in life. How do we get off to arguing that these types of injuries aren’t serious and should be low paying settlements?

Hi Justin. Really great info. I had a bad accident at the gym I was going to. A piece of equipment broke, due to wear n tear, and it cause me to fall flat on my back, full body weight. I suffered a bad concussion and 3 herniated discs in my neck. I saw a spine surgeon and he did in fact suggest surgery. I had an MRI done and they clearly show the herniations. This has impacted my life big time with my own business and part time work. I do have a lawyer, which I hardly hear from, but I am going after the gym, who had the equipment set up improperly and not certified by the equipment brand, and the actual brand itself. I have images, witnesses, everything I need to prove it was 1000000000% the gym's fault. They are both HUGE name brands. Does this increase value? Is this a big case? I am just looking for your input and general comments on this. I have been going a chiro and PT and it's about 1 1/2 months into this injury. Thanks man.

Hi +TheSalonGuy: I'm glad you liked the video. I'm sorry to hear that you were injured. You are smart for hiring a lawyer. All things equal, I think it is better for the injured claimant if the defendant is a big name brand. This is, in part, because if a jury feels that the big name brand gym, or any other responsible party is liable, they won't worry about bankrupting it. (I once spoke with a young man who was on a jury in a slip and fall case, and he told me that he felt bad for the small grocery store owner and didn't want to "punish" him. There are other jurors out there who share his view.) Here are just a few thoughts that I have. This is by no means exhaustive. My comment only applies to Florida accidents, which is where I'm licensed. In Florida, many gyms have well drafted pre-accident waivers are, thus, may be immune from liability. Therefore, many big injury, bad negligence cases may wind up being worthless if the claimant signed a valid pre-accident waiver prior to joining the gym, or working out there. However, at least one Florida trial court that I know of ruled that a pre-incident waiver wasn't binding on a gym member. The gym member's attorney made several arguments as to why the pre-incident waiver wasn't valid. One of her arguments was that the pre-incident waiver said that she received a copy of it, when she didn't. She claimed that there were several other issues with the validity of the waiver as well. You may have a large claim for past lost income, and loss of future capacity to earn money. You also may have a large claim for medical expenses, and pain and suffering, in addition to other claims. Although you're 6 weeks into your injury, this is a relatively short time. (I'm not minimizing your pain or this inconvenience.) I imagine that the gym (or its claims administrator or insurer) will run a past ISO claims check to see if you've made a claim for an injured neck prior, or after, this incident. You should ask this question to your doctor. I think it depends on the severity of the herniated disc or stenosis. For example, I know someone with severe spinal stenosis in her neck. Her doctor says that if she gets in a bad car accident, she could become paralyzed from the neck down. On the other hand, when a herniated disc occurs in the mid back it can be extremely serious. In severe cases, the pressure on the spinal cord can lead to paralysis below the waist. In contrast, there are people with a herniated disc or stenosis in their lower back who have no pain. In Florida, which is where I practice, if someone's negligence caused (or aggravated) another to have a spinal cord stimulator implanted into his/her body, then this increases the full value of the case for settlement purposes. I got a herniated disk from someone who rear ended me and just got cortisone shots bc the pain gets really bad. Which, they said if those shots and physical therapy doesn't work then they'll have to do an epidural. The adjuster wants to settle at $3k but I think it's worth more. Mr. jz here in colorado alot of drivers only carry the low limit. liability auto insaurance it will not pay anything if another driver hit you and injured you, if the driver that injured you also only carried the low limit liability insaurance which would be 25 thousand dollars and you were injured and in wheelchair or dead theres only 25 thousand dollars to gain from if the driver that hit you has no assets , it don't matter what the value of the injury is the injured get pretty near nothing, the doctors and lawyer fees gonna eat up a good chunk of it. Been there done that but i learned, now i carry the 300 thousand limit, it covers not insured and under insured and i did get in accident from another driver hitting me , and yes both insaurance companys paid together 200,000 and yes i pay a bit more a month for auto insaurance but it is well worth it. Many drivers just buy the cheapest auto insaurance and then get surprised when in accident. so all n all thought you mite give the viewers a heads up on auto coverage. Good info!Thanks😄

My wife was rear ended by a man on duty, in a company truck. 100% their fault. A year prior to this she herniated her disk requiring surgery and physical therapy, she has before(injured) and after(repaired) x rays from her surgeon. When she was rear ended recently, it herniated the same disk, it will require surgery(she went through the pt, injections, and epidural, still has nerve pain) what kind of claim can she possible see with something like this? She was offered 15k, we declined and are lawyering up. We have small kids that she can’t pick up, she is a teacher and coach, it has severely affected her occupation because of the pain. Interesting. A freight-liner truck struck my vehicle on the front right side. Completely totaled my vehicle. I’m currently going through neck & lower back injections. 2 herniated discs. Muscles spasms, wrist injury. Not to mention the severe panic attacks while driving now. Why isn’t that taken Into account? What quality of life do you have after this. How can you measure future pain from the impact of a freaking freight-liner. Truck driver lied to the police officer stating that I hit his truck. Totally impossible for the damage to my vehicle. He even yelled at me saying didn’t you see everyone trying to let me over. I was already in the far left lane waiting to make a left turn when he turned right on the street and then proceeded to cross 4 lanes to get into my lane when he slammed into my vehicle. Police officer wouldn’t give him a citation because our stories were contradictory. Thankfully I found out that someone actually witnessed the entire incident. I’m in Georgia.

I wish I would have found your videos sooner. It seems like my lawyer was in a rush to settle and did not take into consideration the long term effect of my or my husbands injuries (herniated discs being included). During our treatment, our attorney told the doctors he sent us to we could no longer be seen because we met the “max” for the amount available in our lien. We went to be seen, following up after they confirmed I had a concussion and my migraines were a result of the accident, and they turned us away because the lawyer told them to do so. This was disheartening because I was supposed to begin oxygen therapy that day which would relieve some of my pain. The last I heard, I will possibly need lumbar &/or cervical surgery and my husband only received one steroid shot but we were not seen again to find out what to do next. The amount we will walk away with will probably pay for gas for us to get to a doctor to follow up with setting up surgery and additional shots for my husband. Thank you for educating others so they have an idea of things to pay attention to in these overwhelming conditions. I really wish I would have found your videos sooner.

In Ontario Canada insurance company’s are extremely g catatropdifficult they have lobbied and manipulated our government into basically make it impossible to sue for pain and suffering and get this the first 39,000 dollars are deductible and the absolute injustice is that the lawyers for the injured cannot inform the jury of this fact meaning if they rule in your favor and award you say 50,000 u get 10 grand and if you happen to lose at trial you are responsible for paying the defendants legal fees I mean they can and will take your house and yet Ontario’s insurance rates are on average 500 bucks higher per year than the rest of canada it is beyond mere injustice it’s a national disgrace but the insurance company’s managed to squeeze even more and in 2016 managed to lower the caps even more for all different injury catagoroes if ANY this went on in florida there would very quickly be rioting in the streeet and public lynching. Insurance companies are basically the king of the hill up in the great white north ... jus wanted to share that with you I thanks for your advice and even tho our laws are different.... justice MUST prevail no matter what.....keep em coming ....J
